About this file

This is an Annual Affidavit document for the Commonwealth of Kentucky used by bidders, offerors, and contractors participating in state and local contract opportunities. The affidavit serves as a required compliance and certification document with a maximum effective period of one year. Bidders and contractors must affirm under penalty of perjury their compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), disclosure requirements, sales and use tax registration with the Kentucky Department of Revenue, and state tax payment obligations. Additionally, bidders must certify that neither they nor their subcontractors have violated prohibitions outlined in KRS 11A.236 during the previous ten years and pledge continued compliance throughout the contract term.

For non-bid contracts—such as sole-source, non-practical-to-bid, or emergency contracts—additional affidavit requirements apply regarding campaign contributions to gubernatorial candidates and elected officials with jurisdiction over the contract award. Bidders may also claim resident bidder status or qualified bidder status (nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities employing such individuals for at least seventy-five percent of direct labor hours). The affidavit must be notarized and signed by a duly authorized representative. The Commonwealth of Kentucky retains the right to request updated affidavits at any time and to request documentation supporting claims of resident or qualified bidder status, with failure to provide such documentation resulting in bidder disqualification or contract termination.
