4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is Title 41, U.S.C.
3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.” The Caliber and MicroAutomation brand names are peculiar to each manufacturer and are essential to the Government’s requirements in accordance with FAR 6.302-1(c).
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE
OF THE AUTHORITY CITED:
In accordance with FAR 6.302-1(c), software licenses and maintenance support the for brand names Caliber and MicroAutomation are essential to the Government's requirement because the supplies or services required by the agency are available from only these responsible sources, and no other type of supplies or services will satisfy the agency's requirements. A brand name, whether available on one or more contracts, is an item peculiar to one manufacturer and may be procured by brand name specification if essential to the Government's requirements. The Caliber and MicroAutomation brand name specifications are essential to the Government's requirements, thereby precluding consideration of products manufactured by another company. These specific software applications are the only ones that meet the customers’ requirements, DLA Cyber Security requirements and are approved for use on a DLA network. Approval and implementation of a different and new application could take up to a year or more.
DLA has a requirement to secure licensing required for the operation and sustainment of Police operations on DLA installations. Because the Police Center (POLC) application utilizes the Caliber and MicroAutomation products as its platform, DLA requires continued software maintenance and support for these software modules. The POLC application is supporting real world 911 and police functions for DLA installations and their users. Therefore, Caliber and MicroAutomation licensing, maintenance, and support are essential to the Government’s requirements and are the only products that will meet the Government’s needs.
During the market research the only applications that fit the needs for the DLA POLC system support were the Caliber and MicroAutomation software modules. No other viable options were submitted from a SAM.GOV RFI.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
The current action will be issued on an Unrestricted basis via “Open Market” procedures as a Request for Proposal (RFP) posted to SAM.gov in accordance with FAR 5.201(b). All responsible parties, including authorized Caliber and MicroAutomation resellers, will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
The Government will attempt to obtain offers from as many vendors as practicable. Proposals will be analyzed in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404- 1(b)(2)(i)); 2) comparison with competitive published price lists (reference FAR 15.404- 1(b)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (reference FAR 15.404- 1(b)(2)(vi)) in order to obtain a fair and reasonable price.
8. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR A
STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED:
Market Research was conducted by the Program Management Office (PMO) through direct inquiries to multiple small businesses who hold contracts within the SAM.GOV and by Strategic Vendor Management (J6TE) through NASA SEWP and GSA eBuy. Market Research was conducted with an extended Request for Information (RFI) posted between 10/16/2024 and 11/05/2024. It was determined through market research that the Original Equipment Manufacturer (OEM) and authorized resellers can provide the greatest discounts to the Government by soliciting this requirement via Open Market procedures. This requirement will be solicited on an Unrestricted basis.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

SUBSEQUENT ACQUISITION FOR SUPPLIES OR SERVICES:
DLA has an continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government as a continuing effort within DLA. DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition. The PMO is in the process or researching alternate solutions for this effort to reduce costs and find more comprehensive solutions. No other brand name sources have demonstrated the capability necessary to provide the required licenses and maintenance support at this time.
