MANEUVER TRAIL IMPROVEMENT CONSTRUCTION SERVICES
PROJECT NUMBER 3926003
1.0 General:
1.1 Scope: The contractor shall provide all personnel, transportation, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to perform Improvement Construction Services, as defined in this PWS.
1.2 Background: The Camp James A. Garfield Joint Military Training Site (CJAG) is a 21,683 acre training site located in northeast Ohio used by the Ohio Army National Guard (OHARNG) and other military and civil agencies. The purpose of this project is to improve an existing rail bed, the Tactical Vehicle Maneuver Lane (TVML), extending west from Paris-Windham Rd., west of the Engineer Dig Site North and on the north side of Smalley Rd., running parallel to it. Once fully completed and all phases constructed the improvements will provide better maneuverability across CJAG from east to west within training areas. The improvements will also contribute to long term sustainable use of training areas and will help avoid and/or minimize negative impacts to the environment and associated costs.
The maneuver trail will have a surface hardened with stone. Some culvert replacement and installation is required as well as other drainage improvements such as ditches and rock check dams. No turn pads are required for this construction project, they have already been installed. The trail must be able to accommodate a tractor trailer hauling heavy, tracked military equipment (tanks, bulldozers, etc.) and support the weight and movement of an M1A1 Abrams battle tank at 80 tons.
1.3 Period of Performance (PoP): The Period of Performance shall be 365 days from the date of the notice to proceed (NTP).
1.4 General Information:

The contractor shall supply their personnel with safety protection as required by OSHA regulations. If a discrepancy exists between regulations, the more stringent of the conflicting regulations shall take precedence.
4.2 The contractor shall comply with the CJAG access and security policies and shall provide a roster of all personnel who require access a minimum of two business days in advance of access. Access rooster will be submitted to the OHARNG project manager who will route them through Security for approval.
4.3 All construction activity must follow the construction drawings and specifications, Erosion and Sediment Control (ESC) Plans (Attachment 1), and Storm Water Pollution Prevention Plans (SWP3’s) provided by CJAG and created by Michael-Baker International. Any amendments or changes must first be approved by the OHARNG and noted on the SWP3 Amendment Log.
4.4 The contractor must comply with applicable portions of the attached Environmental Procedures (Attachment 2), dated 3 April 2024. Of particular applicability are the requirements in Section 2.0 on environmental work plans, Section 3.0 on spill prevention and response, Section 4.0 on erosion and storm water control, and Sections 1.6 and 6.0 on recycling and tracking waste.
4.5 Culvert Replacements and Wetland Requirements:
4.5.1 General Wetland Requirements:
Culvert replacements must be done in accordance with the terms and conditions of U.S. Army Corps of Engineers (USACE) Nationwide Permit #3 (NWP3) and the associated Nationwide Permits Regional General Conditions, Corps NWP Specific Regional Conditions, Ohio 401 Certification Special Limitations and Conditions, and General Limitations and Conditions for all Ohio EPA Clean Water Act Sec 401 Certified Nationwide Permits. The Contractor will obtain a copy of the above listed permit conditions and will include them in their Environmental Work Plan. The Contractor will integrate permit conditions into their work process to ensure compliance.
When a Pre-Construction Notification (PCN) or Individual Sec 401 Water Quality Certification (WQC) is required or an evaluation is needed to determine if a WQC is required, the Contractor will use a qualified Wetland Consultant to do this work. The qualified wetland consultant will perform all work, except as noted in this section, necessary to develop a complete PCN to include a Sec 401 WQC evaluation and Individual Sec 401 WQC application if/as required. The PCN and/ or WQC application must be reviewed and approved by the OHARNG prior to submittal.
PCN’s and WQC will be developed for signature by the OHARNG as the landowner. The Contractor will pay the cost for PCN and WQC development and submittal. Neither the Contractor nor the Contractor’s Wetland Consultant will contact the USACE or the Ohio EPA without written authorization from the OHARNG or the Adjutant General’s Department to do so.
If more than one culvert is replaced as part of a single project, one PCN may be developed and submitted that includes all the culverts. If a partial award is made and a later additional award is made, an additional PCN is required for any culverts not included in the initial award PCN. Project delays caused by Contractor failure to prioritize development and submittal of a PCN/WQC or the need to develop more than one PCN/WQC application will not be cause for a project extension or a cost increase.
The OHARNG Environmental Department will provide the required ESA Sec 7 consultation and the NHPA Sec 106 consultation for the PCN. The Contractor is required to provide a project description and details necessary for the OHARNG to complete these.
4.5.2 Sec 401 Water Quality Certification (WQC)
The Ohio EPA General Sec 401 Water Quality Certification is valid for NWP3 in all locations so a determination of eligibility using Ohio EPA Sec 401 WQC eligibility map is not required and an Individual Sec 401 WQC is not required.
4.5.3 Pre-Construction Notification (PCN)
4.5.3.1 A PCN is required for the culvert replacement.
4.5.3.2 Using a qualified wetland consultant, the Contractor will prepare and submit a PCN(s) in accordance with the General Wetland Requirements above.
4.5.3.3 The PCN will be submitted to: U.S. Army corps of Engineers, Pittsburgh District, William S. Moorhead Federal Building, 1000 Liberty Avenue, Pittsburgh, Pennsylvania 15222-4186,412-395-7155.

4.6 The contractor will develop and submit a Notice of Intent (NOI) for coverage under the Ohio EPA General NPDES Permit for Storm Water Discharges Associated with Construction Activity for project locations that disturb one or more acres. Any minor editing to finalize the Storm Water Pollution Prevention Plans (SWP3) will also be included as part of this contract. Cost for these items, including the NOI fees and any other permit fees, are the contractor’s responsibility to pay. See Section 3.0 of the attached Supplemental Conditions Environmental for specific requirements.
4.7 The contractor is required to develop an environmental work plan applicable to their work activities. This work plan should be very simple and focused. It must identify points of contact and identify who is responsible for environmental compliance for the project. The plan must include the CJAG emergency notification and spill response form. It must identify where contractor spill kits are located. It must identify fuel locations and contractor emergency response procedures. It must identify how storm water will be managed, how spoil piles will be managed, vegetation removal, types of waste and their management, recycling of materials, concrete outwash, hazardous materials on site and their management, and any other applicable environmental issues. The intent of the plan is to identify issues and determine how they will be managed before work starts. See Section 2 of the Supplemental Conditions Environmental.
4.8 The awarded contractor must attend a Pre-Construction Meeting (PRECON) with the CJAG personnel to discuss access procedures, intended schedule, and other issues to ensure successful completion of the work.
4.9 Contractor will provide the OHARNG with one construction schedule to cover all work under the contract. The schedule will be kept current and updated with any changes.

Culvert replacements must comply with USACE Nationwide Permit #3. Downstream flow must be maintained at all times. Hardwood material four inches and greater in diameter will be cut into eight-foot lengths and neatly stacked in an accessible area near the work location and approved by the OHARNG. All other plant material will be removed from site and processed for recycling if possible or otherwise properly disposed.
4.12 Excess soil may be kept on site for later use or future phases of the project. In order to remain, the soil must be approved via submittal to the CJAG Environmental Office. Soil that is determined to be unacceptable must be removed at the expense of the contractor. If it is determined that any soil will be kept the storage location will be determined by CJAG Environmental. Any damage done to the paved roads or debris left behind will be the responsibility of the Contractor to repair/clean up. Silt fence will be placed around the stockpiled soil, and it must be stabilized with vegetation to protect the surrounding area from sediment runoff.
