DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval

For Other Than Full and Open Competition

1. Contracting Activity:

Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC)

The proposed procurement is for the EHRM Infrastructure Upgrades project at the Pine Ridge VA Medical Center (VAMC).

2. Nature and/or Description of the Action Being Processed:

This justification is to support the EHRM Infrastructure Upgrades project at the Pine Ridge VAMC, that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials. The use of a particular brand name for the items listed below accommodates standardization of these items throughout the facility.

a. Acoustic ceiling tiles that may get damaged:

i. Armstrong, 915 2x4 grid

b. Fire panel and testing before and after moving:

i. https://knightsecurityinc.com/

c. Building physical security system:

i. ADT: Integrate TR room door and cabinet into the security system.

d. Remote building monitoring system (HVAC remote monitoring):

i. Checkpoint/Viewpoint

e. Uninterrupted power supply communications with OIT/email system:

i. APC, SRT3000XLA

f. Computer Cabinet:

i. F-Series TeraFrame Gen 3 Cabinet System with accessories

g. Door Hardware (in the unlikely event existing door hardware cannot be reused):

i. Corbin Russwin or LSDA (BEST Core compatible), CL-33 x NZD x 626 x M08, qty 35

h. Infection Control:

i. HEPACART 55 Crew Capacity (1+) and Supporting Accessories

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

This procurement is for the EHRM Infrastructure Upgrades project at the Pine Ridge VAMC. The scope includes everything necessary to construct the EHRM Infrastructure Upgrades that meets the requirements of the Department of Veterans Affairs. There are eight (8) brand name items listed for which the VA is not able to accept equal or alternate items. The value of these items is listed below and the VAAR Construction magnitude for the entire project is between $500,000 and $1,000,000.

a. Acoustic ceiling tiles that may get damaged:

i. Armstrong, 915 2x4 grid

ii. Value:

iii. Description/Impact: This tile is currently used at both campuses. Note each room or area must match.

b. Fire panel and testing before and after moving:

i. https://knightsecurityinc.com/

ii. Value:

iii. Description: Fire safety equipment is currently supported/contracted by knight security. There is a concern if another vendor were to modify the fire panel system, it would impact our current service agreement. The VA fire department is trained on the operation of this system.

c. Building physical security system:

i. ADT: Integrate TR room door and cabinet into the security system.

ii. Value:

iii. Description/Impact: This security system is currently used at this site in support of

VA physical security requirements. There is concern if another vendor were to modify the security system, it would impact our current service agreement with ADT for maintaining this system.

d. Remote building monitoring system (HVAC remote monitoring):

i. Checkpoint/Viewpoint

ii. Thermocouple Probe, 19000B11, qty 8

iii. Temp/humidity, 17000F0F, qty 1

iv. Water detector, 136, qty 1

v. Wireless access, 105, qty 1

vi. Total Extended Value:

vii. Description/Impact: Checkpoint is currently supported/contracted by both campuses to support history review and remote notification. There is concern if another vendor were to extend/expand the Checkpoint/Viewpoint System it would impact our current service agreement. Staff are currently trained on how to support with existing standard operating procedures (SOPs).

e. Uninterrupted power supply communications with OIT/email system:

i. APC, SRT3000XLA

ii. Value:

iii. Description/Impact: APC manufacturer is known to communicate status across

VA campus network and has passed all OIT security requirements. Staff are currently trained on how to support, standard operating procedures (SOP’s) are established, and email status distribution lists have been setup for the solution.

f. Computer Cabinet:

i. F-Series TeraFrame Gen 3 Cabinet System with accessories

ii. Value:

iii. Description/Impact: Fulfills several security requirements due to a non-standard

Telecommunications Room (high access) that will communicate with the ADT security system. It is “highly recommended” by national EHRM technical team to allow the facility to maintain congressional requirements.

g. Door Hardware (in the unlikely event existing door hardware cannot be reused):

i. Corbin Russwin or LSDA (BEST Core compatible), CL-33 x NZD x 626 x M08, qty 35

ii. Value: (Zero) or if needed

iii. Description/Impact: This door hardware key system is currently supported by the parent campus. A multitude of key number schemes for each department are based on the existing system. This is being provided in the scenario a plan “B” option is needed.

h. Infection Control:

i. HEPACART 55 Crew Capacity (1+) and Supporting Accessories (a-g)

a. HEPACART – Multiple Tile Adapter (Fits HALO)

b. HEPACART – Adjustable Ladder Extension Module

c. HEPACART – Wall Access Enclosure with Vision Panels HC55U Series

d. HEPACART – Vinyl/Dust Top Cover HC55U Series

e. HEPACART – Replacement Pre-Filters

f. HEPACART – Clean Mat

g. HEPACART – Cleaning Kit

ii. Value:

iii. Description/Impact: Contractor to use during the project and our facility is in need on a HEPA cart to maintain ICRA/PCRA requirements for patient and employee safety on this and future projects. This will become the property of the VA once the project is complete. The size will work with our smaller elevators.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

These items have been standardized throughout the Pine Ridge VAMC. Installing a different manufacturers’ system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:

a. Acoustic ceiling tiles that may get damaged:

i. Armstrong, 915 2x4 grid

ii. Description/Impact: This tile is currently used at both campuses. Note each room or area must match.

b. Fire panel and testing before and after moving:

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.

7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable:

Government estimate was prepared and provided by the Contracting Officer’s Representative (COR). The anticipated price to the Government for the items requested to be brand name is approximately .

The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

The market research for the equipment was conducted and prepared by the COR and shared with the CO for further review. The CO was in concurrence with information provided in the estimate that supported the brand name items. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the Pine Ridge VAMC, as a whole.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

New components must be able to tie into an existing and operational system including the use of software. At this time, there are no competing vendors whose products are fully compatible with the existing system being used at the Pine Ridge VAMC.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required:

There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
