The contractor shall comply with the Financial Crimes Enforcement Network's (FinCEN) administrative, physical, and technical security controls to ensure that the Government's security requirements are met. |
The Contractor must have an active Facility Clearance at the level of SECRET. Interim facility clearances are not acceptable. FinCEN has restrictive security requirements for personnel assigned to perform work under this contract. All Contractor personnel employed by the Contractor or responsible to the Contractor for the performance of work under this contract shall possess a SECRET clearance based on a favorably adjudicated T3 (or equivalent) background investigation in accordance with Executive Order No. 12968. A final SECRET clearance by the start of the period of performance is required. Interim clearances are not acceptable.
All Contractor personnel supporting this contract are required to be actively enrolled in a Continuous vetting (CV) program consistent with current Trusted Workforce (TW) requirements, regardless of the date of the individual's last investigation or adjudication.
All Contractor employee investigative and security clearance actions are the responsibility of and shall be completed by the Contractor Company.
Failure of any Contractor to provide personnel with the appropriate clearance level means that the Contractor has failed to satisfy the contract's requirement to provide cleared personnel. Failure to meet the requirements to provide cleared personnel is grounds for termination of the contract. This policy applies to any personnel hired as replacements during the term of the contract. The Contracting Officer and the FinCEN Office of Security must approve all personnel replacements.
Classification guidance will be in accordance with source documents or the Treasury Classification Guide, dated September 21, 2021, provided at contract award. Controlled Unclassified Information (CUI) shall be the primary term used to mark sensitive but unclassified information originating within Treasury/bureau offices. Foreign Government Information, Limited Dissemination Information, Law Enforcement Sensitive, and For Official Use Only Information is CUI. CUI handling and protective measures shall be applied to any information labeled with these identifiers.
Approval is required from the FinCEN Office of Security prior to subcontracting any work associated with this contract that requires access to classified information or access to FinCEN facilities. Subcontractor DD254s will be submitted to the FinCEN Office of Security for concurrence prior to the subcontractor commencing work on the contract.
All Contractor personnel will comply with FinCEN’s Reporting Requirements, in accordance with Security Executive Agent Directive (SEAD) 3, Reporting Requirements for Personnel with Access to Classified Information or Who Hold a Sensitive Position. Failure by any Contractor employee to comply with FinCEN’s Reporting Requirements may result in administrative action to include removal from access to FinCEN facilities or information. In addition to the Contractor employee’s reporting requirements, the Contractor Facility Security Officer (FSO) is responsible for ensuring that a copy of any SEAD 3 reports or derogatory information reports are provided to the FinCEN Office of Security within 72 hours of receipt.
