Exclusive Use: The Minimum Guarantee under the Exclusive Use contracts, as required by contract clause 52.216-22, is the total amount for Daily Availability during the Exclusive Use Period (150 days) for the first year (base year) of the contract;

however, the guaranteed quantity for daily availability is subject to reductions due to unavailability. The estimated quantity for daily availability during any extension of the exclusive use period is not guaranteed and also is subject to reductions due to unavailability. Immediately after contract award, the Contracting Officer will issue a task order obligating the guaranteed minimum amount.

On-Call: The one-time minimum amount guaranteed under the OC contract, as required by contract clause 52.216-22, is the initial OAS Inspection/Test of Contractor Aircraft and Pilot(s). When the Government requires supplies or services covered by this contract, a minimum of one (1) Government-provided inspection for each aircraft and pilot as described in Section C 52.212-4(a) Inspection/Acceptance (a) Inspection Scheduling Process will be provided. This inspection is required for the aircraft to be carded and considered for use under this contract and is therefore, of significant (not nominal) value (reference Sections C9.9 and C21.2). This line item is not separately priced and is the minimum quantity the Government intends to order (also known as the minimum guarantee) under any resulting contract(s) as required by Federal Acquisition Regulation (FAR) 16.504 and FAR 52.216-22.

A2.3 Funding will not be obligated under the Indefinite-Delivery, Indefinite-Quantity (IDIQ) contracts. The Contracting Officer will issue task orders to obligate funding for the payment of aircraft services.

A2.4 In the lower-48 states all fuel shall be provided by the contractor and should be included in the flight rate (wet rate).

A2.5 In Alaska, fuel will be furnished by the Government. All fuel not otherwise furnished by the Government must be purchased by or charged to the Contractor. The purchase must be approved by the Contracting Officer. Fuel related costs shall be recorded as a line entry (i.e., date, fuel charge, dollar amount, and use-item code fuel charge [FC]), shall be used and shall be supported by paid legible, itemized invoices from the supplier. Certified true copies may be submitted in lieu of the original invoice.

Solicitation 140D0423R0034 2023 BIA Air Attack Sensor

A3.2 AVIATION FUEL INFORMATION

The contract's hourly flight rates are subject to economic price adjustments (EPA) for changes in the price of the Jet Fuel (CONUS) fuel base price (see C14, Economic Price Adjustment-Fuel).

IMPORTANT NOTICE: The hourly flight rates proposed are subject to adjustment, up or down, due to the fluctuation in jet fuel price from the reference below. It is important for the contractor to understand the ramifications of the contract's Economic Price Adjustment clause (see C14). The referenced price below (in this section) should be considered when developing the hourly flight rates offered in your proposal. If the referenced price per gallon for jet fuel changes in accordance with section C14, the Government or contractor is entitled to an adjustment to the hourly flight rates based upon the change in fuel price per gallon and the economic cruise speed and fuel consumption of the contract aircraft. The Contractor agrees to accept price adjustments, up or down, based upon its aircraft fuel consumption information and the current reference price of jet fuel at the time of the adjustment. The adjustments will be made via issuance of a bilateral modification, which must be agreed to by both parties prior to being fully executed.
