About this file

This is a Certification Letter for Bid Guaranty (Attachment K) issued by the District of Columbia Department of General Services, Contracts and Procurement Division, for use with multiple Request for Task Order Proposals (RFTOPs). The document applies to offerors who elect to submit a cashier's check or irrevocable letter of credit as alternate bid security in lieu of a traditional bid bond. The certification letter must be properly notarized and submitted with the proposal. The solicitations include multiple task orders for school facility projects, including door replacement at Bunker Hill Elementary School, a welcome center at Ketcham Elementary School, miscellaneous work at Bruce Monroe Elementary School, and HVAC installation at Tyler Elementary School. All work is subject to Davis Bacon wage determination, the Living Wage Act, and the Service Contract Act as applicable at the time of task order execution. Contractors must comply with subcontracting plan requirements, residency hiring requirements for District residents (51% of new positions), apprenticeship act provisions, and first source employment agreements.

The certification acknowledges that awarded contractors must provide a payment and performance bond equal to the full contract value prior to commencing work. Failure to post such bonds results in the Department drawing upon the alternate bid security as liquidated damages, termination of the award or contract, a two-year prohibition on submitting alternate bid security in lieu of bonds, and waiver of the right to protest termination. Award methodology is based on lowest responsive and responsible bid considering only the lump sum price from the completed Bid Form (Attachment B). Contractors must submit key personnel information, subcontractor and supplier lists, project management plans, preliminary schedules, and subcontracting plans as part of their proposals. The contracting office is managed by Ebti K. Hana, and all work must comply with Article 12 of the underlying IDIQ Contract regarding program management requirements.

Certification Letter for Cashier’s Check or Irrevocable Letter of Credit

Offerors who submit a cashier’s check or an irrevocable letter of credit (“Alternate Bid Security”) in lieu of a bid bond must also submit this certification, properly notarized, with their proposal.

By executing this document, Offeror acknowledges that, if awarded this contract, Offeror shall be required to post promptly a payment and performance bond equal to the full value of the contract. In the event Offeror fails to post such payment and performance bond, the Offeror understands and agrees that; (i) the Department shall draw upon the Alternate Bid Security as liquidated damages; (ii) the award and or contract shall be terminated; (iii) for a period of two (2) years thereafter, the Department will not accept from such Offeror Alternate Bid Security in lieu of a bid bond; and (iv) the Offeror hereby waives the right to protest the termination of any such award or contract. The Offeror further acknowledges and agrees that the damages the Department would experience in the event such award or contract are terminated due to the Offeror’s failure to post a payment and performance bond are difficult to determine and that the value of the Alternate Bid Security represents a reasonable estimate of the damages the Department would incur.
