About this file

This document is a Standard Operating Procedure (SOP) that details the operational requirements for surface preparation and painting in order to comply with state and local water and waste regulations at Naval Air Station Oceana, Dam Neck Annex, and NALF Fentress.

The SOP outlines procedures for water blasting, dry scraping/sanding/blasting, and painting operations. It requires the collection and containment of all wastewater and solids from paint removal activities, with the wastewater potentially being discharged to the sanitary sewer system after testing and approval. The SOP also requires measures to minimize dust and capture paint chips/debris during dry surface preparation. For painting, the SOP specifies requirements for managing paint cans, solvent rags, brushes/rollers, and spill containment. Contact information is provided for the various media managers who must be consulted throughout the process.

Project as described does not propose to impact wetlands.

For laydown areas and any other outdoor work areas, appropriate erosion and sediment control should be utilized to avoid contamination into adjacent wetlands, waterways, ditches, and other stormwater systems. No equipment nor materials should be utilized nor stored in wetlands or waterways withot proper permits. Note stormwater drains and ditches immediately adjacent and within project work zone connect to waters of the U.S. that are considered linear wetlands and protected under the Clean Water Act. Inappropriate erosion and sediment control that results in a release of material into an upland section of ditch that then runs into wetland/waters of the US is considered fill of wetlands and subject to the issuance of a notice of violation under the CWA.

POC for applicable BMP’s and regulatory compliance requirements:

Michael Wright, PWD Oceana Natural Resources (NR) Program Manager, michael.f.wright@navy.mil, 757-433-3461.

Wetlands & Waters of the US

None Applicable. Navy has made a No Effects Determination as no species of concern are present on project site and project does not impact habitat associated with species of concern.

POC for applicable BMP’s and regulatory compliance requirements:

Essential Fish Habitat, Marine Mammals & T & E Species

As written, No anticipated impacts to Forestry, Ag, or recreation programs. Equipment and materials should be cleaned of soil and debris prior to and after coming to the installation. Forestry/Ag.

Several protected species occur on the installation or within the influence of the installation actions (e.g., air space, etc.). Particular species of concern include several bat, reptile, insect and bird species.

Navy has made a No Effects Determination (Project Code:

2024-0081154). Attached is the USFWS Consultation Official Species List and Northern long-eared bat (NLEB) Consistency Determination. Ensure a copy of these documents are maintained on site and ensure personnel are aware of the listed species of concern and the procedures to follow (described below) if protected species are observed on the project site.

If any protected species are observed on the project site stop work on the site where the animal is located and contact the below POC immediately for further guidance. Particular species of concern anticipated potentially occurring on the project site are bats and birds (for birds, it is only if they have active nests/nest w eggs or hatchlings, on site).

Navy determination was made based on the following assumptions:

project does not impact habitat associated with species of concern;

project noise is not anticipated to exceed that of the existing ambient noise on the installation; project is impacting existing built environment; project does not propose to impact bridges or culverts;

project does not propose the use of pesticides; project does not propose to conduct the work after dark; project does not propose to install exterior lighting; and project does not propose to install exterior windows/glass walls.

Revised 2/19/2020 Page 8 of 12Environmental Checklist

If project SOW changes are made that change any of the above assumption, contact the below POC to obtain additional requirements and updated consultations.

POC for applicable BMP’s and regulatory compliance requirements:

Terrestrial Threatened & Endangered Species

Due to proximity to aircraft air space and helicopter landing sites, avoid creating Bird/Animal Aircraft Hazard (BASH) issues:

Ensure facility, equipment and housing does not have unsecured holes that lead to the inside from the outside. Holes/ventilation should be secured with mesh or other appropriate material to exclude wildlife from entry. For planning purposes, some species of bats can enter through holes as small as 6mm.

Any storage structures or laydown area materials should be housed in a way to minimize its attraction to wildlife that could pose a Bird/Animal Aircraft Strike Hazard (BASH) on the installation. Areas of Mounded materials (soils, pipes, etc.) are very inviting to nesting, perching and/or feeding birds and to rodents which also attract larger animals to the area (prey/predator relationship). Storage areas that capture water may create mosquito breeding areas that attract wildlife to the site for feeding (take measures to avoid mosquito breeding). Areas of disturbed or seeded soil may also attract wildlife. Slit/hydro-seeding of seed or planting of plugs is preferred to minimize seed loss and attraction of wildlife into airspace.

Species of plants selected for landscaping or revegetation activities should be evaluated to select species that will minimize attracting wildlife that pose an elevated BASH threat to the airfield.

All outdoor trash receptacles (particularly those where food based trash is disposed) on site must be secured (lids/doors closed) at all times to avoid the attraction of wildlife to the site.

POC for applicable BMP’s and regulatory compliance requirements:

Doug Lynde Shultz, PWD Oceana Natural Resources (NR) Specialist, douglas.lyndeshultz1@navy.mil, 757-635-5436.

BASH

USFWS identified several breeding birds of conservation concern likely to occur on the project site.

It is illegal to possess, harm or take a migratory bird without regulatory permit authorizations (inclusive of animal, active nest, eggs, and/or parts there of). Nesting birds could be present on the project site and associated laydown area. Do not harm or remove active nests. Contact the below POC for further guidance and action if an active nest (nest with eggs or hatchlings present) is present on the project site.

Ensure to survey the work site for any birds and active bird nests (eggs or hatchlings inside). If active nests are found maintain a 25ft buffer around the nest and avoid working within that buffer until the birds have fledged the nest.

As of Mar 2024, there are no active eagle nests within 660ft of the project site. Eagles are known to nest in the area. The next survey is planned for late-Feb to mid-Mar 2025.

Revised 2/19/2020 Page 9 of 12Environmental Checklist

Eagles begin nesting in the late fall/early winter timeframe, check back with the below POC annually for updates regarding eagle nest locations and associated requirements if a nest is confirmed within 660ft of the project area.

If an eagle nest were to be located within 660ft of this project site, consultations/permits/mitigation/monitoring may be warranted and outdoor work limited as specified in the associated permit.

Osprey nests may occur on site. Osprey are protected, do not mess with nests. Recommend that if a nest is present on site (e.g., on light, power pole, tower, etc.) a minimum 8ft buffer from the edge of the nest be established on the ground to establish a worker safety buffer from potential falling nest debris and bird excrement.

STEP 3: NEPA PROGRAM MANAGER RECOMMENDATION

STEP 4: COMMANDING OFFICER OR DELEGATED PUBLIC WORKS OFFICER DETERMINATION OF CATEGORICAL EXCLUSION (CATEX) APPLICABILITY AND RECORD OF CATEGORICAL EXCLUSION (RCE)

I have previously reviewed the 27 August 2012 CNRMA Guidance for Implementing Categorical Exclusions Under the National Environmental Policy Act and the information within the attached Environmental Checklist supporting the use of this RCE. I find that the CATEX(s) identified below are applicable for the proposed project or activity and that even the presence of one or more of the extraordinary circumstances found in the Navy’s NEPA Implementing Regulation, 32 CFR 775, would not result in environmentally significant impacts that would preclude the use of the identified CATEX(s). I acknowledge that, should the scope or applicable environmental laws or regulations that would affect the subject project or activity change, this RCE will no longer be valid and that a new Environmental Checklist shall be submitted for compliance with NEPA. I will ensure that this signed RCE will be retained locally for six years and that a copy will be forwarded to the installation NEPA Program Manager, COMNAVREG MIDLANT Environmental Planning Office, and NRMA office of General Counsel.

SPILLS: Report all spills to the Regional Dispatch Center (RDC) immediately at 757-433-9111; and notify EV of any spill that enters the stormwater or sanitary system, as these events require notification to the regulator within 24 hrs of discovery.

POC Tara Fisher, (757) 433-3443, tara.g.fisher2.civ@us.navy.mil

Comments: Refrigerant related work must be performed by EPA certified technicians, using recycling/recovery equipment that meets EPA standards, and performed per EPA regulations governing Ozone Depleting Substances (40 CFR 82). Report new or replacement AC&R equipment to the FMS and the Environmental Air Manager. Include equipment type, manufacturer, model number, serial number, refrigerant type, tons cooling capacity, and normal pounds refrigerant charge. Include pounds normal charge per circuit if unit consists of multiple independent circuits.

The Installation Asbestos Program Manager (APM) is responsible for providing asbestos NESHAP Air Quality regulatory requirements, for example: structures must be inspected for suspected presence of asbestos containing material (ACM) prior to renovation or demolition, regardless of the age of the building; asbestos notifications are required at least 10 working days prior to demolition, even if there is no asbestos present in the structure.

NASO operations, per Title V permit requirements, shall use, where possible, of water or chemicals for control of dust in the demolition of existing buildings or structures, construction operations, the grading of roads, or the clearing of land; Application of asphalt, water, or suitable chemicals on dirt roads, materials stockpiles, and other surfaces which may create airborne dust.

Control emissions by keeping all paint, solvent, and/or waste containers closed/secured except when adding or removing material or waste. Air drying of paint cans is only allowed when all liquid possible has been removed and less than 1 inch residue remains. Control emissions during spraying operations by using containment such as shrouds or tarps.

POC: Cole Martin, (757)433-3438, cole.e.martin4.civ@us.navy.mil

Comments: SW: The proposed project will have no impact on industrial stormwater discharges from the site (interior renovations). Ensure all appropriate BMPs are implemented before, during and after construction, to prevent pollutants from entering the stormwater system (ie. sediment, fuel, fluids from equipment, paint, solvents, construction debris, trash, concrete waste, other). Report all spills to the RDC at (757) 433-9111; and notify EV immediately of any spill that enters the storm system, as these events require notification to the regulatory authority within 24 hours of discovery.

POC Tara Fisher, (757) 433-3443, tara.g.fisher2.civ@us.navy.mil

WW. As written, no impact to wastewater program. In the event that wastewater is generated as part of this project, please note that Any release of wastewater from the site (ex-powerwashing water) to either the storm drain or sanitary sewer must be coordinated with and approved by the Water Program Manager. Best Managements Practice implementation or collection of the water may be required.

POC: Dawn Friedrichs (757)433-3434

Comments: Follow up information indicates no renovations in bathrooms or locations containing potable water. With this information, no impact to drinking water program.

POC: Dawn Friedrichs (757)433-3434

Comments: The proposed project does NOT involve land disturbance; therefore, a construction general permit, Erosion & Sediment Control Plan and Stormwater Pollution Prevention Plan are NOT required. The project operator(s) must always utilize best management practices to ensure materials (sediment, construction debris, fuel, oil, mechanical fluids, paints, solvents, trash, other) associated with this activity DO NOT have the potential of becoming a pollutant in stormwater runoff.

No discharges to the sanitary sewer system, storm system or surface waters are permitted without prior coordination with and approval from the Water Program Manager. Report all spills to the RDC at (757) 433-9111; and notify EV immediately of any spill that enters the storm system or sanitary sewer system, as these events require notifications to the regulatory authorities within 24 hours of discovery.

If any painting occurs, painting procedures must be followed in accordance with the attached Surface Prep and Painting SOP.

POC Tara Fisher, (757) 433-3443, tara.g.fisher2.civ@us.navy.mil

Comments: Project as described does not propose to impact wetlands.
