About this file

This document is an attachment containing required affidavits for bidders, offerors, and contractors seeking to do business with the Commonwealth of Kentucky. The file includes three separate affidavit forms that must be completed, notarized, and submitted as part of the bidding process. The first affidavit pertains to campaign finance compliance and requires an authorized representative to attest under penalty of perjury that the contractor has not knowingly violated Kentucky campaign finance laws and that contract award will not violate such laws. The second affidavit addresses resident bidder status claims and requires entities to verify they are authorized to transact business in Kentucky, have filed corporate income taxes for at least one year prior to bid submission, have made payments to the Kentucky unemployment insurance fund, and have maintained an active workers' compensation policy. The third affidavit concerns qualified bidder status for nonprofit organizations, particularly those furthering purposes under KRS Chapter 163 or employing individuals with severe disabilities, requiring attestation that the organization meets specific employment and operational standards set forth in 200 KAR 5:410(3).

All affidavits are effective for one year from the date of execution and must be notarized before a notary public. The Commonwealth retains the right to request updated affidavits at any time and may request supporting documentation to verify claims of resident bidder or qualified bidder status. Failure to provide requested documentation upon demand will result in bidder disqualification or contract termination. These affidavits are mandatory requirements pursuant to KRS 45A.110 and 45A.115 for any entity seeking contract award or contract renewal with the Commonwealth of Kentucky.
