About this file
This is a Right-of-Entry Authorization document issued by the State of Nevada, Division of State Lands, to the United States Bureau of Land Management (BLM) for a fuel reduction treatment project in Baldwin Canyon, Mineral County.
The authorization grants the BLM right-of-entry to conduct fuel reduction treatment activities on state land parcels 006-410-01 and 006-410-03, including cutting down, scattering, and spacing trees to reduce wildfire severity. Work shall be executed in accordance with a Project Narrative dated August 1, 2025, on file with the Division of State Lands. The authorization extends only to the described premises in Exhibit B and does not authorize access across private lands. The fee for this authorization has been waived since the project solely serves the state. The BLM must obtain all required local, regional, state, and federal permits and approvals. All project work and related activities must be completed according to submitted application plans, with the Division of State Lands retaining the right to prohibit substantial alterations to the land. The BLM must provide before-and-after construction photographs within thirty days of project completion and record drawings within six months. The authorization is subject to mutual indemnification provisions, with the State of Nevada asserting all available immunities under Nevada Revised Statutes Chapter 41. Non-governmental entities performing work must carry general liability insurance of at least $1,000,000 per occurrence, naming the State of Nevada and its officers as additional insureds, with certificates of insurance required before entry on state property. The BLM is responsible for all maintenance, damage to state land, and compliance with environmental protection guidelines. The authorization is governed by Nevada law, with venue limited to state district court in Mineral County or Carson City. The document was executed on March 20, 2025, by Charles Donohue, State Land Registrar, and approved by Robert Mergell, Nevada Division of State Parks Administrator, and acknowledged by BLM Fuel Specialist Don Shannon on November 21, 2025.
