About this file
This document is a Required Affidavit template for Bidders, Offerors, and Contractors seeking to do business with the Commonwealth of Kentucky, effective for one year from the date of execution pursuant to KRS 45A.110 and 45A.115. The affidavit requires an authorized representative of the contracting party to complete the attestation, obtain notarization, and submit it to the Commonwealth. Bidders must affirm under penalty of perjury that the contractor has not knowingly violated campaign finance laws of Kentucky and that contract award will not violate any provision of the state's campaign finance laws. The Commonwealth retains the right to request an updated affidavit at any time during the contract period.
The document includes three distinct affidavit options: a general campaign finance compliance affidavit, a Resident Bidder Status affidavit, and a Qualified Bidder Status affidavit. The Resident Bidder Status affidavit requires bidders to demonstrate that, on the date of contract advertisement, the entity is authorized to transact business in Kentucky and has maintained compliance with state requirements for one year prior, including filing Kentucky corporate income taxes, making payments to the Kentucky unemployment insurance fund, and maintaining an active workers' compensation policy. The Qualified Bidder Status affidavit applies to nonprofit corporations that further KRS Chapter 163 purposes or qualified nonprofit agencies serving individuals with severe disabilities, which must employ such individuals for at least seventy-five percent of direct labor hours and maintain good standing with the Secretary of State. The bidding agency may request documentation supporting any claim of resident or qualified bidder status, and failure to provide such documentation upon request may result in bidder disqualification or contract termination.
