About this file

This document is a Questions and Answers (#1) file issued by the Illinois Department of Central Management Services (CMS) for the JPMC Ballasts Fluorescent HID LED procurement (Solicitation 25-416CMS-BOSS4-B-46887), dated 4/15/2025. The document addresses two key vendor inquiries: one regarding mandatory State Board of Elections registration and another concerning potential manufacturer price increases and tariff impacts. The Q&A provides guidance on bidding requirements, specifically emphasizing that State Board of Elections registration is mandatory and not a new requirement, and that vendors must submit the most current Manufacturer's Suggested Retail Price (MSRP) list at the time of bid opening.

The document clarifies pricing and contract terms, indicating that pricing must remain firm for 180 days from bid opening and for six months after contract execution. In the event of tariff implementations, the State of Illinois has established a process to handle price adjustments on executed contracts. Specifically, any tariff-related price increases will only be permitted based on the exact percentage of the applied tariff, with the state allowing an additional line item to cover the tariff increase. CMS will work directly with contracted vendors to manage such situations, ensuring that MSRP adjustments are not permissible and maintaining transparency in the procurement process.

Questions and Answers #1

Date: 4/15/2025

Q1 Is the State Board of Elections registration mandatory and is it a new requirement?

A1. It is mandatory to be registered at time of bid with the IL State Board of Elections and this is not a new requirement. See the below from Section B.2.3 of the IFB Vendor Instructions and Requirements.

State Board of Elections Registration: Vendor or Bidder may be prohibited from making political contributions and be required to register with the State Board of Elections. For more information, see State Board of Elections in Vendor Disclosure, Part 5

Additional information about the BOE registration requirement can be found at https://www.elections.il.gov/BEREP.aspx?MID=5kJmo5Vlmig%3d.

Q2 Currently many manufactures are having 1 or even 2 price increases over the next several months.

If we don’t have the manufactures most current version because they are having price increases after April 24th, say May 1st or even June 1st, how should we handle this? Because the situation with tariffs is ongoing and very fluid, manufacturers cannot hold any pricing firm at this time.

A2. You should submit the most current MSRP list at time of bid opening. Per A.2. of the IFB Vendor Instructions and Requirements, the pricing must remain firm for 180 days from opening. Additionally, per Section 2.3.2 of the Contract, the pricing must remain firm for a period of six (6) months after the execution of the contract.

When addressing any potential tariffs, if a tariff is implemented, the State of Illinois does have a process in place to handle this on executed contracts. The amount of the increase will only be allowed based on the percent of the applied tariff. MSRP adjustments will not be permissible, but the State will allow an additional line item to be added to the contract to cover the tariff increase. CMS will work directly with any contracted vendor if this situation should arise.
