About this file

This is a Non-Disclosure Agreement required for responding to Library of Congress Solicitation #030ADV26Q0053, which involves access to confidential information regarding DC2 and DC4 Data Center addresses at the Library of Congress. Confidential Information is defined broadly to include all technical and non-technical information, know-how, and data disclosed in any format (oral, written, graphic, photographic, or electronic) and identified as confidential pursuant to the agreement. The Library of Congress retains the right to refuse delivery of confidential information to organizations it does not consider essential to completion of the requirement.

Signatories agree to hold all Confidential Information in confidence and not disclose it to third parties, use it solely for responding to the Solicitation, safeguard it consistent with company practices until destruction, limit access to employees or contractors who reasonably require it for proposal preparation, and take reasonable measures to prevent unauthorized use or disclosure. Signatories must inform their employer, co-workers, and contractors of confidentiality obligations and require employees and contractors with access to sign compliance statements. The confidentiality obligations do not apply to information that becomes publicly known without breach of the agreement, is known to the undersigned at time of disclosure as evidenced by written Library of Congress records, is disclosed in good faith by a third party with independent rights to the information, or is required to be disclosed by law or court order. If subpoenaed to testify or produce documents that could result in disclosure, the Contractor must provide the Library advance notification to enable authorization or prevention of such disclosure where practicable and lawful.
