Brand Name Justification Commercial items for procurements exceeding the Simplified Acquisition Threshold (> $250,000) pursuant to FAR Subpart 13.5, including Brand Name

Pursuant to the requirements under the authority for commercial items at 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903 Special emergency authority as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2.

1. Identification of the agency and the contracting activity.

The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Office of Chief Component Procurement Officer (OCCPO), Logistics, Distribution Centers West Branch

2. Nature and/or description of the action being approved.

FEMA intends to install double-deep and single deep racking at a FEMA warehouse facility located in Wahiawa, Hawaii using Commercial Test procedures without seeking competition for brand name TubeRack from Hannibal Industries, Inc. This action is being taken pursuant to FAR

13.501. Hannibal Industries, Inc is the only company that provides the type of tube rack required to support the agency needs with storing water for disaster preparedness.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The requirement is to provide turnkey rack system including all material, labor, delivery, engineering, and project management. The brand name justification is for the material portion, TubeRack from Hannibal Industries, Inc. The fixed-height, double deep and single deep racking shall be installed at a warehouse that will primarily be used for water storage. The ceiling area is slightly vaulted, and the sprinkler system is being upgraded. The warehouse portion of the location for racking totals 40,008 square feet for installation of approximately 3,386 pallet positions. Final racking position layout and pallet position shall be submitted by the contractor for FEMA’s approval. The project including on board destination has an estimated cost between $1 million to $2 million dollars.

4. This action is being taken under the authority of the Use of Noncompetitive Procedures, 41

U.S.C. 3304 (a)(5).

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

FEMA intends to procure a brand name specification for Hannibal TubeRack. Technical specifications must be brand specific. Hannibal TubeRack must be used because no other racking meets safety standards. The normal or common racking is roll form; Hannibal is a
