About this file

This document contains a justification for a sole-source brand name contract award and a related federal contract opportunity solicitation. The justification document details that the 171st Air Refueling Wing requires Federal Signal Corporation equipment including remote terminal units, radios, antennas, and surge suppressors totaling approximately $400,000 to interface their existing wide-area mass notification system with a new building fire alarm and mass notification system. The justification cites only one responsible source being able to meet the requirement due to the need for compatibility with the existing proprietary system. The related solicitation provides an opportunity for construction services including installation of the new fire alarm control and monitoring systems with a magnitude between $1-5 million, 548 calendar day period of performance, pre-bid conference on June 17th, and bid opening on July 6th.

FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity:

Pennsylvania United States Property and Fiscal Office (PA USPFO) Fort Indiantown Gap, Annville, PA 17038.

2. Description of Action:

The 171st Air Refueling Wing (ARW) has an existing Wide-Area Mass Notification (WAMNS) Giant Voice system manufactured by Federal Signal Corporation. Under the Repair Base Wide Fire Alarm System construction project, the 171 ARW will be installing Monaco fire alarm control panels and a Monaco central receiving system that will integrate with the installation’s existing WAMNS. Interfacing the existing WAMNS to the new building fire alarm mass notification systems (FA/MNS) will require installation of twenty (20) new Federal Signal Remote Terminal Units (RTUs), one for each FA/MNS control unit). Federal Signal Corporation (FSC) equipment is required. The Government project award for 2022 and fiscal year 2022, SRM funds will be used. The Chief of the Contracting Office (CoCO) approved an acquisition plan In Accordance With (IAW) DFARS 207.103(d)(i)(B) on 6 Oct 2021.

3. Description of Supplies/Services:

The key FSC equipment shall include: 1) FSC Ultravoice Remote Terminal Units, 2) FSC/Motorola AFX4500 700/800 MHz radios, and 3) FSC/Laird Technologies omnidirectional antennas and surge suppressors. The bare equipment cost is estimated to be around $

4. Authority Cited:

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.

5. Reason for Authority Cited:

FSC is the manufacturer of the existing WAMNS for the 171 ARW. Interfacing the existing WAMNS to the new building, FA/MNS will require the installation of twenty (20) new FSC RTUs, radios, and omnidirectional antennas and surge suppressors. The specifications listed in ANG ETL 15-01-03 specifies standardization of components within the Air National Guard for Fire Detection/Mass Notification Systems.

As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

6. Efforts to Obtain Competition:

The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.

Version – June 2021 CUI

a. Effective Competition: Competition will be obtained for this project; however, the

Federal Signal Corporation RTUs, antennas, and radios will be solicited as brand name only due to the requirement to maintain compatibility with the existing WAMNS.

7. Actions to Increase Competition:

This project will be solicited as a small business set aside on SAM.gov. However, the FSC equipment will be limited to name brand.

8. Market Research:

Research was conducted in accordance with FAR part 10 to determine if there were commercial or modified commercial items that could adequately meet the Government’s needs. The FSC system equipment are unique, proprietary, and cannot be substituted or duplicated by other manufacturers. No substitute is acceptable.

Further investigations of various DoD facilities revealed that they installed Federal Signal Corp WAMNS specifying the brand name for their system without any response from the industry. Initial market research revealed that there are approximately four other companies in the marketplace who install giant voice systems. However, these companies: Acoustic Technology, Inc.; IMLCORP, LLC; Island Signal & Sound, Inc.; and Deep Blue Integration, Inc. do not have a license or other agreement with FSC to install or service their equipment/software and therefore are not viable contenders for the proposed contract.

9. Interested Sources:

Notices required by FAR 5.201 will be published with RFP, and any bids or proposals received shall be considered. Additionally, a pre-solicitation notice will be issued and any information received will be analyzed to determine the validity of this brand name justification.

10. Other Facts:

FSC is the only supplier capable of offering supplies required at the level of quality, expertise, and justified interoperability that will be integrated with the WAMNS system currently installed at the 171st Air Refueling Wing. Maintenance of the 171 ARW WAMNS system, supplies, technical support, and warranty services are all unique to FSC.
