About this file

This is a Bid Guaranty Certification document issued by the District of Columbia Department of General Services for construction task order proposals related to school and municipal facility improvements. The certification applies to offerors submitting either a cashier's check or irrevocable letter of credit as alternative bid security in lieu of a traditional bid bond. The document requires proper notarization and acknowledgment that, upon contract award, the contractor must promptly post a payment and performance bond equal to the full contract value. The accompanying Request for Task Order Proposals (RFTOP) documents outline multiple construction projects at District of Columbia public schools and municipal facilities, including door replacement at Bunker Hill Elementary School, a welcome center addition at Ketcham Elementary School, miscellaneous repairs at Bruce Monroe Elementary School, and HVAC system installation at Tyler Elementary School. Each project requires submission of detailed bid forms, key personnel information including field superintendents and project managers, subcontractor and supplier lists, project management plans with preliminary schedules, bid bonds in the specified form, and subcontracting plans. Mandatory pre-bid conferences and site visits are required for project evaluation, with written questions due by specified deadlines and sealed bids due on designated dates, typically within 30 to 60 days of solicitation issuance. Contract terms extend from Notice to Proceed through substantial completion dates, with liquidated damages provisions for schedule delays.

Pricing for these task orders is evaluated based on lowest responsive and responsible bid price with lump sum amounts detailed in the Bid Form (Attachment B). All contractors must comply with Davis-Bacon prevailing wage determinations, the Living Wage Act requiring minimum hourly rates of $17.50 per hour, and the Service Contract Act. Contractors must demonstrate ability to furnish performance and payment bonds equal to 100 percent of contract value and comply with mandatory subcontracting requirements, including First Source Employment Agreements requiring 51 percent District resident hiring with detailed employment plans and community outreach strategies. Additional compliance requirements include submission of SBE Subcontracting Plans identifying all subcontractors, Tax Affidavits, Bidder/Offeror Certification Forms, Equal Employment Opportunity Statements, and Campaign Finance Reform Contractor Self-Certification Forms. Offerors submitting alternative bid security in the form of cashier's checks or letters of credit must certify that failure to post required performance and payment bonds will result in drawdown of the alternative bid security as liquidated damages, contract termination, a two-year prohibition on using alternative bid security, and waiver of termination protest rights. The Department reserves the right to award based on lowest bid while considering non-price factors and maintains discretion in final award determinations.

Certification Letter for Cashier’s Check or Irrevocable Letter of Credit

Offerors who submit a cashier’s check or an irrevocable letter of credit (“Alternate Bid Security”) in lieu of a bid bond must also submit this certification, properly notarized, with their proposal.

By executing this document, Offeror acknowledges that, if awarded this contract, Offeror shall be required to post promptly a payment and performance bond equal to the full value of the contract. In the event Offeror fails to post such payment and performance bond, the Offeror understands and agrees that; (i) the Department shall draw upon the Alternate Bid Security as liquidated damages; (ii) the award and or contract shall be terminated; (iii) for a period of two (2) years thereafter, the Department will not accept from such Offeror Alternate Bid Security in lieu of a bid bond; and (iv) the Offeror hereby waives the right to protest the termination of any such award or contract. The Offeror further acknowledges and agrees that the damages the Department would experience in the event such award or contract are terminated due to the Offeror’s failure to post a payment and performance bond are difficult to determine and that the value of the Alternate Bid Security represents a reasonable estimate of the damages the Department would incur.
