About this file
The document is a Build America, Buy America (BABA) Certification Form from the City of Fort Myers, Florida, pertaining to the Fleishman Park Improvements project (Invitation to Bid 25-020-ITB). The project involves demolishing and removing existing damaged roof structures over ten bleachers and twelve dugouts at Sam Fleishman Park, with plans to replace them with new structures following damage sustained during Hurricane Ian on September 28, 2022. A pre-submittal non-mandatory meeting is scheduled for January 3, 2025, at 10:00 am, with bid responses due on February 20, 2025, at 2:00 pm. The anticipated City Council approval date is March 3, 2025, and the contract timeline specifies 180 calendar days for substantial completion and 210 calendar days for final completion.
The procurement includes several notable provisions, including a 15% Minority Business Enterprise (MBE) goal and local preference points for businesses with offices in Fort Myers or Lee County. Contractors must complete multiple compliance documents, including a BABA Certification, which requires verification of domestic material sourcing. The project may involve federal funding, potentially from FEMA, introducing additional compliance requirements such as E-Verify and specific labor standards. Liquidated damages are set at $849 per day for delays beyond the specified completion timeline, and contractors must provide performance and payment bonds, maintain appropriate insurance, and adhere to strict labor and material sourcing regulations, particularly focusing on using iron, steel, manufactured products, and construction materials produced in the United States.
