About this file

This file is a FAR 52.204-24 representation and certification form attachment requiring offerors to disclose their use of covered telecommunications equipment or services in response to Solicitation No. 140P8326Q0044 for the LARO Patrol Boat Re-Power opportunity issued by the Department of the Interior National Park Service Pacific West Region.

The provision implements Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, prohibiting federal agencies from procuring equipment, systems, or services that use covered telecommunications equipment or services as substantial or essential components or critical technology. Offerors must make two representations: (1) whether they will provide covered telecommunications equipment or services to the government in contract performance, and (2) whether, after reasonable inquiry, they use covered telecommunications equipment or services in their operations. If responding affirmatively to either representation, offerors must provide detailed disclosures including the producing entity information (name, unique entity identifier, CAGE code, OEM or distributor status), complete equipment descriptions (brand, model number, item description), and explanation of proposed use with factors relevant to determining permissibility under the prohibition. The form excludes offerors who have already certified in SAM or other representations that they do not provide or use such covered telecommunications equipment or services. Quoters must complete and submit this provision unless prior certifications in FAR 52.204-26 or 52.212-3 already address these representations.
