IV. Statutory authority permitting other than full and open competition.
The statutory authority permitting the other than full and open competition for this acquisition is 10 USC 2304(c)1), as implemented by FAR 6.302-1 and required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Johnson Controls - METASYS BAS is a propriety system providing an automated, computer-networked distributed control system to monitor the mechanical, security, flood, lighting, heating/air conditioning, and ventilation systems located within government facilities. Johnson Controls is the only company that can maintain their METASYS equipment and provide software support. The system is designed for use on the Air Force CE-COINE network using industry standard technology compatible with the owner provided network.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This acquisition requires a synopsis in accordance with FAR 5.201. A solicitation for the repair of the Data Center HVAC will be posted on the Government-wide point of entry.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The offerors' final proposed price to replace two (2) AHUs and Ducts will be evaluated against the criteria of reasonableness of the proposed total evaluated price. Assuming adequate competition, price will be evaluated for reasonableness in accordance with FAR 15.404-1(b)(2)(i).
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted in accordance with FAR part 10.
A search was conducted on the Small Business Administration (SBA) search website (http://dsbs.sba.gov). Results showed there are 122 profiles registered under NAICS 238220 "Plumbing, Heating, and Air-Conditioning Contractors", and filtered to profiles with locations in Mississippi. This industry comprises establishments primarily engaged in installing and servicing plumbing, heating, and air-conditioning equipment. The work performed may include new work, reconstruction, rehabilitation, and repairs. Search results by economic group are Service-Disabled Veteran (22), HUBZone Certified (12), SDB Certified (2), 8(a) Certified 16, Woman or Women Owned (36), and Veteran (34).
Historically, construction services for this type of requirement have been procured through source selection trade off process IAW FAR 15, with past performance being more important than price. By using Federal Business Opportunities (FBO) we increase the chance of a more competitive bidding process and allowing the government to get the best value. A previous acquisition for similar work using NAICS 238220 was set aside for HUBZone Small Business firms and received nine offers (FA301018C0015 Replace AHUs Brian Hall).
The government recommends that this requirement be set aside for HUBZone small businesses. A firm-fixed price contract is most appropriate for this requirement. The government has a reasonable expectation that two or more eligible and reasonable HUBZone small business firms are capable of submitting proposals to replace two (2) AHUs and Ducts at building 2901 on Keesler AFB.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
