About this file

This is a self-certification form required by the Indian Health Service (IHS) for the Buy Indian Act, used in conjunction with Sources Sought Notices, Requests for Information (RFI), or Solicitations.

The form requires offerors to self-certify whether they meet the definition of an "Indian Economic Enterprise" (IEE) with Indian ownership as defined under 25 U.S.C. 47 and HHSAR 326.601. Enterprises must maintain eligibility throughout three critical periods: at the time an offer is submitted, at contract award, and during the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. The form mandates that the 51% owner of the IEE firm be an enrolled member of a federally recognized tribal entity. Successful offerors must also register with the System of Award Management (SAM). The form includes explicit warnings that false or misleading information constitutes violations under 18 U.S.C. 1001 and that false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contracting Officers may require supporting documentation of eligibility before award, and awards may be protested if the successful offeror's eligibility is questioned. The form requires completion of fields identifying the solicitation number, project title, date, federally recognized tribal entity, business name, UEI number, and the certifying signature of the 51% owner.
