SECTION C-1.0 GENERAL

C-1.1 Introduction This Performance Work Statement (PWS) is for Contractor Owned-Contractor-operated (COCO) fuel services at Altus Air Force Base, Oklahoma. The Contractor will operate, maintain, manage and provide retail/bulk fuel services as described herein for all fuel facilities, related structures, and property described in this PWS (see Appendix A for Facility Specifications). Refueling operations and maintenance will be performed IAW best commercial practices. As required, the Contractor shall furnish all personnel, equipment, facilities and/or material necessary for providing these services.

C-1.1.1 Real Estate Instrument with Installation: IAW 10 U.S.C. 2667, this fuel services contract serves as in-kind consideration to support a no-cost real estate instrument between the contractor and the installations representative. A draft real estate instrument is included as an Attachment in Section J of the Request for Proposal. DLA is not a party to this instrument but as part of contract performance, the awardee will be responsible for executing a final instrument with representatives of the Installation staff. Offerors are responsible for reviewing the draft real estate instrument and raising any questions concerning the draft provisions with the Contracting Officer prior to submitting their initial proposal. The Contractor must sign the final real estate instrument with representatives of the Installation staff within thirty (30) days of receipt of the negotiated instrument. Any request for delay in this timeline must be approved by the Contracting Officer. Upon completion of the property real estate instrument between the contractor and the installation representative, the executed document will be incorporated into the contract by modification.

C-1.2 Mission Statement The Contractor shall provide COCO operation and maintenance services for bulk and retail refueling services. The Contractor shall be responsible for operation and maintenance of all facilities and equipment and will be accountable according to the provisions of this contract.

C-1.3 Scope of Work The Contractor shall perform required tasks to include fuel operations, management and administration pertaining to the receipt, storage and handling, and issue of DLA Energy fuel products. In addition, the Contractor shall ensure all personnel are adequately trained to perform job tasks, maintain the security of facilities and computer systems, and comply with Federal, State, DoD, Air Force, Installation, and Local laws, rules, regulations, and guidance.

C-1.4 Contract Performance The Contractor shall monitor performance and ensure contract compliance as prescribed by the Contract Compliance Plan submitted. The Contractor shall perform and achieve performance standards for each task. The Contractor shall, submit performance-based plans to ensure performance standards are met and comply with applicable regulations as described in section

4.0 of this PWS. The Contractor shall ensure compliance with and be responsible for obtaining copies of all applicable Federal, State, DoD, Air Force, Installation, and Local laws, rules, regulations, and guidance, including updates/changes.

C-1.5 Personnel Qualifications (listed in Appendix F of this document)

The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. The Contractor personnel shall be able to read and understand English to the extent of reading and understanding printed regulations, detailed written orders and operating procedures, training instructions and materials, and shall be able to compose reports that convey complete information.

C-1.5.1 General Personnel Staffing Objectives

The Contractor shall provide the management and supervisory staff and labor to accomplish all services as identified within this PWS and all related contract texts or QAP’s. The Contractor’s staffing shall be flexible and fully capable of meeting the demands of the PWS. However, the Contractor shall not schedule personnel to work more than a 12-hour shift followed by an eight-hour break.

C-1.5.1.2 Knowledge and Skills

The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet the performance standards for those tasks and comply with all applicable Federal and State laws, regulations, and code. All employees shall be able to read and understand English to the extent they can understand and follow written and oral instructions/directions and be capable of writing in English. All employees shall be capable of performing basic numeric operations and the use of numbers as they relate to ledgers, logs, and forms, meters, gauges, and measuring devices.

C-1.5.1.3 Employment Standards

All employees or persons shall comply with all Federal, State, DOD, Installation regulations, instructions, guidelines, and policy regarding employment at Altus Air Force Base. The Contractor shall be responsible for ensuring employee adherence to DOD and Installation regulations and policies.

C-1.5.1.4 Essential Personnel

Essential personnel, the corporate executive officer and the on-site manager team, shall have the education, training, background/experience, and skills outlined in Appendix F.

Must have skills required and necessary to make fiscal and management decisions, direct personnel, and work with individuals at all levels of corporate management and the military for this contract.

C-1.5.1.5 Corporate Executive Officer

To assure continuity between the contracted location/activity and corporate office, the Contractor shall employ an executive, who, for the duration of the contract, can make

6 As of February 7, 2024 fiscal, management, and administrative decisions concerning this contract. He/she should have a complete understanding of the terms and conditions of this contract and shall be knowledgeable of fuel management and operations to the extent outlined herein.

C-1.5.1.6 Terminal Manager (TM)

Terminal Manager (TM): The TM shall have experience in bulk fuel storage and distribution systems/facilities, and quality surveillance, inventory, accounting, and administration. Practical experience in the basic design and layout of petroleum facilities, component makeup and flow characteristics of storage piping systems, and the ability to read and understand basic drawings, blueprints, and system specifications is also required. Other than those administrative duties commonly associated with and carried out by an individual in a management position, the site manager shall not have collateral duties nor shall the position be a collateral duty. Two years of the TM’s experience shall have been supervisory gained within the five years immediately prior to the contract start date. That experience shall have been specialized supervisory training in bulk storage and aircraft fuel servicing operations with emphasis in equipment inspection, operation, maintenance, inventory management, and environmental compliance.

C-1.6 Suitability Investigations Contractor personnel shall successfully complete a background investigation which includes, as a minimum, a National Agency Check (NAC), before operating a computer workstation that has access to a government server or when the Contractor employees require unescorted entry to restricted areas. These investigations shall be submitted by Altus Air Force Base at no additional cost to the Contractor. The Contractor is responsible for submitting documentation to the appropriate office for applicable employees and shall comply with the DOD 5200.2-R, Personnel Security Program.

C-1.7 Drug Free Workplace The Contractor shall establish and maintain a Workplace Drug Testing Program in accordance with Executive Order 12565, “Mandatory Guidelines for Federal Workplace Drug Testing Programs”, dated September 15, 1986, and Section 503 of Publication 100-71, 5 United States Code (USC), Section 7301, the Supplemental Appropriations Act for Fiscal Year 1987, dated July 11, 1987.

C-1.8 Applicable Directives The Contractor shall comply with applicable statutory and regulatory requirements and validated best commercial practices. This requirement applies to all performance criteria and deliverables set forth in this document. Appendix - E provides a list of directives and other guidance that are applicable to the performance of this contract. The list is not all inclusive. In the event of conflicting guidance, the most stringent shall be enforced. Contact the Contracting Officer and/or the Contracting Officer’s Representative (COR) for clarification.

C-1.9 Quality Monitoring and Evaluation DLA Energy shall utilize a Quality Assurance Surveillance Plan (QASP) to monitor and evaluate the Contractor’s performance throughout the contract performance period. DLA

Energy may also perform customer satisfaction surveys, which may be used as part of the assessment of Contractor’s performance. The Contracting Officer has the option to increase the frequency of surveys to address contract compliance issues as needed.

SECTION C-2.0 PERFORMANCE REQUIREMENTS

C-2.1 Fuel Operations Retail dispensing will be provided for refueling of ground vehicles/equipment including ultra low sulfur diesel (ULD), and unleaded gasoline. Bulk mobile refueling vehicle (C300/C301) filling and offloading (return-to-bulk) capability will be provided for both ULD and unleaded.

Fuel operations at the retail fuel facility must be safely and efficiently conducted to receive, store, and issue petroleum products with appropriate controls to ensure adequate fuel quality, inventory accuracy and environmental compliance in accordance with DLA Energy guidance, the highest industry standard, best commercial practices, and in accordance with all applicable Federal, State, DoD, Air Force, Installation, and local laws, rules, regulations, and guidance.

C-2.2.1 After-Hours Response The Contractor shall establish an after-hours notification mechanism: a means of being contacted in the event emergency services or workforce augmentation is. All services required outside of the normal hours of operation shall be met within two (2) hours as measured from the time the Contractor is notified until the operator is in position to perform the service required.

C-2.3 Fuel Operations The Contractor will perform all fuel operations, inventory management, quality surveillance, maintenance, training, safety and environmental protection functions at the ground fuel service station. The service station will provide fuel support to authorized reimbursable Defense Working Capital Fund (DWCF) customers that have approved DLA–Energy purchase devices or have an assigned DODAAC, FEDAAC or "2A" DODAAC.

C-2.4 Product Receipt The Contractor shall at all times safely receive product without causing delays, interruption, or demurrage. This applies to response times for duty hours, non-duty hours, and extended surge operations at the specified refueling sites. During commercial tanker truck receipts, the

Contractor will escort fuel delivery trucks from and to the gate for all sites.

C-2.4.1 The Contractor will order fuel using the appropriate DLA system and shall immediately notify the DLA Energy Region office of any inventory/quantity discrepancies or the DLA Energy QAR and Air Force Petroleum Office (AFPET) of any quality discrepancies.

C-2.4.2 The Contractor shall schedule inbound fuel shipments, receipts utilizing appropriate DLA Energy systems i.e. (PORTS, EBS etc.). Receipt notification shall include the quantity received, mode of delivery, delivery date, shipment source, grade or type of product, and any special instructions. The Contractor shall immediately notify the COR/QAR designated office of any fuel quantity or quality discrepancy; the COR will notify DLA Energy Americas. The Contractor shall not offload off specification fuel unless a waiver has been granted by DLA Energy-Q (Quality/Tech Support Office).

The Contractor shall prepare all documents required for product receipt.

C-2.4.3 All incoming product shall be sampled in accordance with the most current version of MIL STD 3004-1 and Quantity determination shall be performed as outlined in DoD Manual 4140.25, DLA Energy Interim Policy P-2 and API Manual of Petroleum Measurement Standards (MPMS). The Contractor shall accomplish and submit all appropriate documentation to the DLA Energy Regional Office.

C-2.4.4 During transport truck receipts, the custody and risk of loss shall pass from the carrier to the Contractor when the product passes from the end of the truck discharge hoses into the Contractor’s receiving facility.

C-2.4.5 The Contractor shall not receive and dispense fuel from the same tank simultaneously.

C-2.5 Product Storage At all times the Contractor shall safely maintain product quantity, quality, and availability to meet its intended use as specified in contract clause E1.01 CONTRACTOR RESPONSIBILITY FOR GOVERNMENT INSPECTION OF SERVICES and I119.04 INVENTORY CONTROL RECORDS AND SYSTEM OF RECORDS. The Contractor shall maintain the product storage facilities, as well as maintain product stock levels required to support the mission and planning requirements, within allowable limits. Product will be maintained to preclude degradation, contamination, commingling, or other occurrences which render the product unsuitable for its intended use. The Contractor shall immediately notify the COR/designated office of any issues which impact the integrity, quantity, or availability of fuel in storage.

C-2.6 Product Issue

Except for scheduled maintenance, receipt operations, and other occurrences of which the COR has been notified, the Contractor shall maintain a tank in the ready-to-issue mode for bulk and retail dispensing 24/7. The Contractor shall issue product without causing operational delays and ensure that all product is on specification. The Contractor shall immediately notify the COR of any discrepancy or issue that may result in the inability to issue product.

C-2.6.1 The Contractor must have the ability to dispense (retail) fuel to a minimum of 50 various combinations of wheeled vehicles and equipment per hour with all fuel grades to support issue requirements configured as follows:

C-2.6.2 Bulk loading and offloading (return-to-bulk) of mobile refueling vehicles (C300/C301) capability will be provided for both DS2 and GUR as needed to support estimated requirements as follows:

C-2.6.3 Vehicle overall dimensions that will use retail islands range from approximately 42’ long, 4’ to 10’ wide and 14’ high. Facility drive surface shall be designed to support tactical equipment of approximately 35 tons.

C-2.7 Electronic Point of Sale, QR (Quick Response) Code Management The Contractor will provide the appropriate hardware for the COCO facilities, and DLA Energy will provide the appropriate equipment and software for Electronic Point of Sale (EPoS) support of COCO fuel facilities. The contractor shall utilize EPoS devices (pedestal and/or mobile) provided by DLA Energy as Incidental Equipment to capture and report sales from the COCO. The contractor must contact the DLA Policy and System Sustainment Branch at EPoSFunctionalSupport@dla.mil to coordinate the installation on the COCO retail facility prior to DLA Energy accepting the facility.

Prior to the end of the contract terms or termination of the contract, the contractor will again use the same email address to obtain disposition instructions. The Responsible Officer, Terminal Manager or Organization Commander will appoint one or more Vehicle Purchase Media Manager(s) IAW DLA- Energy P-29 paragraph 2.2.

C-2.8 Accounting for Fuel/Inventory Management The Contractor shall account for fuel according to I-119.04 and DoDM 4140.25 “DoD Management of Energy Commodities” and other applicable DLA Energy policies and procedures.

C-2.8.1 Physical Inventory Management The Contractor shall follow the physical inventory management procedures specified in applicable directives and contract clauses/provisions to maintain sufficient product inventories to meet daily demand requirements and minimum levels required in the Inventory Management Plan (IMP) and/or by the DLA Energy Region.

• Ensure all orders, receipts, transfers, shipments, issues, losses, gains, adjustments, and other transactions/actions are properly documented. Maintain control over the physical environment to ensure proper product storage and prevention of losses.

• Ensure inventory variations are within allowable limits. Investigate, document, report, and take corrective action, when necessary, on excessive variations.

• Provide and maintain manual gauging equipment/supplies (tape and bob, fuel and water finding paste) and manually perform inventory tasks in the event of Automatic Tank Gauging (ATG) inoperability or if ATG readings are in question, as required per directives. Ensure tape and bobs are calibrated during annual ATG calibration and replace as necessary.

• Provide all applicable documents within required timeframes to accountant for input into the DLA Energy accounting system.

C-2.8.2 Inventory Control Records and System of Record Requirements The Contractor shall follow the physical inventory management procedures specified in applicable directives and contract texts in accordance with the most current version of Department of Defense Manual 4140.25 and DLA Energy Class IIIB Supply Chain Management Interim Policy and Procedural Guidance. The contractor shall maintain sufficient product inventories to meet daily demand requirements and minimum levels required in the Inventory Management Plan (IMP) and/or by the DLA Energy Region.

The management of fuel inventories involves a full range of actions associated with order, requisition, receipt, transfer, issue, physical inventory, and storage of fuel. The Contractor shall process inventory data of Government-owned product(s) utilizing DLA Energy’s web-based application Accountable Property System of Record (APSR). DLA Energy will provide training to a minimum of two Contractor personnel. See contract text I119.04 INVENTORY CONTROL RECORDS AND SYSTEM OF RECORDS for additional information regarding the

• Ensure that all orders, receipts, transfers, issues sales/credits, losses, gains, and adjustments are properly documented.

• Maintain control over the physical environment to ensure proper product storage can take place with minimal losses.

• Ensure automated tank gauges are verified monthly against manual gauge readings and calibrated annually if used to report inventory volumes.

• Ensure inventory variations are within allowable limits. Document, investigate, report, and take corrective action, if necessary, on excessive variations.

C-2.8.3 APSR Automated Data Processing (ADP) Equipment The Contractor shall provide an ADP computer system that meets the current commercial standards for a computer system capable of accomplishing the data reporting and records keeping required by APSR, email, maintaining the data collection and records keeping associated with product quality surveillance (product analysis and testing reports), and the document collection and records keeping associated with the Contractor’s preventive maintenance program. DLA Energy will provide the appropriate equipment and software for EPoS support of COCO fuel facilities.

C-2.9 Product Quality The Contractor shall ensure proper product quality. Quality control includes but is not necessarily limited to visual inspection of product receipt samples, daily recirculation of all fuel dispensing systems/equipment and periodic receipt and bulk storage all level/bottom samples as

11 As of February 7, 2024 required by the Air Force Petroleum Agency. No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications. The Contractor shall adhere to recommended settling time for fuel receipts prior to issue. Products shall be issued on a first-in, first-out basis unless otherwise specified or directed by the KO/COR. Additional sampling/testing may be required as determined by the KO/COR.

The Contractor shall take all samples and ship those requiring analysis to the Air Force Petroleum Agency fuels laboratory, Wright-Patterson AFB, OH. Samples shall be shipped within 72 hours of being drawn.

The KO/COR/AFPET/DLA Energy QAR shall be notified immediately of any suspected fuel quality issues prior to fuel receipts, transfers or issues. The Contractor shall take retention samples when directed by the KO. Samples representing receipts of capitalized products shall be properly marked by the Contractor as to product, source, and date taken for retention as determined by the COR/QAR.

The Contractor shall provide all necessary laboratory supplies and replacement equipment without additional government funding.

Sample requirements for all product grades will be accomplished IAW applicable MIL-STD- 3004-1 standards in regard to fuel quality.

C-2.10 Safety The Contractor will ensure Contractor personnel have a safe and healthy work environment. It is essential that personnel handling fuel products and related equipment at the fuel facilities are thoroughly knowledgeable of the principal hazards to be encountered and how to prevent or reduce these hazards IAW applicable Federal, State, DoD, Air Force, Installation, and local laws, rules, regulations, and guidance. The Contractors safety program shall instruct employees how to eliminate the hazards or cope with them in a safe manner. Contractor shall comply with applicable safety requirements and Installation fire regulations at all times and shall maintain documentation showing compliance which shall be available to DLA Energy or designated representative at any time. Contractor shall provide 24-hour contact information to the Installation fire department dispatch center. The Contractor shall provide and replace as necessary all Personal Protective Equipment (PPE) and other safety items required for performing operations and maintenance tasks.

C-2.11 Security The Contractor shall incorporate necessary physical, personnel, operations, communications, and information system security to obtain and control access to applicable restricted/controlled areas, ensure only appropriate computer and information access, and maintain integrity and safety of applicable fuel facilities, equipment, and vehicles. These security measures shall include controlling access by only authorized personnel to fuel facilities and equipment under Contractor control to include escorting personnel while in the area. The Contractor shall inspect gates, fencing, and security lighting surrounding fuel facilities and perform maintenance and repairs as needed. Gates, buildings, and system valves will be secured when not in use. The Contractor shall conduct background checks meeting National Agency Check

12 As of February 7, 2024 and Inquiry (NACI) standards or higher as required for Contractor personnel. The Contractor shall ensure requirements for application, receipt, use, and turn-in of personnel badges are met such as for Common Access Cards and flightline/restricted area badges. The Contractor shall establish information systems security measures appropriate to the level of computer use. The Contractor shall establish liaison with appropriate Installation law enforcement agencies in development and implementation of security measures. The Contractor is not responsible for providing dedicated guards. Force protection is the responsibility of the Installation. After hours security checks are performed by the Logistics Readiness Squadron (LRS) or Installation Security Forces personnel. The Contractor will respond immediately upon notification to correct security issues. Contractor personnel should be identified to the LRS and Installation Security Forces as mission essential as required to facilitate Installation entry and ensure uninterrupted fuel support during normal base operations, deployments, exercises, and contingencies as well as during periods of heightened security or inclement weather. The Contractor may be required to enter into a long-term Visitor Group Security Agreement (VGSA) if deemed necessary by Installation security forces or by virtue of the contract security requirements.

C-2.12 Environmental Protection The Contractor shall actively protect and enhance the quality of the environment by adhering to all Federal, State, DoD, Air Force, Installation, and local laws, rules, regulations, and guidance. requirements and by preventing or controlling pollution at the fuel facilities. The Contractor shall ensure dike draining or similar discharge actions are properly approved, performed, and documented as required. The Contractor shall provide sufficient initial and replacement spill response and clean up material for facilities and vehicles as required and properly dispose of hazardous material accumulated. If the Contractor receives a visit from or a Notice of Violation (NOV) from a federal, state, or local agency, the Contractor shall immediately notify the COR or Contracting Officer. The Contractor shall participate in the Environmental Management System (EMS).

C-2.12.1 Government Provided Documents Altus Air Force Base will provide the following environmental documents as applicable: Spill Prevention Control and Countermeasures (SPCC) Plan; Facility Response Plan (FRP); Hazardous Waste Management Plan; National Pollutant Discharge Elimination System (NPDES) Permit(s); Storm Water Pollution Prevention Plan (SWPPP); and Oil Pollution Prevention Operations Manual.

C-2.12.2 Leak Detection The Contractor shall conform to all applicable Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance concerning environmental protection.

C-2.12.3 Spill Response

1. In the event of a fuel spill, the Contractor shall make notifications IAW the SPCC Plan, FRP, or equivalent plan. Notifications shall be initiated immediately but no later than 15 minutes after discovering the spill.

2. In accordance with spill plans, for all spills the Contractor shall

13 As of February 7, 2024 immediately initiate necessary actions to stop and contain the spill. For small spills, the Contractor shall clean up the spill using appropriate spill response material and properly dispose of residual material. For large spills, removing ignition sources, evacuating personnel, cordoning off the area, and directing traffic may be required until relieved by appropriate authority.

3. Spill response actions beyond those outlined above should be provided by a Contractor-funded spill response team and/or qualified spill response Contractor IAW applicable plans.

4. Clean up actions required beyond emergency spill response should be provided by Contractor-funded remediation Contractor IAW applicable plans.

5. The Contractor should attempt to recover usable fuel to the greatest extent possible.

6. At the Contractor’s expense, all unusable fuel and hazardous substances generated by spill response (soil, used spill response supplies, etc.) shall be properly disposed of in accordance with applicable Federal, State, DoD, Air Force, Installation, and local laws, regulations, and guidance.

C-2.13 Training Requirements The Contractor shall ensure that each employee in the fuel operations workforce successfully completes job specific and mandatory training required IAW all applicable Federal, State, DoD, Air Force, Installation, and local laws, regulations, and guidance. The Contractor is responsible for maintaining each employee’s requisite certifications or licenses on file.

The Contractor shall establish and maintain a training program to ensure that applicable personnel receive training in the areas defined below, and IAW all applicable Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance. Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. The Contractor shall maintain documentation of training records which will include, but not limited to employees name, date of training, course information (synopsis), and test results, if applicable.

Altus AFB has a fully implemented Environmental Management System (EMS). All contractors must complete General EMS Awareness Training. Training is provided on CD and available on the Altus AFB website at http://www.altus.af.mil/ or (580) 481– 6221.

C-2.13.1 DLA Energy Provided Training The Contractor will ensure employees are fully qualified at the performance start date of the contract. DLA Energy will provide the following classroom instructions; Fuels Terminal Manager/Property Administrator/Responsible Officer course, (5 days), and the Fuels Manager Defense (FMD) course, (15 days). This training will be funded by DLA Energy. This includes training, transportation and lodging. DLA Energy will only fund the cost of training for initial two (2) individuals hired into requirement positions. Any additional employees requiring training will be funded by the Contractor. The Contractor will submit requests for classroom slots to the COR who will approve or disapprove requests based on contract requirements. Once approved, the Contractor will make a written request accompanied by an indemnification statement to the Contracting Officer http://www.altus.af.mil/

14 As of February 7, 2024 for scheduling. The Contractor shall ensure that all employees attend and participate in the Annual Spill Response Training.

C-2.13.2 Contractor Provided Training The Contractor shall provide the following training to all employees: OSHA Hazard Communication, Confined Space training, Hazardous Waste Operations and Emergency Response (HAZWOPER), Hazardous Materials (HAZMAT), OSHA Lock-out/Tagout, Personnel Protective Equipment, fuel operations, environmental compliance, and DoD Antiterrorism (AT Level I Awareness training) IAW applicable Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance.

Additional training requirements are as follows:

C-2.13.2.1 The Contractor will provide familiarization training to the Installation’s Fire Department on the facilities and procedures when requested.

C-2.13.2.2 All Training records will be made available to the COR upon request.

C-2.14 Contractor Furnished Items The Contractor shall provide sufficient and adequate tools, personnel protective equipment, vehicles, and other items needed to adequately and safely perform all operations and maintenance tasks required by the contract. The Contractor shall ensure compatibility between Contractor items and on-site facilities, systems, and equipment.

C-2.14.1 Disposition of Contractor Furnished Items Contractor items identified herein shall be used solely in the performance of the work define within this PWS. The Contractor shall not store items in excess of the contract requirements on Installation property. Upon termination of the contract, all Contractor items shall be removed from Installation property within 30 days. Thereafter, the Contractor shall be charged the prevailing commercial storage rate for any items kept on Installation property.

C-2.14.2 Restoration of Property: The Contractor shall be responsible for and shall include in their technical proposal an annex providing a detailed plan addressing facilities closure; demolition; removal; disposal; and restoration of the land leased from the Installation. Land restoration is defined as a state in which the leased land is free of any contamination, debris, or other environmental hazards or impact resulting from the Contractor’s use in the performance of this contract in compliance with all applicable Federal, State, DoD, Air Force, Installation, and Local laws, regulations, guidance, and lease provisions. The Contractor shall comply with all Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance, and Installation requirements for Tank Closure (closing and demolition facilities etc.).The Contractor shall be responsible for facilities closure; demolition; removal; disposal; and restoration of the land leased from the Installation during this contract, however; the cost associated with

15 As of February 7, 2024 these tasks shall not be included in the firm fixed offer of this contract. Instead, the contractor shall submit a detailed plan and cost proposal for this work to the Contracting Officer upon request and shall obtain price competition from three vendors for this work. The cost for remediation actions due to/related to fuel contamination shall remain the responsibility of the contractor, shall not be included in the contract price or proposal cost, and shall adhere to all Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance. The Contractor will ensure the facilities remain fully operational until no more than 6 months from the end of the performance period.

C-2.14.3 Uniforms, Clothing, and Safety Equipment The Contractor shall provide a distinctive company uniform for personnel to wear in the performance of their duties. Uniforms shall be maintained in a clean, serviceable condition and replaced when excessive wear requires. The Contractor shall provide all personnel safety equipment including safety shoes, safety glasses, reflective vests, sound suppression devices, cranial protection, gloves and other identifiable special safety equipment for specific operation and maintenance procedures for personnel.

When a cap is worn, it will have the company logo on the front. No other caps/hats are authorized.

C-2.14.4 Contractor Furnished General Purpose Vehicles The Contractor shall provide sufficient general purpose vehicles with appropriate capability to meet the contract requirements including but not limited to escorting fuel deliveries where required, towing bowsers, transporting personnel, and performing expeditor duties as needed. The vehicles shall have a distinctive company logo or marking to ensure ease of recognition. The Contractor is responsible for ensuring any vehicle is properly licensed IAW local civilian requirements, registered with Installation security if applicable, adequately maintained, flightline capable if applicable, and operated only by licensed and qualified personnel. The Contractor is responsible for providing fuel for Contractor general purpose vehicles. The Contractor may request to establish a Fuels Purchase Agreement (FPA) to allow purchase of DWCF ground fuel for use in Contractor general-purpose vehicles.

C-2.15 Unauthorized Use of Facilities The Contractor shall not permit or authorize personnel to store or repair any personal property including boats, vehicles, trailers, motorcycles, etc., on leased property. In addition, the Contractor shall not utilize on-site equipment, property, or facilities for storage or repair of Contractor-owned vehicles and equipment not specifically required by the contract provisions.

Parking of personal vehicles used for transportation to and from work will be permitted in designated vehicle parking areas during working hours. The Contractor shall not allow employees to cook, smoke, have open flames, or have flammable materials in the work areas or inside any building. The designated smoking and cooking area will be designated by the Installation Fire Department.

C-2.16 Report Fraud, Waste and Abuse The Contractor shall promptly report to the contracting officer and fraud counsel any indications

16 As of February 7, 2024 of fraud, waste or abuse as well as any investigative contact (investigative/audit agency name, investigator/auditor’s name and phone number) concerning fraud, waste or abuse.

C-2.17 Notification of Correspondence and Visits The Contractor shall immediately provide the Contracting Officer (CO) and COR copies of all correspondence and notification of any visits relating to Federal, State, or Local officials or agencies and other personnel or Contractor that visit the retail fuel facility.

SECTION C-3.0 MAINTENANCE

C-3.1 Maintenance: The Contractor shall maintain the COCO fuel systems, e.g., facilities and equipment according to facility permits, applicable regulation, statute, manufacturer specifications/recommendations, and best commercial practices. The contractor will include in the monthly firm fixed price the cost of all operator maintenance, preventive maintenance, recurring maintenance checks/services, and minor repairs.

C-3.2 Operator Maintenance: Operator maintenance is normally performed by facility operators as part of normal use such as pre/post operation inspection, other periodic inspections and actions taken to control and run the petroleum fuel system on a day-to-day basis. These include actions taken to ensure equipment functions properly and safely, and to protect the environment based on the Original Equipment Manufacturer (OEM) Manuals, manufacturer recommendations and best commercial practices. Inspection records and OEM Manuals will be available on-site.

C-3.3 Preventive Maintenance: Preventive Maintenance is the routine maintenance of equipment and assets in order to preserve a facility, prevent deterioration, prevent component failure, prevent unscheduled outages, and identify components requiring replacement or repair.

This includes cleaning, pressure washing, painting, lubricating, adjusting, tightening, or similar tasks to equipment components in accordance with best industry practices and as recommended by equipment manufacturers.

C-3.4 Recurring Maintenance: Recurring maintenance is defined as all checks, services, calibration, and testing of petroleum fuel systems that are to be performed on a scheduled recurring basis; including, but not limited to, tasks required in accordance with, facility permits, federal, state, and local regulation, statute, manufacturer specification, and best industry practices. These tasks will be included in the Contractor’s Maintenance Plan and documented in the maintenance records available on-site.

C-3.5 Minor Repairs: Minor repair is defined as repairs to components performed by replacing parts using simple hand tools within the scope of the Department of Labor duty position description for a Fuel Distribution System Operator without other professional credentials required.

C- 3.6 Major Repairs: Repairs which exceed those described in paragraph 3.2, 3.3, 3.4, and 3.5 or the overhaul, replacement, or major repair of critical facility components to include storage

17 As of February 7, 2024 tanks, piping, canopies, dispensers, truck fill-stands, and pavement must be approved by the DLA Contracting Officer prior to having the work performed.

C-3.7 Maintenance Records: Maintenance, repairs, inspections, and test findings will be electronically and manually recorded and maintained in permanent facility’s files. The Contractor is required to keep all maintenance records using a computerized maintenance management system (CMMS). The Contractor shall develop and maintain an electronic database on deficiencies and problem areas needing corrective work. Record keeping includes all noted deficiencies found and work performed at the fuel facility, even if performed by another organization or Contractor. Records will be maintained for the duration of the contract and turned over to the Government at completion of the contract. In addition, the Government will be allowed unlimited/unrestricted access to the Contractor developed database.

C-3.8 Building and Grounds Maintenance: The Contractor shall maintain all facilities buildings and grounds in accordance with Installation guidelines. The Contractor will ensure buildings are clean, free of debris, and pest free. The Contractor shall be responsible for mowing and trimming the grounds. The Contractor will not permit or allow fire hazards to accumulate in buildings or on grounds. All pesticide application shall be in accordance with the Altus AFB Integrated Pest Management Plan.

C-3.9 Storage Tank Cleaning: The Contractor shall empty, inspect, and clean each bulk petroleum storage tank and dispose of all tank bottom waste for each tank covered under this contract in accordance with all applicable Federal, State, DoD, Air Force, Installation, and Local laws, regulations, and guidance. Prior to disposal of tanks bottoms, the Contractor must notify the COR and KO, and obtain official written approval from the Region QAR and Inventory Management Representative for proper disposition of the product. If applicable, the Contractor shall transfer remaining product to alternate tanks during tank cleaning. Tanks shall be cleaned in accordance with contract provision Quality Assurance Provision E18, Inspection and Cleaning of Bulk Petroleum storage Tanks (DLA Energy).

SECTION C-4.0 DELIVERABLES

C-4.1 Pre-Award Contractor Detailed Plans The Contractor shall provide the detailed plans that will accompany their proposal or at timelines indicated within the PWS.

C-4.2 Detailed Plans

The following plans shall be submitted to the contracting officer as indicated. The Contractor shall ensure that all required plans are acceptable to and approved by DLA Energy prior to the start of the contract performance period. DLA Energy reserves the right to request changes or modifications to any Contractor performance-based plans at any time throughout the contract performance period.

C-4.2.1 Contract Compliance Plan (CCP) The Contractor is responsible for ensuring compliance with all contract performance requirements. As such, the Contractor shall develop an inspection system acceptable to the Government pursuant to FAR 52.246-4 INSPECTION OF SERVICES-FIXED PRICE and 52.246-5 INSPECTION OF SERVICES COST REIMBURSEMENT for monitoring overall contract performance. The inspection system is to include a written CCP developed and used by the Contractor to measure performance on a continuous basis. The CCP shall include performance requirements for all of the services and tasks listed in this PWS and the Contractor’s own performance-based plans. General performance criteria shall include the Contractor’s ability to provide continuous support capabilities as specified in this PWS, record keeping and reporting procedures pertaining to administrative requirements, terminal operations, facility/equipment maintenance, pest management, upkeep and appearance of grounds and facilities under Contractor control. The contractor shall ensure compliance with the installation pest management plan if the use of pesticides, herbicides, etc., are required. The CCP shall include time specific checklists for evaluation of all operational and preventive maintenance requirements. The CCP shall address procedures for corrective actions including the resolution of any Corrective Action Requests (CAR) and Quality Deficiency Reports (QDR) generated by the Government. Any disagreements with the CCP will be resolved at least one level higher than the Contracting Officer. The CCP shall be made available for Government review, upon request, at any time during the contract performance period. The CCP may be used by the COR for monitoring and assessing contract performance. This plan shall be submitted no later than (NLT) 90 days prior to start of contract period of performance and shall be effective at the time of submittal.

C-4.2.2 Product Quality Plan

The Contractor shall provide a comprehensive and detailed plan that will ensure that products handled by the Contractor remain on-specification IAW MIL STD 3004-1 (most current version). The plan shall include sampling, test methods, equipment, and documentation of tests, records keeping, and actions to be taken in the event of unacceptable test results. The plan shall describe how product quality surveillance data will be documented and reported. The plan shall incorporate the requirements specified in Section C-2.9 of the PWS. The plan shall identify responsible parties for these functions. This plan shall be submitted NLT 90 days prior to start of contract period of performance and shall be effective at the time of submittal.

C-4.2.3 Environmental Protection Plan (EPP) The Contractor will continuously maintain an Environmental Protection Plan that complies with applicable provisions under Federal, State, DoD, Air Force, Installation, and local environmental laws, rules, regulations, and guidance. To include, but not limited to prevailing DoD directives and/or policies, including

19 As of February 7, 2024 but not limited to 40 CFR 112/Oil Pollution Prevention Regulation; 40 CFR 280/Underground Storage Tank Regulation; State Aboveground Storage Tank Regulation; State Air Pollution Control Regulation; and Air Force Environmental Compliance and Protection Manual.

The Plan shall conform/interface with Installation’s current plans and can include but are not limited to: Oil Discharge Contingency Plan; Oil Storage Tank Management Plan; Oil and Hazardous Substance Spill Prevention and Response Plan; Integrated Spill Management Plan; Storm Water Management Plan; and the Installation’s Environmental Management System (EMS) Initiatives.

The provisions of the Plan shall include, but are not limited to, identification of points of contact; telephone numbers; description of required emergency response supplies and equipment maintained and available in work areas;

personnel training requirements and certifications; required inspections;

operation and maintenance procedures; spill response, manifesting and proper waste disposal SOPs; spill reporting requirements; and recordkeeping.

The Plan shall be readily available and continuously maintained at the Contractor’s work areas. It shall indicate that the Contractor is responsible for completing spill response, site assessments, required reporting/notifications, containment and cleanup/remediation of spills IAW DLA Energy Policy P-40 (Fuel Spill/Leak/’Release’ Reporting) and the plans, as applicable and shall reference the contractor’s spill response plan.

The costs for spill materials shall be included in the proposal under the Monthly Use Charge CLIN 0001 (MUCC). The Contractor shall be responsible for proper disposal of contaminated items associated with any spill and any required remediation and identify the disposal process in the EPP.

Required environmental permits to operate the fuel facilities will be obtained and maintained by the Contractor and outlined in the EPP. If any monitoring or testing is required for permits or regulations, the Contractor will be responsible for coordinating the tests and…
