About this file
This document contains two federal contracting regulatory provisions that establish eligibility requirements and representations for corporations bidding on government contracts.
The first provision, 52.209-11, prohibits the Government from entering into contracts with corporations that have unpaid assessed Federal tax liabilities that are not being paid pursuant to an agreement with the collecting authority, or that have been convicted of a felony under Federal law within the preceding 24 months, unless the awarding agency has considered and determined that suspension or debarment is unnecessary. Offerors must represent that they do not fall into either category. The second provision, 252.204-7016, applies specifically to defense contracts and requires offerors to represent whether they provide covered defense telecommunications equipment or services. Offerors must review the System for Award Management (SAM) at https://www.sam.gov to verify they are not listed as excluded parties for providing such equipment or services. Both provisions require affirmative representations by the offeror at the time of proposal submission to establish eligibility and compliance with applicable Federal regulations.
