1.3 Location

The project is located in in Oldtown, Allegany County, Maryland within the Chesapeake and

Ohio (C&O) Canal National Historical Park (NHP) in and around milepost 155.5, which is accessed from the Paw Paw Tunnel Campground located off of Oldtown Road SE. See Sheet G1

– Construction Access of the site plans for information regarding alternatives for access to the project site.

1.4 Background

The canal tunnel was constructed by the Chesapeake & Ohio Company to allow boats to bypass a 6- mile long sinuous stretch of the Potomac River near mile post 155, known as the ‘Paw Paw

Bends’, and the adjacent steep cliffs on their way to Cumberland, Maryland. The tunnel was constructed between 1836 and 1850 and remained in operation until 1924 when it fell into disuse. The canal was purchased by the Federal Government in 1938 and by the early 1950’s, plans were being developed to repurpose the canal into a non-motorized recreational trail. In the mid-1950’s, the National Park Service started making improvements to stabilize and repair the condition of the tunnel and the towpath, and these efforts continue today.

This section of the canal and the tunnel follows the valley of Mill Run, a former tributary of the

Potomac River. Mill Run generally followed the alignment of a geologic fold axis (i.e. anticlinal fold) in the bedrock. North of the tunnel, the canal was created by deepening and widening the valley through predominantly shale bedrock. The excavation for the canal cuts across the anticlinal axis of the fold at an oblique angle exposing potentially unstable rock slope conditions on both the east and west sides of the canal prism. Historic landslides and rockfall events have occurred within the canal prism since its construction.

In 2017-2019, the National Park Service took measures to stabilize the east slope of the canal prism. This stabilization effort included rock scaling, and installation of rock bolts, shear blocks, barrier fences (installed in 2013), and weep drains. This project builds upon that project by stabilizing the landslide area on the west slope of the canal prism and providing additional stabilization support for the east slope.

1.5 Description

The 184.5-mile C&O Canal Towpath is currently the backbone of the Potomac Heritage National

Scenic Trail network. Along with the Great Allegany Passage (GAP) trail, the towpath is part an off-road recreational trail stretching 335 miles from Pittsburgh to Washington, DC.

Approximately 250,000 people cycle the entire route annually and these numbers continue to grow each year. Cyclists have had a positive economic impact on “Canal Towns” throughout

Maryland and nearby West Virginia. Should the boardwalk at the Paw Paw Tunnel fail, there is no alternative route for the towpath. Mitigating rockslide potential and hazards helps ensure that the towpath is safe for users in years to come.

This section of the park is used heavily by hikers and cyclists on a daily basis. The condition of the rock slopes presents a significant life safety hazard for park visitors and staff. The number and size of falling rocks have increased, and visual inspections by park staff and geotechnical engineers have revealed multiple vertical fissures and cracks, as well as precariously perched stones. Mitigation of the rock fall hazard will provide for a safer visitor experience and will reduce the potential for having to close the Paw Paw Tunnel section of the trail, which is a favorite biking and camping destination for groups. In 2016, C&O Canal NHP formalized a two-mile-long hiking trail as a by-pass to the Paw Paw Tunnel; however, the trail is strenuous, extends through an area with limited emergency communications/response capability, and includes large grade changes which make traversing of it arduous. The Paw Paw Tunnel remains the only bicycle passage through the mountains of western Maryland.

This project requires the contractor to mitigate rock fall hazards along approximately 1,000 linear feet of rock face adjacent to the C&O canal towpath and historic canal prism at milepost

155 and will remove rock and debris deposited in the canal prism from a large rockslide that occurred in April 2016.

The scope of the project includes geotechnical slope stability analysis and design work for remediation of the rock slope based on the site geology and potential stabilization methods. The structural geology changes along the length of the prism due to the canal excavation through the anticlinal axis of the geologic fold, so the rock stabilization methods must be tailored to fit the conditions. Preliminary investigation suggests there are two primary modes of slope failure occurring at the site depending on the local structural geology of the shale and siltstone rock mass, as well as the slope orientation within each segment of the canal prism. Preliminary documents have observed and calculated planar failure for both the west and east canal prism slopes. Toppling and wedge failures occur in the upper portion of the east slope and rock cuts above the north tunnel portal. The Contractor is fully responsible to evaluate the sufficiency of the preliminary work and adopt its own design to meet the performance requirement of fully stabilizing the area. While the contractor is responsible to determine its own means and methods, the preliminary information suggests that rock stabilization methods may include rock scaling, pattern and spot rock bolts, pinned mesh, weep drains, and shear blocks. This project requires the Contractor to deliver a slope stabilization program integrating all interrelated activities, including but not limited to, geotechnical engineering, environmental considerations, safety issues, construction methods and costs, and contracting procedures to ensure safe operation and maintenance of the project area in accordance with park objectives for this site.

In addition, the timber boardwalk towpath within the project area is in poor condition and is to be removed and replaced as part of the project.

1.6 Schedule

The Contractor shall complete all work within the Contract period of performance according to following milestone schedule which may only be amended by written modification by the

Monthly updates: Monthly updates of project schedule shall be an integral part and basic element of estimate upon which progress payments shall be made under this contract. If, in judgment of

Contracting Officer, DB Contractor fails or refuses to provide schedule of values and complete schedule update or revision as specified hereinafter, DB Contractor shall be deemed to have not provided required information upon which progress payment may be made and shall be subject to retainage of a portion of the payment.

Narrative: Include in report:

• Brief description of actual progress made during update period

• Actual and potential delaying activities

• Impediments to progress

• Issues related to inclement weather

• Progress toward established milestones

• Project float

• Brief description of work anticipated to be performed in next month

• Identify minor revisions to schedule for evaluation and accepted or rejected

As work progresses, indicate Actual Completion percentage for each activity. If schedule update shows late finish date after contract completion date, at a minimum, include the following in narrative with submission:

• Known delays

• Actions taken to get back on schedule

• Impediments or constraints affecting progress

Progress Payments: Update currently accepted construction schedule monthly. If DB

Contractor fails to provide monthly updates or revisions to currently accepted construction schedule, a portion of monthly payment may be retained until updates/revisions made.

Time Impact Analysis for Contract Modifications, Changes, Delays, and Contractor

Requests Requirements: When contract modifications or changes are initiated, delays are experienced, or DB Contractor revises project schedule, DB Contractor shall submit to

Contracting Officer a written time impact analysis illustrating influence of each modification, change, delay, or DB Contractor’s request on the contract time.

• Time Extensions: Activity delays shall not automatically mean an extension of contract time is warranted or due to DB Contractor. It is possible that modification, change, or delay will not affect existing critical activities or cause non-critical activities to become critical. A modification, change, or delay may result in only absorbing a part of available total float that may exist within an activity chain of the project schedule, thereby not effecting the contract time. Time extensions will be granted according with terms of contract.

• Float: Float is not for exclusive use or benefit for NPS or DB Contractor. Extension of contract time is granted only to extent the equitable time adjustments to activity or activities affected by modification, change, or delay exceeds total (positive or zero) float available on a particular activity.

2.2.2 Environmental and Sustainability Requirements for Design (NOT USED)

NPS established environmental and sustainability requirements for project. Notify Contracting

Officer if conflicts arise between performance of work and environmental and sustainability requirements. NPS does not intend to limit alternative means of achieving these requirements.

For sustainability requirements for design, see Part 3 Performance Requirements and NPS

Project Sustainability Checklist. Complete checklist by concisely explaining how each credit/requirement will be met.

2.3 Construction Requirements

2.3.1 Environmental and Sustainability Requirements

Specific sustainability requirements generated in design will dictate more stringent environmental requirements for this project. Refer to Part 3 Performance Requirements and NPS

Project Sustainability Checklist. General requirements:

• Site Disturbance: Minimize construction limits of project to reduce impact on site.

• Toxic Chemicals: Avoid materials that can leach toxic chemicals into ground water. Do not allow toxic chemicals to enter sewers or storm drains or contaminate land or any body of water. Refer to NPS Project Sustainability Checklist for additional requirements.

• Soil Erosion: Protect against erosion and topsoil depletion according to Stormwater

Pollution Prevention Plan (SWPPP).

• Habitats: Protect natural habitats and ecological systems on facility site as identified in

Environmental Assessment (EA).

• Noise: Minimize noise during construction. Operate power equipment according to local/Park noise restrictions.

• Waste Management: Employ processes ensuring minimal waste output and in landfills.

Recycling is a requirement of this project. Specific recycling goals were established in

NPS Project Sustainability Checklist. Legally dispose materials unsuitable for recycling at public or private dumping areas outside the Park.

https://www.nps.gov/dscw/loader.cfm?csModule=security/getfile&pageid=387018 https://www.nps.gov/dscw/loader.cfm?csModule=security/getfile&pageid=387018

DB Contractor shall designate an on-site party (or parties) responsible for instructing workers and overseeing environmental and sustainability requirements of this project. Distribute copies of environmental and sustainability requirements to Job Site Foreman and each Subcontractor.

Waste Management Plan: Prior to scheduled Preconstruction meeting, DB Contractor shall submit draft Waste Management Plan to Contracting Officer for approval. Develop and implement according to ASTM E1609 and as required in contract documents. Plan shall include, but not be limited to:

• List of recycling facilities, reuse facilities, municipal solid waste landfills, and other disposal area(s) to be used. Include name, location, and phone number.

• List of proposed materials to be reused or recycled.

• List of materials that cannot be recycled or reused with explanation or justification.

• Storage and collection methods of waste and recyclables, handling procedures, and means of keeping recyclables free of contamination.

• Describe means of transporting recyclable materials and estimate frequency of emptying bins.

• Identity person or persons responsible for ensuring project recycling goals are achieved.

• Revise and resubmit Plan per Contracting Officer. Approval of DB Contractor’s Plan does not relieve DB Contractor of complying with applicable environmental regulations.

Progress Documentation: Supplemental to Waste Management Plan, document solid waste disposal, diversion, and cost/revenue analysis, and submit completed worksheet monthly. Use

Appendix A - Project Waste Management Plan Worksheet and report totals to date for column headings. Use Appendix B for solid waste volume to weight conversions.

Prior to commencement of work, schedule and conduct meeting with Contracting Officer.

Discuss proposed Waste Management Plan and develop mutual understanding of details of environmental protection.

Minimize Construction Impacts

Implement following mitigation measures to minimize impacts of construction activities:

Soil Erosion: Protect staging areas against erosion and topsoil depletion. SWPPP is required.

Exotic Vegetation and Noxious Weeds: Prevent introduction and minimize spread of exotic vegetation and noxious weeds. Incorporate following procedures:

• Obtain fill or additional topsoil needed from a Government approved source.

• Use NPS approved native seed and/or plants and revegetate areas disturbed by construction.

• Where seeding is required, a weed-free native grass/forb seed mix would be obtained and used in accordance with NPS policies and guidance. Management techniques would be implemented to foster rapid development of native plant growth.

• To avoid transport of nonnative species to terrestrial portions of the study area, all construction vehicles would be washed prior to use on the project and only clean and weed-free fill material would be used.

• Any equipment used for construction would be decontaminated prior to use in the canal so they are free of any vegetation, animals, mud, and any other organic material that is not native to the canal.

Vegetation Salvage and Revegetation Plan: Required for this project. For revegetation efforts, use approved native species and/or native seed and incorporate Park policies regarding vegetation and site restoration. Consider use of native species, plant salvage potential, exotic vegetation and noxious weeds, and pedestrian barriers. Policy related to revegetation will be referenced in NPS Management Policies 2006 (Section 9.1.3.2). If disturbance of vegetation occurs outside the approved limit of disturbance, for any required restoration, the contractor shall work with NPS to install appropriate replacement species or seeding.

Special Status Species: To protect unknown or undiscovered threatened, endangered, or special status species, construction contract will include provisions for these discoveries. DB Contractor should contact Park for direction to evaluate special species at the site.

State plants of concern would be located and fenced or flagged prior to construction. NPS will provide a briefing to the contractor identifying plants of concern. Contractor shall work with

NPS to avoid, reduce, and minimize impacts to plants of concern when possible.

To minimize potential impacts on northern long-eared bat habitat, removal of trees greater than

4-inches DBH is prohibited from June 1 to July 31. Contractor shall coordinate with NPS and

MD-DNR to minimize impacts to bats when possible. Of note is that the Paw Paw Tunnel is used to varying degrees for hibernating bats over the winter.

Visitor Experience: Incorporate following mitigation measures into action alternatives to minimize impacts of construction activities on visitor experience:

Contractor shall provide & maintain signage for detours, maintenance of traffic, and safety throughout the length of the project. Closure measures at either end of any closed portions of towpath within the immediate work area will be established and maintained by the contractor. A traffic control plan detailing signage for detour will be submitted by the contractor for government approval. At this time, it is assumed by the government that for the purposes of towpath closure, the immediate work area extends between the North portal of Paw Paw Tunnel and intersection of towpath with Tunnel Hill Trail. An existing pedestrian detour path used by

NPS during previous stabilization efforts in 2017 – 2019 exists over tunnel hill road to tunnel hill trail that may be used to bypass pedestrians around the immediate work area. A Minimum of 3 weeks will be provided to the park in advance of any towpath closures.

During transport of equipment and materials outside of the immediate work area along open portions of towpath construction vehicles will have shared usage with pedestrians. Any vehicles larger than a pickup truck are required to have flaggers/escorts provided by the contractor to ensure pedestrian safety.

During hauling operations, a shuttle service will be provided by the contractor to avoid any conflicts between pedestrians and construction vehicles. During the hours of hauling or high/heavy trucking activity the contractor shall provide a shuttle service to transport visitors from either end of the towpath closure. Shuttle shall be capable of transporting a minimum of 8 visitors. Shuttle shall be ADA accessible. Shuttle shall be able to transport a minimum of 8 https://www.nps.gov/policy/mp/policies.html bicycles. Shuttle shall operate during hours when hauling or high/heavy trucking activity outside of the immediate work area is anticipated. The shuttle shall run at 30 minute intervals. A schedule of shuttle routes shall be prepared and submitted to the CO for review/approval. The shuttle loading and unloading zone shall be clearly marked and approved schedule and route posted at each location. A Minimum of 3 weeks will be provided to the park in advance of the start of shuttling activities.

Any driving on the towpath must comply with the most recent version of the NPS C&O Canal

NHP Safety Officer Memo for Towpath Driving. Notable items are highlighted below:

• The maximum speed for any vehicle on the towpath is 15mph. This is under ideal conditions when the towpath is dry, there are no visitors in the area, and you have clear visibility on both side of the towpath for at least 200’ in front of you. If any of these conditions don’t exist, SLOW DOWN.

• When possible, avoid driving on the towpath when snow covered, icy, or muddy. Any damage to the towpath will be repaired by the contractor at no additional expense to the government.

• Seatbelts shall be worn at all times.

• Yield to all visitors on the towpath.

• If a visitor is coming toward you, you must pull over and come to a full stop until the visitor is completely clear of your vehicle.

• If you are approaching a visitor traveling in the same direction, us a slight tap of the horn to notify them that you are coming up. Wait for the visitor to step off the towpath to allow you to proceed and do so at a very slow speed.

• If you must park on the towpath, pull over as far as you can. Fold in your mirrors and keep doors shut except to exit and enter vehicle.

• This project area has limited communication capabilities – define alternate means to communicate between vehicles if no cell phone coverage exists.

Public access to Paw Paw Campground shall be maintained at all times through construction. No closure of the campground is currently anticipated by NPS. Measures by the contractor shall be taken to provide for visitor parking by expansion of the existing parking area (contractor shall have use of the West…
