About this file
This document is a required affidavit form issued by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking to be awarded contracts or contract renewals. The affidavit serves as a sworn statement under penalty of perjury and remains effective for one year from the date of execution. An authorized representative of the contracting party must complete and have the attestation notarized before submitting it to the Commonwealth. The form requires the contractor to affirm that it has not knowingly violated Kentucky campaign finance laws and that awarding a contract will not violate any provision of such laws. The Commonwealth retains the right to request updated affidavits at any time during the contract period.
The document includes three distinct affidavit variations for different bidder classifications. The Resident Bidder Status affidavit requires the bidding entity to confirm it is authorized to transact business in Kentucky and has, for one year prior to advertisement, filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained an active Kentucky workers' compensation policy. The Qualified Bidder Status affidavit applies to nonprofit corporations furthering the purposes of Kentucky Revised Statutes Chapter 163 and qualified nonprofit agencies for individuals with severe disabilities that employ individuals with severe disabilities for at least seventy-five percent of direct labor hours in manufacturing or providing listed products or services. The bidding agency reserves the right to request supporting documentation for any claimed status, and failure to provide such documentation upon request results in bidder disqualification or contract termination. All affidavits must be notarized and include the affiant's signature, printed name, title, company name, address, and the notary public's seal and commission expiration date.
