Security requirements include limited access to classified information only at government facilities, with no removal of classified materials from work sites. Contractor employees are prohibited from storing, generating, or reproducing classified information at non-government locations. The contractor must submit Visitor Access Requests (VARs) via the Defense Information System for Security (DISS) Web Application to verify need-to-know authorization. CUI information must be marked, stored in out-of-sight locations during work hours and locked receptacles after hours, and shredded upon disposition. The Contracting Officer at MICC-Fort Eisenhower (W91249) is the primary point of contact for public release approvals and interpretation of security guidance. The Cognizant Security Office is located at the U.S. Army Cyber Center of Excellence, 506 Chamberlain Avenue, Fort Eisenhower, GA 30905.

and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

(Fill in as appropriate for the classified effort. Attach, or forward under separate correspondence, any documents/guides/extracts referenced herein. The field will expand as text is added. Ref 10e(1): SCI Access SCI Access required. No public release of information authorized, public disclosure or confirmation of any subject related to the support contract is not authorized without first obtaining written approval from the KO.

Ref 10e(2): Non-SCI Information is not releasable to contractor employees who have not received a clearance at the appropriate security level. Written concurrence of the KO is required prior to subcontracting. Access to Intelligence information required for performance.

Ref 10j: CONTROLLED UNCLASSIFIED INFORMATION (CUI) information generated and/or provided under this contract shall be safeguarded and marked as specified in DoDM 5200.01 (VOL 4), AR 380-5 or AR 25-55.

1. GENERAL.

a. The Controlled Unclassified Information (CUI) marking is assigned to information at the time of its creation in a DoD User Agency. It is not authorized as a substitute for a security classification marking but is used on official government information that may be withheld from the public under exemptions 2 through 9 of the Freedom of Information Act (FOIA).

PREVIOUS EDITION IS OBSOLETE. Page 3 of 5DD FORM 254, APR 2018

b. Other non-security markings, such as "Limited Official Use" and "Official Use Only" are used by non-DoD User Agencies for the same type of information and should be safeguarded and handled in accordance with instruction received from such agencies.

c. Use of the above markings does not mean that the information cannot be released to the public under FOIA, only that the Government must review the information prior to its release to determine whether a significant and legitimate government purpose is served by withholding the information or portions thereof.

2. MARKINGS:

a. An unclassified document containing CUI information will be marked with the proper classification at the bottom of the front cover (if any), on the first page, on each page containing CUI information, on the back page, and on the outside of the back cover (if any).

b. Within a classified document, an individual page that contains both CUI and classified information will be marked at the top and bottom with the highest security classification of information appearing on the page. If an individual portion contains CUI information but no classified information, the portion will be marked, "CUI."

c. Any CUI information released to a contractor by a DoD User Agency is required to be marked with the following statement prior to transfer. “This document contains information EXEMPT FROM MANDATORY DISCLOSURE UNDER THE FOIA. Exemptions apply.”

d. Removal of the CUI marking can only be accomplished by the originator or other competent authority. When the CUI status is terminated, all known holders will be notified to the extent practical.

3. DISSEMINATION: Contractors may disseminate CUI information to their employees and subcontractors who have a need for the information in connection with a classified contract. Contractors must ensure employees and subcontractors are aware of the special handling instructions detailed below.

4. STORAGE: During working hours, Controlled Unclassified Information (CUI) information shall be placed in an out-of-sight location if the work area is accessible to persons who do not have a need for the information. During nonworking hours, the information shall be stored to preclude unauthorized access. Filing such material with other unclassified records in unlocked files or desks, is adequate when internal building security is provided during nonworking hours. When such internal security control is not exercised, locked buildings or rooms will provide adequate after- hours protection or the material can be stored in locked receptacles such as file cabinets, desks, or bookcases.

5. TRANSMISSION: CUI information may be sent via first-class mail or parcel post. Bulky shipments may be sent by fourth-class mail.

DoD components, officials of DoD components, and authorized DoD contractors, consultants, and grantees send CUI information to each other to conduct official DoD business. Tell recipients the status of such information and send the material in a way that prevents unauthorized public disclosure. Make sure documents that transmit CUI material call attention to any CUI attachments. Normally, you may send CUI records over facsimile equipment. To prevent unauthorized disclosure, consider attaching special cover sheets, the location of sending and receiving machines, and whether authorized personnel are around to receive CUI information. CUI information may be passed to officials in other departments and agencies of the executive and judicial branches to fulfill a government function. Mark the records CUI and tell the recipient the information is exempt from public disclosure under the FOIA and requires special handling.

6. DISPOSITION: When no longer needed, CUI information must be shredded.

7. UNAUTHORIZED DISCLOSURE: Unauthorized disclosure of CUI information does not constitute a security violation, but the releasing agency should be informed of any unauthorized disclosure. The unauthorized disclosure of CUI information protected by the Privacy Act may result in criminal sanctions and disciplinary action may be taken against those responsible.

Ref 11.a: Have Access to classified Information only at another Contractor’s Facility or a Government Activity

1. Contractor access to classified information shall be limited to that which is necessary to support this work effort. Contractor performance is restricted to Fort Eisenhower GA. The Government User Agency will provide security classification guidance for performance of this contract. The contractor will comply with the provisions of DOD 5220.22-M, DOD Manual 5200.01 (Vol 4), AR 380-5, and all applicable regulations and local policies and procedures governing the control, protection, and safeguarding of classified and sensitive (CUI) material.

2. The contractor shall provide a Visitor Access Request (VAR) via the Defense information System for Security (DISS) Web Application to the Cyber Center of Excellence (W6ZRAA5) for all contractors on contract to verify need to know. All contractors shall be added to the VAR prior to their start date and be removed on their working day on the contract.

3. The contractor shall not remove classified materials or information from the government work sites, nor shall the contractor use, reproduce, generate, or store any classified materials or information relating to this contract at other than specified government work

PREVIOUS EDITION IS OBSOLETE. Page 4 of 5DD FORM 254, APR 2018 locations.

All contractor employees shall maintain the required security clearance throughout the life of the task order. Failure, inability, or delay in obtaining the appropriate clearance shall not relieve the contractor from performance under the terms of this task order. Additionally, all contractor personnel are required to in-process the CCoE G2 within 10 business days.

6. The investigative basis for personnel security clearances should be IAW existing DoD policy. Eligibility based on investigations that are out of date, i.e. Top Secret (5 years) must submit a Form Update investigation request via NBIS within 10 days of being assigned to the contract.

7. Any adverse action preventing a contractor from retaining access to classified material must be brought to the attention of the COR, CCoE G2, and contractor FSO immediately.

8. The contractor Facility Security Officer (FSO) will ensure there is a procedure for all contractor employees to in-process and out-process the Cyber Center of Excellence, G2 at Winship Hall. All contractors shall turn their Common Access Card (CAC) into the COR on their last day of employment.

11l: Receive, Store, or Generate Controlled Unclassified Information (CUI) General: In addition to classified information, certain types of unclassified information also require application of access and distribution controls and protective measures for a variety of reasons. In accordance with Reference (e) DoDM 5200.01 V1, such information is referred to collectively as CUI. DISCLOSURE OF INFORMATION (a) The Contractor shall not release to anyone outside the Contractor's organization any unclassified information, regardless of medium (e.g., film, tape, document), pertaining to any part of this contract or any program related to this contract, unless(1) The Contracting Officer has given prior written approval; (2) The information is otherwise in the public domain before the date of release;

(b) Requests for approval under paragraph (a)(1) shall identify the specific information to be released, the medium to be used, and the purpose for the release. The Contractor shall submit its request to the contracting Officer at least 10 business days before the proposed date for release. (c) The Contractor agrees to include a similar requirement, including this paragraph (c), in each subcontract under this contract. Subcontractors shall submit requests for authorization to release through the prime contractor to the Contracting Officer

The guidance in this DD 254 is also applicable to subcontractors who require a security clearance or access to classified information (no higher than Secret).

It is not authorized as a substitute for a security classification marking but is used on official government information that may be withheld from the public under exemptions 2 through 9 of the Freedom of Information Act (FOIA).
