About this file

This is an attachment to an Invitation to Bid (ITB) issued by the Florida Department of Management Services for Natural Gas Supply (ITB No. 25-83101601-ITB-V2). Attachment O is a mandatory Principal Place of Business Letter that bidders must complete and submit with their bid responses. The letter requires bidders to declare whether their principal place of business is located within Florida or outside of Florida. Bidders with a Florida principal place of business must complete a basic certification section with company information and an authorized representative's signature. The solicitation intends to establish a state term contract for natural gas supply with the potential for multiple statewide awards, though the Department reserves the right to award to one or multiple bidders by region or make no award based on the state's best interests. Responses must be submitted through the MyFloridaMarketPlace Sourcing Event via the SAP Business Network, and bidders are responsible for monitoring the Vendor Information Portal (VIP) for all procurement-related communications and decisions. Alyssa Wallace, Purchasing Analyst, serves as the primary procurement contact.

For bidders with a principal place of business outside of Florida, completion of the legal opinion section is mandatory; failure to provide this section will result in the bid being deemed non-responsive. Out-of-state bidders must obtain a written opinion from an attorney licensed to practice in their state of principal business location regarding any state preferences granted to in-state business entities in public contracting. The attorney's opinion must detail whether the bidder's state of business location grants preferences to its own entities and, if so, describe all applicable preferences. This requirement is mandated by Section 287.084(2), Florida Statutes, and serves to inform the state of any competitive advantages that may exist under the bidder's home state law.
