About this file
This document is a Construction Manager Selection Guide issued by the Florida Department of Management Services (DMS), Division of Real Estate Development and Management for selecting construction management services for state projects. The guide outlines a comprehensive process for soliciting, evaluating, and selecting construction management firms through a competitive Request for Qualifications (RFQ) process. The selection involves multiple phases including preliminary screening, interviews, and presentations, with a detailed evaluation methodology that assesses firms across categories such as financial capacity, project experience, proposed staff, project management systems, references, preconstruction services, and overall approach to project delivery.
The selection process includes a structured scoring system with point values assigned to different evaluation criteria, requiring construction management firms to submit detailed documentation including company information, staff qualifications, project histories, and proposed approaches. Firms are evaluated on their ability to provide efficient construction management services, with particular emphasis on cost control, scheduling, market analysis, and subcontractor management. The guide provides specific instructions for both the construction management firms preparing submissions and the selection committee members reviewing and scoring the submissions, ensuring a transparent and systematic approach to selecting the most qualified construction management firms for state projects.

SECTION 2 OVERVIEW
The Department will issue a competitive solicitation for a CM Firm in connection with a Project estimated to exceed the Category Five threshold amount provided in section 287.017, F.S., except in cases of valid public emergencies certified by the Secretary of the Department. In furtherance of this solicitation, the Department will establish the Selection Committee for the CM Firm solicitation to evaluate prospective CM Firms in accordance with this guide. The relative ability of a CM Firm to perform the services required shall be determined utilizing the evaluation criteria set forth in the underlying Request for Qualifications, this guide, Rule Chapter 60D-5, F.A.C., and section 287.055, F.S. The Construction Procurement Liaison will assist in guiding the Selection Committee through the solicitation process.

For those vendors determined by the Construction Procurement Liaison to be responsive, the Construction Procurement Liaison reviews the information from the submittal packages and enters the profile data onto the Construction Manager Selection Form, as set forth in this guide.
2.1.13. Responsive vendor submittals and the Construction Manager Selection Form are then transmitted individually to the Selection Committee members by the Construction Procurement Liaison.

Column R: Overall Approach & Methodology:
a. CM Firm – The CM Firm should indicate the proposed approach to the Project, the efforts the CM
Firm will take to keep the Project on time and on budget, the proposed staff’s roles on site, how staff will interact with the Department and Client Agency (if applicable), and their methods for resolving problems or conflicts that may arise during construction. Each CM Firm should provide information about the experience and knowledge of the proposed staff and indicate the city and state of residence of key staff members working on the Project and how the CM Firm proposes to mitigate costs associated with staff members’ location that may be borne by the Department.
Information should be provided on what methods the CM Firm will utilize to provide the services on time and on budget. For Continuing Contracts, the CM Firm should provide information regarding their overall approach and methodology efforts, including methods the CM Firm will utilize to provide the services on time and on budget, for projects that would meet the needs of the Department during the life of the Continuing Contract.
b. Selection Committee - Based on the information provided in the Presentation and Interview, the Selection Committee will evaluate the CM Firm’s overall approach to the Project, especially regarding efforts to keep the Project on time and on budget and methods for resolving conflicts or problems. The staff’s relevant experience and knowledge of this Project type may be considered in the scoring, as well as the location of proposed staff. For Continuing Contracts, the CM Firm’s overall approach and methodology for projects that would meet the needs of the Department during the life of the Continuing Contract should be considered, especially the CM Firm’s ability to keep projects on time and on budget and methods for resolving conflicts or problems.
(Rev. 07/2025) 13
SECTION 8 CONTRACTING PROCESS
The contracting process is governed by section 287.055, F.S., and Rule Chapter 60D-5, F.A.C. Negotiation of the contract for the Project will be for compensation determined to be fair, competitive and reasonable, to provide for profit, overhead, and direct management costs plus actual costs not to exceed a guaranteed maximum price. The terms of the contract for the Project are set forth in the Construction Manager Agreement attached to the RFQ and are non-negotiable except as expressly set forth in the RFQ.
8.1 The Construction Procurement Liaison prepares and routes for execution an authority to negotiate document identifying the Project and the CM Firm(s) awarded and the order of award.
8.2 The Project Manager coordinates with the Client Agency representative (if applicable) and the first ranked most qualified CM Firm to negotiate a contract.
8.3 A letter requesting staffing and overhead and profit information is sent to the first ranked CM Firm from the Project Manager before the negotiation date. This up-front preparation and exchange of information shortens the negotiation period so the construction process can begin sooner and reduce the cost of the Project.
8.4 The Project Manager and CM Firm will discuss and negotiate with the CM Firm upon the following:
a. Project Scope,
b. Projected Project budget, including the CM Firm’s calculated multiplier,
c. Staffing,
d. Projected Project Schedule,
e. Verification of Bonds and Insurance.
8.5 If the Department is able to negotiate a satisfactory contract, a draft Construction Manager Agreement is finalized by the Department’s Contracts Administrator with information provided by the Project Manager. The finalized document is routed internally within the Department and is then transmitted to the CM Firm for execution by the CM Firm prior to execution by the Department. Bonding and insurance information will be provided by the CM Firm at the time the CM Firms submits its signed Construction Manager Agreement to the Department.
8.6 Should the Department be unable to negotiate a satisfactory contract with the CM Firm considered to be the most qualified at compensation which the Department determines is fair, competitive and reasonable, the Department may then undertake negotiations with the second most qualified CM Firm, then the third most qualified CM Firm, etc., until the Department is able to negotiate a satisfactory contract or decides to reject all Responses.
8.7 The contracting process for Continuing Contracts follows the same steps as outlined above with the exception that the Project may not be identified at the time the parties enter into the Continuing Contract. Accordingly, the contracting process for Continuing Contracts will proceed as outlined above, except that:
a. The Construction Procurement Liaison coordinates all steps of the contracting process without the assistance of a Project Manager,
b. Only the CM Firm’s calculated multiplier is negotiated during the negotiation period (i.e., negotiation of Project scope, projected Project budget, staffing, projected Project schedule, and verification of bonds and insurance will not occur prior to execution of the Continuing Contract),
c. Bonding and insurance information will be provided by the CM Firm prior to the Continuing Contract being activated in writing by the Department for a particular Project, and,
d. Typically, multiple firms are awarded and placed under contract.
