52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)

Evaluation Criteria

The Government will utilize lowest price technically acceptable (LPTA) procedures. The Government will award a contract resulting from this solicitation to the responsible offeror conforming to the solicitation that will be most advantageous to the Government, price and other factors considered. The price is more important than technical. The Government will first establish a competitive range based on price and then evaluate the lowest offer within that range for technical acceptability. If the lowest offer is not technically acceptable, the Government will proceed to evaluate the next lowest offer, and so on, until a technically acceptable offer is identified.

The following three factors shall be used to evaluate offerors:

Factor 1: Price

An offeror’s Total Evaluated Price (TEP) will be determined by multiplying the quantities identified by the proposed unit price for each Contract Line Item Number (CLIN) to confirm the extended amount for each. The Government will first conduct a review of the overall quoted pricing and place the offerors in order from lowest to highest based on price. The government will conduct both price reasonableness and price realism to establish a competitive range. Generally, adequate price competition will satisfy the criteria of price reasonableness;

other methods include, but are not limited to, historical prices paid and comparison to the Independent Government Cost Estimate. In addition, the Government will conduct a price realism analysis to ensure that the proposed price is realistic for the work to be performed, reflects a clear understanding of the requirements, and is consistent with the offeror's technical proposal.

This analysis will include one of the following:

• Comparative Analysis: Comparing proposed prices with the Government estimate, historical prices, or prices submitted by other offerors.

• Commercial Price Lists or Industry Catalogs: Using commercial price lists or industry catalogs to verify that proposed prices are in line with industry standards for similar goods or services.

Factor 2: Technical

Technical proposals shall include the Offeror’s revised Statement of Work (SOW), completed Attachment 3, Minimum Specifications Worksheet, and an itemized quote that will be evaluated using Attachment 1, Statement of Objectives. Each quote will receive an acceptable or unacceptable rating indicating whether the quote is technically acceptable.

Technical Acceptable / Unacceptable Ratings Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

At a minimum, the quote must meet all specifications as listed in Attachment 3, Minimum Specifications Worksheet and Attachment 1, Statement of Objectives.
