About this file
This is a Contractor Non-Disclosure Agreement for employees of contractors providing support services to the Defense Logistics Agency (DLA) under the EVSE Maintenance contract (RFP SP4705-26-R-0004).
The agreement establishes mandatory confidentiality obligations for contractor employees who have access to nonpublic information. Recipients must restrict access to only information required for contract performance and must disclose their contractor status when accessing nonpublic information. Nonpublic information protected under this agreement includes Planning, Programming, Budgeting and Execution (PPBE) information, Controlled Unclassified Information (CUI), Source Selection Information, proprietary information, advance procurement information, trade secrets, confidential business information, attorney work product, Privacy Act-protected information, and other sensitive information exempt from Freedom of Information Act release. Recipients are prohibited from using or disclosing protected information for any purpose other than providing contract support services and must immediately notify the Contracting Officer's Representative in writing of any improper disclosure. All nonpublic information and transcriptions must be returned or destroyed upon contract termination. Violations subject recipients to administrative, civil, or criminal remedies as authorized by law. The agreement explicitly preserves existing statutory and Executive Order protections related to classified information, Congressional communications, Inspector General reporting, and whistleblower protections.
