SECTION I

1.0 DESCRIPTION OF SERVICES

1.1 General. This is a non-personnel services contract to provide Fleet Janitorial Services. The Government shall not exercise any supervision or control over the contract Contactor performing the services herein. Such contract Contractor shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1.1 Overview Description of Services/Introduction. The Contractor shall provide all personnel, vehicles, supervision, and other items and services necessary to perform Fleet Janitorial Services for the 412 Test Wing as defined in this Performance Work Statement (PWS) at Edwards AFB (EAFB), CA. The Contractor, while handling aircraft sanitation waste, shall comply with standard commercial airline fleet services practices as well as enforce both Federal and California State and local environmental laws. The Contractor shall perform to the standards in this contract. This includes the planning, coordination, and surveillance of the activities necessary to ensure disciplined work performance and timely resources application to accomplish all tasking under the contract. The Contractor shall be responsible for maintaining communication with the Contracting Officer (CO) and the Contracting Officer Representative (COR), and to immediately notify the CO, Government Project Manager GPM and the COR of any problems that would prevent timely performance of this contract. The Contractor is responsible for and required to implement, and maintain management control systems necessary to plan, organize, direct, and control all activities under this contract.

1.2 Inherently Governmental Function. The Contractor shall not perform Inherently Governmental functions as defined in FAR Subpart 7.5 in relationship to this PWS.

1.3 Period of Performance. This is a five (5) years option contract with a period of performance of 1 Oct 2022

– 30 Sep 2025.

1.4 Place of Performance. The contractor shall perform the services in the Performance Work Statement at Edwards Air Force Base, California.

1.5. Specific Tasks.

1.5.1. Clean galley areas and remove solid waste.

1.5.2. Clean and service lavatories. Clean surrounding areas and replenish lavatory supplies as required (toilet paper, paper towels, and hand soap). The contractor shall replenish these supply items IAW FAR 52.208-9, a list of the Ability One Procurement List Product can be found here:

1.5.3. Clean interior/exterior of trash containers and replace with new plastic trash liners.

1.5.4. Provide alcohol hand wipes for aircraft without potable water systems.

1.5.5. Discharge/flush liquid waste residue from lavatory truck/cart at Building 1220 manhole as required. Alternate site (FAMCAMP) may be used with COR/GPM prior approval in writing.

1.5.6. Solid waste (trash) is to be deposited in the nearest base trash dumpster.

1.5.7. Service/replenish aircraft potable water system as required. Water tank must be marked “Potable Water Only” and tank must be filled using potable water hose (food grade hose) and water tested using Drinking Water Test Kit until water achieves chlorine residual as high as reasonably possible (0.2mg/L is absolute minimum, however levels between 1.0-2.0mg/L are recommended).

1.5.8. Utilize the 412th Maintenance Group, Maintenance Operations Center (MOC) 277-2949, as the primary servicing dispatcher.

1.5.9. Maintain and document a monthly servicing log of aircraft that required/received servicing (see Appendix 5).

1.5.10. Contractor to furnish supplies, vehicles, and equipment to perform PWS.

1.5.10.1. All aircraft servicing, cleaning, and sanitation supplies.

1.5.10.2 Provide, operate, and maintain all necessary vehicles and equipment to complete all required servicing.

1.5.11. Transient aircraft transiting through but not assigned to EAFB CA, will be provided fleet services on an as-needed basis.

1.6 Historical Data. The tasks described above have been performed in the past by 1 full-time equivalent employee.

1.7 Deliverables.

1.7.1 Appendix 5 is a monthly deliverable to the GPM/COR per email due within first 5 workdays of following month under this contract.

1.7.2 Data. The Government has unlimited rights to all deliverables of this contract.

SECTION II

2.0. SERVICE SUMMARY.

2.1 General

Unless indicated elsewhere these performance objectives will be measured monthly. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

2.2 Performance Evaluation

Performance of a service shall be evaluated to determine whether or not it meets the performance requirements of this contract Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate. In the case of issued Corrective Action Reports (CARs), the CO shall take appropriate measures according to the “Inspection of Services” clause.

SECTION III

3.0 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.1. Government Furnished Services.

3.1.1 Custodial Service. The Government shall provide custodial services for restroom facilities in base facilities IAW the current base custodial contract. All inquiries regarding scheduling and level of custodial services will be directed to the COR/GPM.

3.1.2 Emergency Medical Services. Edwards AFB will provide emergency medical services for Contractor personnel in performance of services under this contract base IAW Air Force Instruction (AFI) 41-115 Chapter 1.

The Contractor shall reimburse the Government for treatment provided at the current reimbursement rate for non-authorized user IAW AFH 41-114, paragraph 42. The Contractor shall provide to the 412TH Medical Group, the name of a physician and/or hospital to which injured personnel can be transferred for further treatment and care after receiving initial emergency treatment on base. All mishaps will be promptly reported to the base safety office through the COR/GPM.

3.1.3 Employee Training. Government furnished training will be provided only for the following areas.

Security, anti-terrorism, fire prevention and safety. Flight line drivers initial training, 412 TW/PZDB vehicle control officer (VCO). Annual flight line refresher training is provided by 412th Maintenance Training Division. Flight line vehicle pass (412 OSS/OSAM). Security services, (412 MXG/SF).

Electronic Personnel Security Questionnaire. Flight line entry control card submission services (412

MXG/SF).

3.1.4. Insect and Rodent Control. The Government will provide insect and rodent control services. Services will be furnished upon request to the facility manager.

3.1.5 Refuse Collection. The Government will provide refuse collection services. The Contractor shall take refuse to the nearest dumpster on a regular basis. The Contractor shall comply with all installation recycling programs, refuse volume reduction programs, and hazardous waste collection policies IAW base policies.

3.1.5 Security Police and Fire Protection. The Government will provide general on-base police and fire protection. Dial 911 for police and fire emergencies from base land lines only. The Security Forces (Police) telephone number is 277-3340 or 661-277-3341 for routine calls, and also emergency calls placed via a cellular phone. The Government will provide fire prevention and protection, inspection, and maintenance of Government furnished fire extinguishers and systems. The Fire Department extension is 277-4540 or 277-4541 for routine calls, and also emergency calls placed via a cellular phone. The Fire Department shall also be contacted to provide Hazardous Material Incident Response.

3.1.6 Telephone Service. The Government will provide one telephone (Class B) line for on base calls only. The contractor shall be responsible for all additional lines, their charges, and all long distance telephone call costs.

Government provided telephone lines shall be used for official Government business only.

3.1.7 Utilities. The Government will provide all electricity, water and sewage at no additional cost to the Contractor. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish requirements under this PWS.

3.2 Government Furnished Facilities. The Government will provide office space for 2 personnel to include 1 landline, 1 computer workstation, 2 office chairs, 1 four drawer file cabinet, 2 three drawer file cabinets and secured storage area.

3.3 Government Furnished Equipment. The Government will provide 1 handheld radio and access to printer and fax machine.

3.3.1 Automated Data Processing Equipment. The Government will provide 1 computer system which includes computer, monitor, keyboard and mouse for use on the local area network (LAN), email, and the Internet for work related to this contract.

3.3.2 Equipment Inventory. Not later than five (5) calendar days prior to the start of the contract, the Contractor and the Government representative shall conduct a joint inventory of all Government Furnished Equipment listed.

The Contractor shall sign receipt for all equipment provided by the Government. The Contractor and the Government representative shall jointly determine and certify agreement on the working order and condition of all equipment. Items of equipment missing or not in working order shall be recorded. If the Contractor does not elect to participate in the inventory within the timeframe listed above, the Contractor must accept as accurate, the listing and stated condition of equipment provided by the Government. If the Contractor participates in the inventory but does not agree with the Government representative's determination as to the working order of the equipment, the equipment will be turned in as excess or the matter will be turned over to the CO for resolution.

3.3.3 Equipment Accountability. The Contractor shall designate custodians and alternates to receipt and account for Government-furnished equipment. By completion or extension of each year of the contract, a joint inventory of equipment shall be conducted by the Contractor and the Government representative. All equipment in need of repairs/maintenance shall be repaired/maintained by the Government unless the damage was caused by willful negligence of Contractor employees.

3.4 Government Furnished Materials. The Government will provide the following information: access to relevant Government organizations, information and documentation, manuals, texts, briefs, and associated materials as required IAW Appendix 4.

SECTION IV

4.0 GENERAL INFORMATION

4.1. Hours of Operation. Fleet services are to be available 24 hours a day, 7 days a week (24/7)

4.1.1. Normal (scheduled) hours are considered to be between 6:00am through 2:00pm local time, five (5) days per week except on Federal Holidays (para 4.1.5). All routine or scheduled activities between these hours shall be considered “Normal Working Hours.” Work started prior to 2 pm but not finished is considered normal hours. Contract’s personnel on duty and on standby during normal hours.

4.1.2. Standby (unscheduled) hours are weekdays between 2:01pm through 5:59am, to include weekends and federal holidays. Contractor will notify MOC upon arrival (277-2949) and wait approximately 45 minutes prior to considering requestor service no-show (request status update from MOC after 30 min).

4.1.3. Daily flight schedules will be provided to the Contractor in advance of the service requirements (when available).

4.1.4. If additional work arises, regardless of the situation, the COR/GPM must be made aware prior to the event. Authorization for the Contractor to proceed is solely at the discretion of the COR/GPM and CO. They alone are the only personnel authorized to direct the Contractor.

4.1.5 Recognized Holidays.

4.1.6 Work Schedules, Leave, and Absences. Monthly schedules will be provided for the upcoming work month to the COR/GPM. Any changes in the schedule shall be coordinated between the Contractor Project Manager (CPM), GPM and the COR.

4.2. Contract Personnel

4.2.1. Contractor Project Manager (CPM) : The Contractor shall provide a CPM and alternate(s) who are knowledgeable of Aircraft Fleet Servicing. The Contractor shall submit a list of personnel’s name, and telephone to the COR/GPM at or before award of the contract. The list shall be kept current throughout the life of the contract. The CPM and alternate(s) shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The CPM or alternate(s) shall be available within 24 hours to meet on the installation with Government personnel designated by the COR/GPM to discuss problem areas. The CPM and

Attachement1 PWS FA930122Q0026 FLEET JANITORIAL SERVICES MXG 20220801 Page - 10 - of 26 alternate(s) shall be able to read, write, and speak English. The CPM shall be able to effectively communicate with Contractor employees. Qualifications for the CPM are listed below:

4.2.1.1. Personnel Roster. The Contractor may be required to provide a personnel roster consisting of names and other pertinent personnel data to the requiring activity for the purposes of 100% accountability real-world and exercise situations. The personnel roster shall be updated as individuals are removed and added.

4.2.2. Contractor Employees: The Government reserves the right to restrict the employment, under this contract, of any Contractor employee, or prospective Contractor employee who is identified as a potential threat to health, safety, security, general wellbeing, or the operational mission of the installation and its population. Contractor shall perform background checks, at Contractor's expense, to ensure that said employee has not been convicted of any sexual crime or any crime against children.

4.2.2.1. Alcohol/Drug Use. The consumption of alcoholic beverages or illegal drugs by Contractor personnel, while on duty, is strictly forbidden. The Contractor shall immediately remove any employee who is under the influence of alcohol or drugs.

4.2.2.2 The Contractor shall ensure employees acquire an Air Force Entry Control Card in order to have unescorted access to restricted/controlled areas on Edwards AFB. According to AFI 31-501, Contractor’s employees require a favorable National Agency Check (NAC) as a condition for access to restricted areas.

Contractor’s employees must be US citizens.

4.2.2.3 Appearance. Contractor personnel shall present a neat clean professional appearance.

4.2.2.4 Certifications. Contractor employees shall have current and valid professional certifications and licenses required to perform the work in this PWS, prior to or at contract award. All certification and licensing requirements by Federal, State, and local agencies shall be complied with at the Contractor's expense.

4.2.2.5 Contractor Qualifications. The Contractor shall utilize employees possessing adequate training, skills, and knowledge to perform the requirements of this contract. All employees require flight line access and shall be fully qualified and thoroughly familiar with flight line rules and regulations as stated in AFI 13- 213, Air Field Management

4.2.2.6 Employee Training. The Contractor shall give all training required to meet requirements of the PWS unless otherwise specified within the PWS or as otherwise approved by the CO. The Contractor shall maintain training and experience records for each employee during the period of this contract that reflect sufficient personnel are qualified to accomplish all tasks required by this contract. Provide status of employee training upon Government request.

4.2.2.7 English Language. Employees who deal directly with customers will be required to effectively communicate with the customers in English. This requirement is strictly for the purpose of efficiently performing the contract tasks.

4.2.3. Use of Government Employees.

The Contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest. In addition, the Contractor shall not employ any person who is an employee of the Department of the Defense if such employment would be contrary to the policies contained in AFI 64-106, Chapter 1, Contractor Labor Relations Activities Last updated 04 Oct 2019.

4.2.3.1 Employment of Spouses/Dependents. The Contractor shall not employ any person who is a spouse or dependent child of a Department of Defense employee (either military or civilian) when such employee would be placed in a conflict of interest or appearance of a conflict of interest by virtue of such employment.

4.2.3.2. Off-duty Military Personnel. The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military Reservists and National Guard members may be subject to reorder to active duty. The abrupt absence of these personnel could adversely affect the Contractor's ability to perform. However, their absence at any time shall not constitute an excuse for nonperformance under this contract.

4.2.3.3. Identification of Contractor Employees. All contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

4.2.3.4 Personal Conflict of Interest (PCI). The term "personal conflict of interest" means that a Contractor employee assigned to the contract has interests which (i) may diminish his/her capacity to give impartial, technically sound, objective assistance and advice in performing this contract, (ii) may otherwise result in a biased work product under this contract, or (iii) may result in an unfair competitive advantage.

(1) Financial Interest. A Contractor employee shall not participate (i.e., recommend, influence, or decide) in any particular matters that will have a direct and predictable effect on the financial interests of that employee, his/her spouse or minor child, or organization in which he/she serves as officer, director, trustee, general partner or employee and/or any person or organization with whom he/she is negotiating or has an arrangement concerning prospective employment that may otherwise cause a reasonable person to question his/her impartiality.

(2) Post Award Disclosure. If after award, the Contractor discovers an employee’s financial conflict of interest, with respect to this contract, it shall make an immediate and full disclosure in writing to the Contracting Officer.

The disclosure shall include identification of the conflict, the manner in which it arose, and a description of the action the Contractor has taken or proposes to take to avoid, eliminate or neutralize the conflict. The Government may, however, terminate the contract. If the Contractor does not disclose the conflict of interest within ten (10) working days of becoming aware of such conflict, the Government may terminate the contract and the Contractor shall not be entitled to reimbursement of any cost incurred in performing this contract or payment of any fee there under. Further, such costs shall not be allocable or chargeable, directly or indirectly, to any other contract with the Government.

4.2.3.5 Privately Owned Vehicles. Each Contractor employee driving a privately owned vehicle on the installation must carry minimum liability insurance as required by the State. Contractor employees shall adhere to all posted speed limits and shall not use hand-held cellular telephones while driving on the installation for phone calls or texting. Use of seatbelts is mandatory. Any Contractor employee cited for driving under the influence will have their driving privileges immediately revoked for a period to be determined.

4.2.3.6 Retainability. Personnel provided under this contract are critical to the mission and shall be considered “key personnel”. The Contractor is expected to minimize employee turnover with respect to personnel performing under the PWS. The Contractor must notify the COR/GPM within 24 hours of any change of personnel performing under this contract. Any replacement personnel proposed must meet all minimum qualifications outlined in this PWS and shall be filled within two (2) weeks. The Government may request to review the candidate’s résumé for replacement personnel prior to the time the personnel change is expected to

Attachement1 PWS FA930122Q0026 FLEET JANITORIAL SERVICES MXG 20220801 Page - 12 - of 26 occur. The Contractor is responsible for providing personnel with the appropriate security clearances and expertise in the related field described in the PWS.

4.3. Safety

It is the contractor's responsibility to ensure its employees and managers have a comprehensive understanding of and full compliance with OSHA requirements. Detailed information is available on the OSHA website at http://www.osha.gov. It is the contractor's sole responsibility for compliance with OSHA, Public Law 91-596.

The contractor shall comply with all federal, state and local laws, and Air Force Instructions for the protection of their employees while working on an Air Force Installation or property. The protection of contractor employees is exclusively the obligation of the contractor. Contractor shall manage all work areas to ensure the safety of building occupants, base personnel, or visitors in or near the areas. The contractor shall submit a Safety and Health Plan that describes the capabilities and processes to ensure compliance with safety and health requirements during the performance of the work described in the solicitation. The contractor's plan shall include appropriate measures to ensure the contractor reacts promptly to investigate, correct and track alleged safety and health violations and/or uncontrolled hazards in contractor work areas. Contractor must ensure that personnel are properly trained on the equipment they are tasked to operate. The contractor shall develop site specific mishap reporting procedures which result in damage to government property or injury to Air Force personnel. These procedures are to be included in the safety and health plan for review. In accordance with AFI 91-202, AFMC Supplement, Safety Program, the contractor shall submit a Safety and Health Plan to Contracting for review and acceptance by the safety office prior to contract award.

4.3.1. Safety Equipment. The Contractor shall furnish personal safety equipment for its employees in performance of this contract. Safety equipment includes shoes or boots, eyewear, respirators, and gloves.

4.3.2. Safety Threats. The Contractor shall not employ persons for work on this contract if such employees are identified to the Contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.

4.3.3. Substance Abuse Testing. Contractor employees shall be subject to substance abuse testing as a result of a mishap investigation when an individual’s actions or inactions are suspected as factors in a mishap sequence. The CO/ Functional Commander (FC) may identify the employees to be tested and the drugs and substances for which those employees must be tested. The Contractor shall accomplish the specified testing using a certified (i.e., a certified lab that meets Department of Health and Human Services (DHHS)/ Substance Abuse and Mental Health Services Administration (SAMHSA) certification) medical substance abuse testing facility. Results of the test(s) shall be provided to the Government solely for the purpose of completing an investigation.

4.4. Base Security Requirements:

4.4.1. Physical Security.

4.4.1.1. All Contractor employees will be subject to a criminal history background check IAW Air Force Manual (AFMAN) 31-113, Installation Perimeter Access Control, as stipulated in the Installation Commander’s memorandum to the 412th Security Forces Office dated 23 Apr 2015 (copies of both the AFMAN and memorandum can be obtained upon request from the Contracting Office). Vehicle registration, proof of insurance, and a valid driver's license must be presented for vehicles. Installation Commanders may deny access and credentials based on information obtained during identity vetting that indicates the individual may present a threat to the good order, discipline, and morale of the installation.

Please refer to the Edwards AFB Fitness Determination for further information concerning base access.

4.4.1.2. Base Access. For Contractor personnel who wish to obtain long-term Base access via an Air Force Materiel Command (AFMC) Form 496, Application for AFMC Identification Card, Contractor Access to Air Force Installations, the Prime Contractor shall submit a written request on company letterhead to the COR/GPM with the following information (prior to submitting a request for Base access via an AFMC Form 496): 1) contract number, 2) location of work, 3) expiration date (must be on or before contract’s expiration date), and 4) names of employees/ subcontractor employees needing access to the base, to include each employee’s company name.

4.4.1.3. It is recommended that the Prime Contractor provide a copy of the request letter to each employee for verification purposes when the employee comes to the COR/GPM.

4.4.1.4. Base passes will be limited to a period of one year from the date the AFMC Form 496 is submitted to the COR/GPM for signature.

4.4.1.5. The AFMC Form 496 will be reviewed/approved by the COR/GPM, then taken by the Contractor employee to the Edwards AFB Pass & Registration Office in Building 3000 for the security portion and issuance of the Base pass.

4.1.1.6. The contractor shall comply with all base security regulations. Additionally, the contractor shall comply with actions dictated by force protection condition changes/measures. For real-world situations/exercises, changes to force protection conditions could impact contractor performance of work and can include denial of access to the installation to perform work

4.4.1.7. Only employees who will be working on the contract consistently/frequently should be submitted for a long-term Base pass.

4.4.1.8. The Contractor shall comply with all security requirements imposed by the Installation.

Specific security considerations will be handled on contract basis as required.

4.4.1.9. The contractor shall report suspicious activity (refer to Edwards AFB Contractor Antiterrorism Awareness pamphlet) to Security Forces at 661-277-3340 ( or 911, from landline) in a timely manner.

4.4.1.10. The Contractor and its employees shall comply with all base traffic regulations.

4.4.1.11. Visitors/contractors with driver’s licenses from ME, MN, MO, MT, and WA (exceptions are EDL-Enhanced driver’s licenses from MN & WA) will not be able to obtain Base access without another form of identification as an identity proofing document. The list of authorized IDs can be found in the REAL ID Act of 2005. Please visit the Department of Homeland Security’s (DHS) website to get the latest information, https://www.dhs.gov/current-status-states-territories.

4.4.1.12. Contractor will be offered Level I - Antiterrorism Awareness Training by the government. This training provides contractor employees with the requisite knowledge necessary to remain vigilant for possible terrorist threats. Coordination for training should be done by the requiring unit Antiterrorism Representative (ATR) after contract award. AT Level I training can be taken at https://jkodirect.jten.mil/Atlas2/faces/page/login/Login.seam for non-CAC holders. Tracking for each contractor or subcontractor employee is the responsibility of the COR/GPM or unit ATR.

4.4.1.13. The Contractor shall be responsible for safeguarding all government property, equipment and materials provided for Contractor use. At the end of each work period, all government facilities, equipment, and materials shall be secured.

4.4.1.14. During performance of the contract, the Contractor shall be responsible for obtaining required identification for newly assigned personnel.

4.4.1.15. The Contractor shall be responsible for prompt return of credentials and vehicle passes for: 1) any employee who no longer requires access to the work site; 2) upon request by a COR/GPM/CO; and

3) upon completion or termination of the contract. The Prime Contractor shall ensure that all Base identification passes issued to employees and subcontractor employees are returned to the issuing office.

Failure to comply with these requirements may result in withholding of payment.

4.4.1.16. Contractor employees are prohibited from possessing weapons, firearms or ammunition, on themselves or within Contractor-owned or privately owned vehicle while on Edwards AFB.

4.4.1.17 National Agency Check Investigations (NACI). The Contractor shall have current favorable National Agency Check investigations for its employees, from the Government, by contract start date and throughout the life of contract. These investigations shall be submitted by the Government at no additional cost to the Contractor.

4.4.1.18 Restricted Area Badges. The Contractor shall obtain a Restricted Area Badge for all personnel from the 412 MXG for entrance to controlled areas prior to commencing work under this contract.

4.4.1.19 Common Access Card (CAC). The Contractor’s CPM or alternate shall complete all necessary documents for all Contractor personnel requiring access to Edwards AFB. Common Access Cards (CAC) shall be required for all on-site Contractor personnel. The Contractor’s CPM shall ensure the Government representative in the local organization designated to authorize issuance of Contractor’s CACs (i.e. Trusted Agent (TA) receives a Visitor Request for each employee through the Trusted Agent Security System (TASS). Contractor personnel shall electronically submit application to the TA, once approved set up appointment at https://idco.dmdc.osd.mil/idco/#/ or go to the Military Personnel Section.

4.4.2. Computer Security (COMPUSEC).

4.4.2.1. Local Area Network (LAN). The Government will provide limited access to the existing LAN to include email capability. The Contractor shall not use the LAN for purposes other than for work required under this contract.

4.4.2.2. Required Training. All Contractors will receive documented Information Assurance (IA) training prior to receiving access to the LAN. Authorized users will receive initial IA orientation and annual (every 12 months) awareness training to ensure they know, understands, and applies the IA requirements of Air Force information and ISs. The minimum orientation and awareness requirements for users are outlined in DoD 8570.01-M. IA Program. The Contractor shall comply with the established C4 Systems IA program to integrate security education, training, and awareness covering the COMSEC, COMPUSEC, and Emissions Security (EMSEC) disciplines. Contractor personnel shall be required to attend initial and annual IA training at no additional cost to the Government.

4.4.3 Key Control.

4.4.3.1 Procedures. The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons.

NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost keys/key cards to the

COR/GPM.

4.4.3.2 Lost/Duplicated Keys. In the event keys are lost, the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.

4.4.3.3 Authorized Use. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.

4.4.3.4 Lock Combinations. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations.

These procedures shall be included in the Contractor’s Quality Control Plan.

4.5. Emergency Operations: Fleet Services are to be available 24 hours a day, 7 days a week (24/7). In the event of afterhours (non-duty) support requirements a 2 hour response time is required.

4.5.1. Continuation of Essential DoD Contractor Services During Crisis. In Accordance With DoDI 1100.22, (12 Apr 2010) Continuation of Essential DoD Contractor Services During Crises, DFARS 237.76, and the Air Force implementation thereof, unless otherwise directed by an authorized government representative, it is determined that Fleet Janitorial Services as identified in this PWS are not essential for performance during a crisis.

4.5.2. Contingency Plan. The Contractor shall submit a contingency plan to the CO at contract start date, which explains how the Contractor will expand operations in emergency or contingency situations to ensure all services are provided, how the Contractor will ensure there are no interruptions of routine contract services due to labor disputes. Such plan shall be approved by the COR/GPM prior to Contractor assuming duties under this contract.

4.5.3. Labor Disruptions. The Government reserves the right to take over performance of this contract in the event of a labor strike, bankruptcy, default or period of non-performance by the Contractor’s employees. In such events, the services will be performed exclusively by Government personnel and not a mix of Government and non-striking Contractor employees. At the direction of the CO, the Contractor agrees to remove its non-striking work force from the performance site and not interfere in any way with Government performance. The Contractor further agrees, under such circumstances, to permit the Government to use any essential Contractor-furnished property. The Government will not compensate the Contractor for performance during this period.

4.6. Quality Control (QC):

In compliance with the contract clause entitled "Inspection of Services" The contactor will develop and maintain an effective quality control program to ensure services are performed IAW this PWS, applicable laws and

Attachement1 PWS FA930122Q0026 FLEET JANITORIAL SERVICES MXG 20220801 Page - 16 - of 26 regulations and IAW best commercial practices. At a minimum, the items listed in 4.6.1. Shall be submitted to the CO prior to pre-performance conference or within five (5) days after contract award, whichever comes first. The CO will notify the Contractor of acceptance or required modifications to the plan before the contract start date.

The Contractor shall make appropriate modifications and obtain acceptance of the plan by the CO before the contract start date or within five (5) days post award.

4.6.1. Quality Control Plan (QCP): The Contractor shall be required to submit a QCP before contract start date or within Five (5) days post award.

The Contractor’s quality control plan shall contain, as a minimum, the following items:

a. A description of the inspection system to cover all services. Description shall include specifics as to the areas to be inspected on a scheduled and unscheduled basis, frequency of inspections, and the title and organizational placement of the inspector(s).

b. A description of the methods to be used for identifying and preventing defects in the quality of service performed.

c. A description of how the records will be kept. Records must document all inspections and corrective or preventive actions taken.

4.6.2. Government Quality Assurance:

4.6.2.1.Quality Assurance The Government will periodically evaluate the Contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP). The Government may inspect each task as completed and increase the number of quality assurance inspections if deemed appropriate because of repeated failures discovered during surveillance inspections or because of repeated customer complaints. Likewise, the Government may decrease the number of quality assurance inspections if performance dictates. The Government shall also receive and investigate complaints from customers. The Government representative shall make the determination of the validity of all customer compliant

(s) and the Contractor shall address/correct all valid customer complaints.

4.6.2.2. Contracting Officer Representative (COR)

COR are representatives of the CO and will participate in the administration of this contract. Subsequent to contract award, the Contractor will be provided with a letter identifying COR and setting forth their duties and authorities.

The COR is not authorized to change any of the terms and conditions of the contract.

4.6.2.3. Multifunction Team (MFT). The CPM with the CO, Contract Administrator (CA), GPM, COR, QA Personnel, and other Government personnel shall meet on a regular basis. The team will establish how often meetings are needed based on contract complexity. The Contractor may request a meeting with the CO when the Contractor believes such a meeting is necessary. If the CO or CA deems necessary, written minutes of any such meetings shall be recorded by the CA in the contract file and signed by the COR/GPM and the CPM or CO. If the Contractor does not concur with any portion of the minutes, such nonoccurrence shall be provided in writing to the CO within 10 calendar days following receipt of the minutes.

4.6.3. Contract Discrepancies. The Government COR/GPM or CO will periodically evaluate the Contractor’s performance using the methods of surveillance listed in Section 2 – Service Summary of the PWS. Government personnel will record all surveillance observations. When an observation indicates defective performance, the COR/GPM will require the CPM or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgment that he or she has been made aware of the defective performance. If the Contractor challenges the validity of any observation, and the COR/GPM and CPM cannot come to an agreement, the complaint in question shall be forwarded to the CO for resolution. The preferred method of dealing with any valid observation is re-performance, if possible, and at no additional cost to the Government. Repeat observations or an incident that violates safety or environmental

Attachement1 PWS FA930122Q0026 FLEET JANITORIAL SERVICES MXG 20220801 Page - 17 - of 26 regulations shall require the COR/GPM to instigate a Corrective Action Report (CAR) through the Contracting Officer. The Contractor shall be given three (3) business days to respond to the CAR with either an explanation on why it disagrees with the CAR or with its concurrence with the CAR, any disciplinary action taken, and a mitigation plan to avoid repeat occurrences.

4.7. Conservation of Utilities. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude the waste of utilities.

4.8. Contractor Furnished Property and Services. Except for those items or services specifically stated to be Government-furnished in Section III and any appendixes, the Contractor shall furnish everything required to perform this contract in accordance with all of its terms. The following mentioned requirements are not all inclusive of the Contractor furnished items and services required in the performance of this contract. The Contractor shall provide all personnel, vehicles, supervision, and other items and services necessary to perform Fleet Janitorial Services.

4.9 Environmental Protection. The Contractor shall comply with all applicable Federal, state and local laws, regulations and standards that are or may become applicable to Contractor’s activities in performance of this PWS. During on-site Edwards AFB operations the following apply:

4.9.1. Prior to use, the Contractor shall provide the Base Hazardous Material Pharmacy, through the COR/GMP a list of all hazardous materials the Contractor brings onto Government property and shall submit an AF Form 3952 along with a Safety Data Sheet (SDS) for each Hazardous Chemical listed in OSHA Hazard Communication Standard 29 CFR 1910.1200. The purpose of the inventory is to provide information for Emergency Planning and Community Right-to-Know Act (EPCRA) reporting.

4.9.1.1. Any products that meet the criteria of “Hazardous Waste” must be bar coded and tracked until permanently removed from Government property. Criteria for identifying hazardous waste are contained in Subpart C of 40 CFR Part 261. Note: Products containing chlorofluorocarbons (CFC’s) or ozone depleting substances shall not be allowed or approved for use.

4.9.1.2. In performing work under this contract on a Government installation, the contractor shall:

4.9.1.2.1. Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and

4.9.1.2.3. Take such additional immediate precautions as the CO may reasonably require for health and safety purposes.

4.9.1.2.3.1 The CO may, by written order, direct Air Force Occupational Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract.

4.9.1.2.4 Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract.

4.9.6. Permits. The Contractor shall be solely responsible for obtaining at its cost and expense any environmental permits required for its operations under the Contract, independent of any existing permits held by the Government. Any and all environmental permits required for any of the Contractor’s operations or activities would be subject to prior concurrence of the Government. The Contractor acknowledges that the Government

Attachement1 PWS FA930122Q0026 FLEET JANITORIAL SERVICES MXG 20220801 Page - 18 - of 26 will not consent to being named a secondary discharger or co-permittee for any operations or activities of the Contractor under the Contract. In the event the Government is named as a secondary discharger or co-permittee for any activity or operation of the Contract, the Government shall have the right to take reasonable actions necessary to prevent, suspend, or terminate such activity or operation, including terminating this Contract, without liability or penalty.

4.9.7. Right to Inspect. The Government’s rights under this Contract specifically include the right for Government officials to inspect upon reasonable notice the work site for compliance with environmental, safety and occupational health laws and regulations, whether or not the Government is responsible for enforcing them.

Such inspections are without prejudice to the right of duly constituted enforcement officials to make such inspections. The Government normally will give the Contractor twenty-four (24) hours prior notice of its intention to inspect, unless it determines the entry is required for safety, environmental, operations or security purposes.

4.9.8. Non-compliance. If the Contractor is found to not be in compliance with any of these regulations, there may be because for the operation to shut down until the Contractor, when within the Contractor’s control or the Government, has remedied the problem. Any sanitary deficiencies shall require immediate correction.

4.9.9. Spill Response. The Contractor is responsible to report and promptly clean up all spills in a manner consistent with current environmental regulations. In the event that it is necessary to utilize Government material, equipment, or personnel to clean up a Contractor caused spill, the Contractor shall be required to reimburse the Government for all associated costs.

4.9.10. Audit. This contract may be subject to audit by any and all cognizant Government agencies. The Contractor shall make available all records, which it maintains with respect to this contract, to such agencies.

4.9.11. Failure to Insist On Compliance.
