FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity:

Pennsylvania United States Property and Fiscal Office (PA USPFO) Fort Indiantown Gap, Annville, PA 17038.

2. Description of Action:

The 171st Air Refueling Wing (ARW) requests fire control panels with Monaco Enterprises for the construction project entitled “Repair Base Wide Fire Alarm Systems”.

The Government projects award for 2022 and fiscal year 2022, MILCON funds will be used. The Chief of the Contracting Office (CoCO) approved an acquisition plan In Accordance With (IAW) DFARS 207.103(d)(i)(B) on 6 Oct 2021.

3. Description of Supplies/Services:

Monaco (MAAP-X) addressable fire control panels with mass notification, Monaco transceivers (BT-X series), and redundant Monaco D-21 central receiving systems. The bare equipment cost is estimated to be around $

4. Authority Cited:

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.

5. Reason for Authority Cited:

The specifications listed in ANG ETL 15-01-03 identifies the requirement of using 2-way radio based detection systems as the standard specified by the Air National Guard Civil Engineer for use in all ANG facilities and specifies standardization of components within the Air National Guard for Fire Detection/Mass Notification Systems.

ANG ETL 15-01-03, para 6.2 states, “The fire alarm system shall provide radio based, fiber optic or landline based, remote system reporting to the base central system, and a secondary central receiver. Provide radio based transmission systems for all new base-wide systems. Retrofit installations shall use system equipment that is listed by a nationally recognized testing laboratory, and is compatible with the existing equipment to include the central base transmitting and receiving system. All facility fire alarm systems must also transmit appropriate signals to the responding (host or other) fire department, which in most cases is the ANG fire station.”

Currently, the specifications that direct the use of this type of system as provided in ANG ETL 15-01-03 were developed around the technologies of the Monaco Enterprises systems and components. The use of other systems or components will not maintain the proper level of compatibility. Based upon ANG ETL 15-01-03, The ANG Civil Engineer has specified that facility designs shall reflect and implement coordination and implementation of standardized features. Specifically fire detection and reporting systems, which are located in multiple facilities, shall be of the same manufacturer to ensure compatibility, maintainability and operations.

Version – June 2021 CUI

In addition, the ANG Civil Engineer has established a maintenance, training and technical trouble shooting program at the Civil Engineer Technical Services Center specifically to support Monaco Enterprises Detection components and systems installed in ANG facilities nationwide. Therefore, in order to maintain the proper operational level of fire detection, Monaco Enterprises products, components and services are required.

Monaco Enterprises is the only manufacturer and known source to fulfill this requirement for the Fire Detection/Reporting, which meets all of the requirements as specified in ANG

ETL 15-01-03.

As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

6. Efforts to Obtain Competition:

The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.

a. Effective Competition: Competition will be obtained for this project; however, the

Monaco fire alarm control panels, transceivers, antennas, and central receiving systems will be solicited as brand name only due to the requirement to meet ANG

ETL 15-01-03.

7. Actions to Increase Competition:

This project will be solicited as a small business set aside on SAM.gov. However, the Monaco fire equipment will be limited to name brand.

8. Market Research:

Research was conducted in accordance with FAR part 10 to determine if there were commercial or modified commercial items that could adequately meet the Government’s needs. The Monaco system is unique and cannot be substituted or duplicated by other manufacturers. No substitute is acceptable.

Further investigations of various Air National Guard units, Air Force Bases, and DoD facilities revealed that they have upgraded their base-wide fire alarm system specifying the brand name Monaco for their system without any response from the industry.

9. Interested Sources:

To date, no other sources have written to express an interest. Notices required by FAR

5.201 will be published with RFP, and any bids or proposals received shall be considered. Additionally, a pre-solicitation notice will be issued and any information received will be analyzed to determine the validity of this brand name justification.

10. Other Facts:

CUI

Version – June 2021 CUI

The standardization of equipment 171st Air Refueling Wing and the Air National Guard is critical to avoid negative consequences or loss of life, government property or assets, and ensure the 171st Air Refueling Wing’s mission during training and real-world situations.

There is a procurement history of justification and approval (J&A) for other than full and open competition for Monaco systems. In 2008, Davis-Monthan AFB received a signed J&A to purchase Monaco alarm equipment for their aircraft hangar 1750, child development center 2614, and industrial work center 5309. In 2015, Eielson AFB had an existing Monaco D-21 supervising station and received a signed J&A to purchase Monaco BT-XF transceiver for the BOSS. Also in 2016, U.S. Army at West Point (solicitation number W912DS-16-S-0010) posted a notice of intent to purchase Monaco Fire Alarm system for all new construction and renovation projects at the USMA. In 2019, PEASE NH ANGB (Notice ID W912WJ19X0037) posted a notice of intent to purchase base-wide fire alarm system with mass notification capability Monaco fire alarm panels and Monaco Emergency Management supervising system. Lastly, in 2021 the 186th ARW posted a J&A for fire suppression system repairs to include an integrated fire alarm system for two aircraft hangar and aircraft maintenance administration facilities and the products requested were Monaco MAAP-X control panels and Monaco transceivers (BT-X series) compatible with the Monaco D-21 Emergency Management System.

At this time, no other vendor can support technical expertise or provide the fire detection/reporting and intrusion detection systems, components or the specialized accessories. In addition, the ANG Civil Engineer Technical Service Center does not provide technical support for any other 2-way radio based fire detection systems other than those installed with Monaco Enterprises components. The company has ventured beyond traditional military customers for business. In addition to pursuing international markets, Monaco Enterprises, Inc. 14820 East Sprague Avenue Spokane, Washington 99216-2191 is very active in commercial/consumer markets.
