Performance Work Statement (PWS) Latrines and Handwashing Stations
Laredo TX
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personal service contract under which the personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. The United States (U.S.) Government shall not exercise supervision or control over the Contractor’s employees performing the tasks herein. Such contract employees shall be accountable solely to the Contractor who, in turn shall be responsible to the U.S. Government.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide portable latrines and handwashing stations as defined in this PWS except for those items specified as government furnished property (GFP) and government furnished services (GFS). The contractor shall perform to the standards in this contract.
1.2 Background: This service requirement is in response to the Presidential National Emergency Declaration at the Southern Border of the United States on 20 January 2025. Based on this declaration, the Southern Border of the U.S. must be secured and protected and in doing so members of the Armed Forces must deploy. In order to fulfill the President’s orders, portable latrines and handwashing stations are required to sustain and support the assigned troops at various locations along the border. The current known locations and number of personnel are identified in Part V of the PWS. However, based on the uncertainty and duration of the mission requirements, locations and number of personnel may fluctuate and change over time.
1.3 Objectives: The Contractor shall provide basic life support services that include portable latrines and handwashing stations in support of the Service Members, Department of Defense Civilians, and Government Officials that are providing direct support to sealing the Southern Border in order to enable the completion of military operations.
1.4 Scope: Contractor shall provide non-personal services to provide portable latrines and handwashing stations to support military operations on the Southern Border of the US. The Contractor shall ensure latrines and hand washing stations are delivered with all necessary original equipment parts IAW the operator’s manual and this PWS with fully stocked relevant items (paper towels, hand soap, toilet paper, etc.). All items must be fully functional IAW the operator’s manual. The Government reserves the right to vary quantities and locations due to changing mission requirements. All latrines and handwashing station are to be delivered to designated locations by the Contractor.
1.5 Period of Performance: Please refer to the contract schedule for the contract’s period of performance.
1.6 General Information:
1.6.1 Quality Control Plan (QCP): Reserved.
1.6.2 Operations Security (OPSEC) SOP/Plan Requirements: The Contractor shall implement and maintain an OPSEC program for preventing the disclosure of critical information or sensitive information which could jeopardize the Government’s ability to execute its mission or to adequately protect its personnel and/or equipment. The Contractor shall develop an OPSEC Standing Operating Procedure (SOP)/plan within 90 calendar days of contract award to the Contracting Officer Representative (COR) or Contracting Officer (KO) to be reviewed and approved by the Government OPSEC Officer on the supporting installation. The SOP must contain a training plan that includes an initial OPSEC brief, continuous awareness, and annual OPSEC training. Awareness/training includes, but is not limited to information disclosure via letters, conversations, photographs, resumes, electronic mail (e-mail), social media/networking sites, dissemination of information and documents disposal. OPSEC Program shall fully comply with the provisions of AR 530-1, Operations Security.
1.6.2 Quality Assurance (QA): The government shall evaluate the contractor’s performance under this contract in accordance with (IAW) the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed IAW the performance standards and contract quality requirements are met. “Contract quality requirements” means the technical requirements in the contract relating to the quality of the product or service and those contract clauses prescribing inspection, and other quality controls incumbent on the contractor, to ensure the product or service conforms to the contractual requirements. It defines how the performance standards will be applied, the frequency of surveillance, the performance threshold, and deductions, if applicable.
1.6.3 Recognized Holidays: The contractor is required to perform services on all holidays.

1.6.4 Hours of Operation: The contractor is responsible for conducting business 24/7. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
1.6.5 Place of Performance: The work to be performed under this contract will be performed at various locations along the US Southern Border.
1.6.6 Type of Contract: The Government anticipates the award of an FFP type contract.
1.6.7 Security Requirements:

1.6.7.2 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information, and property provided for contractor use.

1.6.7.4.1 (As Determined by AT/OPSEC Review): The contractor shall follow DOD Federal Acquisition Regulation Supplement (DFARS) clause 252.223-7004, Drug-free Work Force. The contractor shall conduct drug tests, ensuring all top secret cleared contractor employees are tested at least once per year, each year of the contract, as well as when there is a reasonable suspicion that an employee uses illegal drugs. The drug testing shall be at the contractor’s expense. Positive drug test results shall be made available to both the KO and COR within 24 hours of known test results. Records of drug testing shall be made available to the COR.

1.6.7.5.2 Remedies. In addition to other remedies available to the Government, the Contractor’s failure to comply with the requirements of this paragraph may result in requiring the Contractor to remove a contractor, employee or employees from the performance of the contract.

1.6.8 Post Award Conference/Contract Periodic Progress Meetings: The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW Federal Acquisition Regulation (FAR) Subpart 42.5. The KO, COR, with other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the KO will apprise the contractor of how the government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.9 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: ensure the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the KO and Contractor of any deficiencies; coordinate availability of government furnished property; and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.10 Key Personnel: The following contractor personnel are considered key personnel by the government:
Contract Manager and Alternate Contract Manager. The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate, who shall act for the Contractor when the manager is absent, shall be designated in writing to the Contracting Officer prior to start of contract performance. The Contract Manager and alternate shall have full authority to act for the contractor on all contract matters relating to the daily operation of this contract. The Contract Manager or alternate shall be available by phone 24/7.

1.6.11.1 IA/IT Training Certification: All Contractor employees and subcontractor employees supporting IA/IT functions must be certified upon contract award as directed in DoD 8570.01-M, DFARS 252.239.7001, and AR 25-2. 1.6.12 Identification of Contractor Employees: Contractor employees shall identify themselves as Contractor personnel and shall avoid representing themselves as Government employees. This identification includes meeting attendance, answering Government telephones, email communications, and working in other situations where Contractor status is not obvious. Contractor personnel identification shall be easily identifiable through the display of badges, name tags, lanyards, etc.

1.6.12.2 Uniform: The Contractor shall provide a standard uniform for all Contractor and subcontractor employees performing services under this contract, and ensure they wear the uniform during appointed duty hours. 1.6.16. Non-Disclosure Requirements: Performance under this contract may require the Contractor to access data and information proprietary to a government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this work statement would be adverse to the interests of the Government or others. Neither the Contractor, nor Contractor personnel, shall divulge, nor release data or information developed, or obtained under performance of this work statement, except to authorize Government personnel or upon written approval of the KO. The Contractor shall not use, disclose, or reproduce proprietary data, which bears a restrictive legend, other than as specified in this PWS. All documentation showing individual names or other personal information shall apply and shall be controlled and protected under the provisions of the Privacy Act of 1974, Public Law 93-579, 5 United States Code (U.S.C.) Section 552a.
1.6.16.1 Non-Disclosure Statements: Reserved
1.6.16.2 Advertisement and Social Media: The Contractor shall NOT post information to public website or social media locations, personal or professional, that in any way disclose names, locations, hotel data, participants, discussions, pictures, etc. before, during or after the contract period of performance without the express consent of the Government. The use of propaganda violates DOD Commercial Use of Imagery Guidelines stated at (http://www.defenseimagery.mil/products/DODimagery/commercialuse.html). The Contractor shall not cite any information (e.g., contract information, pictures, locations, etc.) obtained through this contract on any marketing tools to include its company website.
1.6.16.3 Information Assurance: At no time will the Contractor or associated sub-contractor employees transmit government documents or information over using methods that do not meet the security requirements specified in the National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171, "Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations" such as personal electronic mail accounts, public digital data storage sites (cloud storage), social media platforms or instant messaging. Approved government sites such as U.S. Army Aviation and Missile Research Development and Engineering Center (ARMDEC) Safe Exchange at https://safe.amrdec.army.mil/SAFE/About.aspx, or All Partners Access Network (APAN) at https://community.apan.org/, or other transmission means determined by the government must be used.
1.6.17 Organizational Conflict of Interest (OCI): Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or http://www.defenseimagery.mil/products/dodimagery/commercialuse.html potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2. DEFINITIONS AND ACRONYMS:
2.1. Definitions:
2.1.1. Contractor. The total contractor organization or a separate entity of it; such as an affiliate, division, or plant that performs its own purchasing.
2.1.2. Contracting officer (KO). A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
2.1.3. Contracting Officer’s Representative (COR). An individual designated and authorized in writing by the contracting officer to perform specific technical or administrative functions.
2.1.4. Defective Service. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. Deliverable. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.
2.1.6. Key Personnel. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. Performance Work Statement (PWS). A statement of work for performance-based acquisitions that describes the required results in clear, specific, and objective terms with measurable outcomes.
2.1.8. Physical Security. Protection of the perimeter area, government property, and assets that prevent the loss or damage of Government property.

CONTRACTOR FURNISHED ITEMS AND SERVICES
4. Contractor Furnished Property and Services:
4.1 General: The Contractor shall furnish all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform services as described in the PWS and associated contract documents, except for those items specified in Part 3 Government Property and Services.
4.2 Secret Facility Clearance: Reserved
4.3 Materials: The Contractor shall provide all materials to perform services under this contract.
4.4 Vehicles and Equipment: The Contractor shall provide all necessary vehicles (no GSA vehicles provided for Contractor for use on this contract) and equipment to perform the work described in this PWS.
All Contractor provided vehicles, and equipment shall have the company name prominently displayed on both sides of the vehicle or equipment and present a neat, professional appearance. The contractor’s vehicles and equipment used in the performance of this contract shall meet all local, safety, and environmental requirements. Vehicles and equipment found to be unsafe shall be removed from the installation and replaced. The Contractor shall not use any Government-owned tools, materials, or parts to maintain Contractor vehicles and equipment without prior written approval of the Contracting Officer.

SPECIFIC TASKS
5. Specific Tasks: Contractor shall provide non-personal services to provide portable latrines and handwashing stations to support military operations on the Southern Border of the US.
5.1. Basic Services: The Contractor shall deliver, set up, and maintain portable latrines and handwashing stations according to the table listed in Attachment 1 – Estimated Workload Data within the PWS. These equipment sets will be in place NLT 1200CST on the first day of PoP. The equipment sets shall be tied down or tied together to prevent mishaps during windstorms.
5.2. Equipment.
5.2.1. Portable Latrines:
5.2.1.1. The Contractor shall provide, deliver, and emplace portable latrines at the location(s) provided in the table outlined in Attachment 1 – Estimated Workload Data. Portable latrines shall be enclosed on all four sides with a roof and large enough for a single standing occupant, able to withstand winds up to 30mph/45kph, and maintained in good repair. Collapsible latrines are not acceptable.
5.2.1.2. The Contractor shall ensure each portable toilet contains a minimum 60-gallon waste holding tank, a seated toilet, lockable door, and ventilation. The holding tank shall be capable of reducing odors using self-sealing or chemical technologies.
5.2.1.3. Portable latrines shall be capable of being locked, from the inside, to prevent unauthorized access and privacy.
5.2.1.4. Portable latrines shall be free of any holes in the walls or doors, have no chemical leaks, and all doors, hinges, and latches shall operate as intended in manufacturer’s design.
5.2.1.5. Each portable latrine shall be equipped with a wall-mounted toilet tissue holder, a wall- or door-mounted coat hook, and a urinal.
5.2.1.6. Urinals shall be securely fastened to the tank or structure. Urinal drains shall have adequate drain flow and/or gravity feed to the holding tank to prevent overflow from the urinal fixture.
5.2.1.7. Toilet tissue holder shall hold a minimum of two rolls of toilet tissue and be constructed in a manner to prevent free reeling of the tissue paper.
5.2.1.8. The urinals and toilet seat shall be rust proof and of a material having a non-absorbent finish.
5.2.1.9. Cleaning Services: The Contractor shall provide cleaning services a minimum of one time weekly.
Cleaning services shall include disinfecting surfaces, trash removal, and restocking toilet paper as required (minimum of 2 rolls per latrine). Portable latrines shall be serviced, sanitized, and dried a minimum of once weekly.
5.2.1.10. Waste Removal: The Contractor shall remove all urine/feces from each portable latrine’s waste holding tank a minimum of one time per week. Following waste removal, the Contractor shall disinfect the waste holding tank and restock with appropriate chemical liquid as necessary.
5.2.1.11. The Contractor shall dispose of waste in accordance with local laws and regulations. The United States Government is not responsible and will not provide any containers or transportation for waste disposal.
5.2.1.12. The Contractor shall correct deficiencies within 24 hours of notification from the KO or COR. In the event the equipment cannot be repaired to fully operational status within 24 hours, a similar replacement shall be furnished to the same location at no cost to the Government within 48 hours.
5.2.2. Handwashing Stations:
5.2.2.1. The Contractor shall provide and emplace all requested equipment sets at the designated locations to include paper towels, hand soap and/or hand sanitizer, and trash receptacles. Hand washing stations shall be able to withstand winds up to 30mph/45kph, and maintained in good repair.
5.2.2.2. The Contractor shall provide cleaning services a minimum of one time weekly. Cleaning services shall include disinfecting surfaces, trash removal, and restocking paper towels, hand sanitizer, and hand soap as required.
5.2.2.3. Trash Receptacles: The Contractor shall provide one large 30 gallon minimum trash receptacle with lid for each hand washing station. Trash receptacle contents shall be removed and disposed of in accordance with local laws and regulations. Trash receptacles will be secured to the handwashing stations to prevent displacement during high winds. The Government is not responsible for lost or unaccounted for trash receptacles.
5.2.2.4 Each hand washing station shall contain a receptacle for used “dirty” water and a separate receptacle for holding clean water. Clean water shall be potable and meet standards outlined in TB MED
577. A 1 part per million (ppm) Free Available Chlorine (FAC) residual shall be present in water added to station when servicing. Ideally, the water is checked and maintained at 1ppm FAC throughout the day, but a clean, disinfected handwashing station (to include the storage tanks) will help maintain the residual longer. Place in shaded area, if possible, to minimize bacteriological growth in ‘dirty’ water tank.
5.2.2.5. Waste Water Removal: The Contractor shall remove and dispose of used “dirty” water in accordance with local laws and regulations. The United States Government is not responsible and will not provide any containers or transportation for waste water disposal.
5.2.2.6. The Contractor shall correct deficiencies within 24 hours of notification from the KO or COR.
5.2.3. Emergency Services: The Contractor shall be available by phone to provide 24-hour emergency repair and/or replacement services for the leased equipment, including all weekends and holidays, at the Contractor’s expense. The Contractor shall provide emergency services upon notification from the KO and have repaired the equipment within 24 hours or replaced the equipment within 48 hours. All repairs, replacement, delivery and pick-up costs not due to Government negligence shall be at no additional cost to the Government. Repairs shall be on-site at the equipment’s location. All replacement/backup units utilized in the event of primary failure shall be at no additional cost to the Government.
5.2.4. Delivery Instructions: All equipment shall be delivered to the specified locations no later than 1200CST on the first day of the PoP. Delivery of equipment must be coordinated with the COR prior to delivery to confirm delivery times and location. The Contractor shall allow adequate time for a joint visual inspection. All set up must be complete and equipment ready for use at time of delivery. Delivery/pick-up costs are included in the price.
5.2.5. Unit Relocation: The contractor shall relocate units within 48 hours of notification by the COR. The contractor shall provide up to 2 moves for each unit per month at no additional cost.
5.2.6. Pre-Inspection Requirements: The Contractor shall coordinate with the COR to assure all delivery confirmations prior to arrival. At time of delivery, the Contractor shall complete a joint pre-inspection with the COR verifying that items delivered are in the correct location and are operational in accordance with the contract requirements. Contractor must be present until these joint inspections are complete.
5.2.7. PoP or Quantity Change Inspections: In the event that the Contractor is not available for a joint inspection within 48 hours of being notified of a decrease change to the PoP, the Government will conduct its inspection unilaterally and submit the inspection to the contractor as evidence that the Government’s PoP is complete. The contractor shall adjust the invoice in accordance with the adjusted PoP.
5.2.8. Inspection Sheets: The Contractor shall provide all inspection sheets. All pre- and post-inspection/acceptance sheets must be provided to the KO and COR after joint completion by the COR and Contractor. Inspection sheets must be signed and dated. Both parties’ names must be printed legibly and signed. Inspection sheets shall be sent to the KO and COR upon completion of inspection via email.
5.2.9. Removal of Equipment: The Contractor shall coordinate with the COR for removal of equipment NLT 1500 following the period of performance. Should equipment remain in place beyond the designated time listed above, the Government is not liable for usage, theft, loss, damage or replacement costs due to the contractor's negligence to take possession of owned items. If for any reason the Contractor is unable to pick-up equipment, notify the KO in writing 24 hours prior to scheduled pick-up date.
5.2.10. Contractor’s Representatives or Supervisors: The contractor shall have a company representative on call to respond to emergency maintenance requests with full telephone coverage and authority to make decisions on behalf of the company on a 24-hour basis. The time for the required maintenance call starts when the Government calls the company representative. The Contractor shall have functional voicemail.
Lack of receiving capabilities by the Contractor does not relieve the Contractor of liability for the required service call timeframe to repair or replace equipment.
5.2.11. Spillage: The contractor shall clean the area contaminated by the spillage. The contractor shall also report the type and kind of spill and provide a sample if required. Contractors are liable for the costs associated with clean-up of any spills (POL, solvents, wastewater, battery acids, paints, lubricants, refrigerant oils, hydraulic fluids, anti- freeze, etc.). Any spilled chemicals must be cleaned up in accordance with all Federal, State, and local laws, ordinances and regulations.
5.2.12. Waste Disposal: Any waste collected shall be dumped at an approved municipal, county, or state waste disposal site. All work performed under this contract, including dumping, shall be in accordance with all applicable Federal, State, and Local laws, ordinances and regulations.
