About this file
This document is an Annual Affidavit required by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state and local contract opportunities. The affidavit establishes compliance requirements across multiple statutory provisions and must be executed under penalty of perjury by duly authorized representatives of bidding entities. The affidavit serves as a binding declaration of the bidder's eligibility and good standing with the state, with an effective period of one year maximum. All bidders and offerors must affirm compliance with Kentucky's campaign finance laws, disclosure requirements under KRS 45A.485, sales and use tax registration requirements, state tax payment obligations, and boycott prohibitions under KRS 45A.607. Additionally, bidders must declare non-violation of ethics statutes (KRS 11A.236) during the previous ten years and confirm they have not procured contracts while employing convicted executive agency lobbyists within five years of conviction.
For non-bid contracts designated as sole-source, not practical or feasible to bid, or emergency contracts, enhanced affidavit requirements apply. These provisions require contractors to attest that neither they nor immediate family members with 10 percent or greater business interest have contributed beyond statutory limits to gubernatorial campaign slates, that officers, employees, and affiliated entities have not contributed more than $5,000 in aggregate to elected candidates with jurisdiction over the contract award, and that no direct solicitation of contributions exceeding $30,000 in aggregate has occurred for such campaigns. Optional affidavits address resident bidder status, which requires authorization to conduct business in Kentucky and one year of prior tax filing, unemployment insurance fund payments, and workers' compensation policy maintenance. Qualified bidder status affidavits apply to nonprofit corporations furthering KRS Chapter 163 purposes and qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor hours. Bidders claiming resident or qualified bidder status must provide supporting documentation upon agency request or face disqualification or contract termination.
