About this file
This is a Maryland Living Wage Requirements Affidavit of Agreement form issued by the Maryland State Department of Education, Division of Rehabilitation Services for a snow and ice removal services contract at the Workforce and Technology Center (WTC) located at 2301 Argonne Drive, Baltimore, Maryland. The affidavit, effective July 2024, serves as a compliance document for solicitation R00B7600015 and requires bidders to either certify exemption from Maryland's Living Wage Law or commit to living wage compliance. The contract is designated as a Certified Small Business (CSB) procurement only, restricting bidding eligibility to small business entities.
The affidavit provides multiple exemption pathways for contractors, including nonprofit status, public service company designation, or employment thresholds combined with contract value limitations (10 or fewer employees with contracts under $500,000, or more than 10 employees with contracts under $100,000). For contractors subject to living wage requirements, the form mandates compliance with Title 18 of the Maryland State Finance and Procurement Article, requiring payment of the established living wage rate to covered employees and submission of payroll reports to the Commissioner of Labor and Industry. Contractors must ensure subcontractor compliance as well and automatically adjust wages upon Commissioner-announced rate increases. The affidavit includes provisions for contractors with no covered employees based on time allocation (less than one-half work week), employee age (17 or younger), or contract duration (less than 13 consecutive weeks). All bidders must submit the completed and witnessed affidavit with their proposals.
