About this file

This is a Conflict of Interest Affidavit form required for the State of Maryland's Highway Mowing along US Route 50 Ocean Gateway in Talbot County (TAMO5028SB). The affidavit applies to all offerors, contractors, consultants, subcontractors, and their employees or agents with authority to control or supervise work under the contract. The project involves both zero turn mowing and hand mowing services along state highways in Talbot County, including a continuous 60-inch cut of medians, six-foot shoulder cuts, and grass islands on approximately 15 acres of US Route 50 (from mile point 12.960 to mile point 3.46), along with hand mowing and weed eating around signs, light poles, traffic poles, utility poles, culverts, catch basins, guardrails, and wet areas. The roadway will be bid on a per-cycle basis with invoicing upon completion of each full cycle. Contractors must own all commercial grade continuous 60-inch cut zero turn mowers and provide pictures of equipment with their bid, with up to 19 cycles anticipated across the contract duration on an as-needed basis.

The affidavit requires offerors to warrant that no relevant facts or circumstances give rise to or could give rise to conflicts of interest, except as disclosed in writing. The definition of conflict of interest includes situations where a person is unable to render impartial assistance or advice to the State, where objectivity in performing contract work is impaired, or where an unfair competitive advantage exists. Offerors must disclose any actual or potential conflicts in detail and agree to immediately notify the procurement officer in writing if conflicts arise after the affidavit date, including a description of actions taken to avoid, mitigate, or neutralize such conflicts. The affidavit must be submitted with the bid or proposal and is made under penalties of perjury, to be signed by an authorized representative and affiant on a specified date.
