About this file
This is an Indian Economic Enterprise Representation Form required by the Indian Health Service (IHS), Department of Health & Human Services, for the Fort Thompson Duplex Construction project (Solicitation #75H70125R00076).
The form serves as a self-certification document for offerors to declare whether they meet the definition of an "Indian Economic Enterprise" (IEE) under the Buy Indian Act (25 U.S.C. 47) and HHSAR 326.601. Offerors must maintain IEE eligibility at three critical junctures: at the time of offer submission, at contract award, and throughout the full contract performance period. Failure to maintain eligibility requires immediate written notification to the Contracting Officer. The form requires certification from the 51% owner of the IEE firm, along with documentation of the federally recognized tribal entity affiliation, business name, and DUNS number. False or misleading information submitted in offers is punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also register with the System of Award Management (SAM), and Contracting Officers may require eligibility documentation before awarding set-aside or sole source contracts, which may be subject to protest.
