This award DD254 is the original, issued on the date indicated in Item 3a. Delayed issuance is an administrative oversight – the Contractor has had access to the solicitation
DD254.
All provisions of 32 CFR Part 117, National Industrial Security Program Operating Manual (NISPOM) apply. Effective date is 24 Feb 2021.
REQUIRED CLEARANCE LEVEL
All procedures for contractor access to classified National Security Information (NSI) are in Chapter 10 of the DOJ Security Program Operating Manual (SPOM), which discusses contractor contracts, contractor visits, and Department procedures. To complete the necessary paperwork, the following will be required:
1) A copy of the Contract; Statement of Work (SOW); Task Order, plus a copy of the Purchase Order. At a minimum, for security purposes, the Contract/SOW/Task Order must contain language to the effect that the contractor requires access to classified NSI at a specific level and agrees to comply with the National Industrial Security Program Operating Manual (NISPOM).
2) Approximate number of clearances: SCI 4 TOP SECRET 4 SECRET 2 CONFIDENTIAL 32
PREVIOUS EDITION IS OBSOLETE. Page 3 of 4DD FORM 254, APR 2018
If SCI access is required, which accredited SCIF will the contractor use: EOUSA SCIF or USAO SCIF
3) Prime Contract Number or Delivery/Task Order:
Activity Address Code (AAC): 6 alphanumeric digit
Is this a Bridge/Follow-On Contract? If yes, please list the preceding contract #:
4) Length of the contract, starting date and ending date, whether it is extendable (option years)
5) Complete and accurate “official” name and address of the contractor, this would be the home office location and branch office location (if any). If a branch office does not require possession of classified material for contract performance, DSS will process clearances through the home office location. This is important for our research with the DSS. Providing other than the “official” company name may cause delays with DSS.
6) A "Commercial and Government Entity (CAGE) Code." Having a CAGE code does not guarantee that the contractor will have a facility clearance. If the contractor does not have a CAGE code or a facility clearance, provide a senior level point-of-contact, including name, title, email address and phone number that our office can include in a sponsorship letter to the DSS so that their representative can make contact and begin the facility clearance process.
7) Location(s) where the work will be performed, i.e. DOJ facilities.
Executive office for US Attorneys Security and Emergency Management Staff Executive Office for U.S. Attorneys 175 N Street, NE Suite 2.900 Washington DC 20530
8) A general description as to why the contractor needs access to classified information and the service the contractor will provide. This should be precise, for example, “The contractor will provide technical and operational support for a classified Information Technology system for (name of component)”.
The contractor will provide technical and operational support for a classified space and system for EOUSA and USAO community.
9) Contracts/SOWs/Task Orders involving IT systems will need a statement regarding foreign nationals. 2640.2E states that “Non-US citizens shall not be authorized to access or assist in the development, operation, management or maintenance of Department IT systems, unless a waiver has been granted by the Head of the Component, with the concurrence of the DSO and the CIO.”
US citizenship will be required for all contractors supporting this contract.
10) We will complete the Form DD 254 at the Office of Information Safeguards and Security Oversight and forward it to DSS with a copy to your component for you to provide to the contractor.
11) Personnel security clearances for individual contractors are handled between DSS and the contractor's facility security officer.
After this basic information is received, other concerns and requirements can be addressed.
