About this file
This document provides a justification for other than full and open competition for a federal contract. The U.S. Coast Guard Surface Forces Logistics Center seeks to procure technical representative services from the original equipment manufacturer Wartsila for work items involving propulsion shaft seals during the mechanical overhaul of the USCGC Mobile Bay. The justification cites FAR 6.302-1 for awarding to a sole source, stating that as the OEM, only Wartsila possesses the proprietary design specifications and testing procedures necessary to ensure work is performed according to standards. The Coast Guard conducted market research but determined that without access to Wartsila's confidential information, full and open competition was not feasible for this requirement.

WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY
THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.
STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE
REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE.
Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR
MARKET RESEARCH EFFORTS HERE).
Work Item will be solicited for competition in MOBILE BAY DD FY23 availability specification package
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE
SUPPLIES OR SERVICES.
OEM is the only known source of the required technical representative services to ensure compliance for work being performed on the project Work Items. The absence of an OEM technical representative on-site could cause significant damage to equipment if installed/programmed incorrectly. The manufacturing drawing and specifications are proprietary to OEM and have not been purchased by the Coast Guard.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE
TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT
AVAILABLE.
OEM is the only known vendor that has the techniques, design specifications, testing, quality assurance capability, and documentation necessary to provide these technical representative services on the work items.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE
REQUIRED.
USCG will continue to conduct market research; however, without proprietary technical information described above, obtaining full and open competition is not realistic. The Coast Guard cannot require any vendor to release proprietary information
