About this file
This Performance Work Statement (PWS) details a federal contract for Hawaiian Home Lands Boundary Surveys in Maui County, focusing on conducting Standards for Federal Lands Boundary Evidence (SBE) Reviews for select parcels. The project, mandated by the Hawaiian Home Lands Recovery Act, requires a contractor to perform comprehensive boundary research and documentation for approximately 200,000 acres of Hawaiian Home Lands (HHL) Trust lands managed by the State of Hawaiʻi Department of Hawaiian Home Lands (DHHL).
The scope of work involves researching land descriptions, title records, previous surveys, and physical evidence to identify and verify land boundaries across four specific parcels: Kahikinui, Waiohulu/Keokea, Leialii, and Paukukalo. The contractor must prepare detailed documentation including weekly service reports, record research, boundary study diagrams, land surveyor reports, parcel review checklists, and land description reviews. All work must conform to federal and state survey standards, with the Bureau of Land Management's California State Office overseeing the project. The contract has a 12-month performance period, with deliverables to be submitted to the Contracting Officer's Representative (COR) in various digital formats.

PROJECT TITLE: Hawaiian Home Lands Boundary Surveys, Maui County Select
Parcels
August 21, 2025
1.0 Background on the Government’s Requirement
1.1 Introduction
The Standards for Federal Lands Boundary Evidence (SBE) Review provides a standardized process and documentation for the exchange of information gained by a diligent search of land descriptions, title related records, previous land surveys, and survey related records, maps, aerial photographs, physical inspection, and other controlling evidence pertaining to the condition and certainty of the location of boundaries. Evidence may include records and/or physical evidence that disclose the location of the surrounding property boundaries and may contain a sufficient summary of the material facts for the purpose of authenticating or not authenticating various boundary locations, including exceptions, reservations, subject to, caveats, reversions, or objections to specific portions of the exterior boundary locations of lands of the Hawaiian Home
Lands (HHL) Trust (Trust lands) managed by the State of Hawaiʻi Department of
Hawaiian Home Lands (DHHL).
While it is true that the SBE Review process cannot furnish the kind of detail that would be available through a land survey, it is a reasonable examination of the available records and evidence, providing an estimation of the risk from the condition of the boundary(s) involved in managing transactions.
Approximately 200,000 acres of land were set aside for the benefit and rehabilitation of native Hawaiians under the Hawaiian Homes Commission Act, 1920 (HHCA), 42 Stat
108. The HHCA is a cooperative federalism statute, a compound of interdependent
Federal and State law that establishes a federal law framework but also provides for implementation through State law. For practical purposes this means that the Department of the Interior has an oversight role and the DHHL is responsible for the day-to-day administration of the Trust.
1.2 Congressional Requirement
Hawaiian Home Lands Recovery Act (HHLRA) section 205(e), Surveys and Appraisals, states:
(1) Requirement – The Secretary shall conduct a survey of all Hawaiian Home Lands based on the report entitled ‘Survey Needs for the Hawaiian Home Lands,’ issued by the
Bureau of Land Management of the Department of the Interior, and dated July 1991.
(2) Other Surveys – The Secretary is authorized to conduct such other surveys and appraisals as may be necessary to make an informed decision regarding approval or disapproval of a proposed exchange.
2.0 General Scope of Work
The Contractor shall provide all commercial services to assist the Bureau of Land
Management (BLM) to identify the boundary line information of the subject sites for the locations designated in the Standards for Federal Lands Boundary Evidence (SBE)
Review request. Including title(s) of origin and investigation of all necessary land records, to ascertain the actual location of lands held by the Hawaiian Home Lands Trust
(Trust lands) on the ground by evaluating the exterior boundaries included in this PWS and to provide the necessary data and information to list each parcel in the BLM records system. The SBE Review shall meet or exceed Federal and State of Hawai’i survey standards in preparation for the conducting of a Federal Cadastral Boundary Survey of the subject parcel(s).
Survey review shall be executed in conformance with all applicable statutory law, rules and regulations, and judicial interpretations governing the survey of Federal interest lands; the Manual of Surveying Instructions 2009 (Manual); and Department of the
Interior Manual – Chapter 5 – Standards for Federal Lands Boundary Evidence (SBE) –
SBE 600 DM 5, 2014.
Except for certain portions of the boundaries adjoining water boundaries, if applicable, surveys will strictly be limited to locating the exterior boundaries. No other ties to boundaries of Federal or non-Federal interest land is required unless directed by the special instructions or the Contracting Officer’s Representative (COR). The COR can only provide direction and special instructions that are within the scope of work. Any other instruction will come from the Contracting Officer (CO).
The Contractor shall produce a water boundary report for each segment of a water boundary prior to establishing the Trust lands boundary, if applicable.
2.1 Survey Authority
All the commercial activities shall be performed by, or under the direct supervision of a
Surveyor licensed to practice land surveying in the State of Hawai’i. While Certified
Federal Surveyor (CFedS) certification is not mandatory, the Contractor must ensure that all survey work meets or exceeds CFedS standards. The Contractor may demonstrate capability to perform work in accordance with CFedS standards by employing or subcontracting a qualified CFedS, or by employing a State of Hawaiʻi licensed surveyor who is currently enrolled in a CFedS training class.
Survey review shall be made under the Federal survey authority of the BLM. Any and all decisions and inherently governmental functions regarding evaluation of evidence, survey procedures, acceptance of local monuments or local corner points will be made by the
BLM Chief Cadastral Surveyor, CA and HI, or through the recommendations of the COR prior to finalizing of any documents.
A survey plat and/or record of survey shall not be filed or recorded in the local public record by the Contractor for any project done under this contract by the Contractor. Any field or office survey work done under this contract will be considered as preliminary in nature. The BLM Chief Cadastral Surveyor, CA and HI, will make all final decisions pertaining to the field notes, plats, and filing of the survey record.
2.2 Location of Work
LSR location maps for the parcels listed below are available at https://www.doi.gov/sites/default/files/uploads/hh_islandseries_maui_lanai.pdf. Reports shall be made in a format pre-approved by BLM.
4.4 Research
The Contractor shall research and obtain all records necessary to locate a diligent search of the land descriptions, title related records, previous land surveys, and related records, maps, aerial photographs, physical inspection, and other controlling evidence pertaining to the condition and certainty of the location of boundaries. Evidence may include records and/or physical evidence that discloses the location of the surrounding property boundaries and may contain a sufficient summary of the material facts for the purpose of authentication or not authenticating various boundary locations, including exceptions, reservations, subject to, caveat, reversions, or objections to specific portions of the boundary location(s) of the Trust land boundary lines.
Contractor research for surveys and resurveys shall include applicable Government and public agencies, title companies, utility companies, DHHL entities, local surveyors, and any other location susceptible to containing pertinent information regarding the survey.
If needed, the Contractor is authorized to take testimony in accordance with the Manual from those who may have knowledge regarding the location of corners or occupancy and use boundaries.
The research for the chain of title for each parcel, a requirement under this statement of work, must reach back to the original conveyance of the lands to the Trust. Conveyances may be made through, but are not limited to, the following instruments: legislation, executive orders and proclamations, land patent grants, quit claims, and grant or exchange deeds. Note that title or management of some parcels of Trust lands may have been interrupted by executive proclamations and other instruments, thus research should reach back prior to such instruments.
