SAMPLE TASK ORDER
PERFORMANCE WORK STATEMENT (PWS)
AQUEOUS FILM FORMING FOAM REPLACEMENT SUPPORT
NORTHWESTERN UNITED STATES
DEPARTMENT OF THE ARMY
8 September 2022
1.0 PERFORMANCE OBJECTIVE. The U.S. Army Engineering and Support Center, Huntsville (CEHNC) is planning an acquisition for the procurement of Aqueous Film Forming Foam (AFFF) Support Services. AFFF support includes the contractor removing, disposing, and replacing all foam containing perfluoroalkyl substances (PFAS) from the existing fire protection systems on Government installations. The National Defense Authorization Act (NDAA) for the Fiscal Year (FY) 2020 prohibits Department of Defense (DoD) use of AFFF by 1 October 2024 at all military installations. The objective of this project is to provide environmental support to facilitate transition of all fire protection systems at specified installations currently using AFFF to a fluorine-free fire-fighting agent meeting the requirements of the specification (MILSPEC) to be published by the Secretary of the Navy in accordance with Section 322 (a) of FY2020 NDAA, herein referred to as “Fluorine-Free Foam”. All project work shall be accomplished under the Aqueous Film Forming Foam Replacement Support Multiple Award Task Order Contract (MATOC).
2.0 INTRODUCTION.
2.1 Firefighting and suppression foams such as AFFF are used primarily to control fires involving flammable liquids such as oil and fuel. Such foams control fires by forming films which serve as barriers that effectively starve fires of oxygen. AFFF based systems are presently installed and utilized at DoD installations throughout the world. The key ingredients of AFFF are mixtures of hydrocarbon and fluorocarbon surfactants acting as surface active agents which are important in fire suppression effectiveness. Of these, perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) are family to a large group of perflouroalkyl substances (PFAS) that have come under increasingly greater environmental concern and scrutiny because of their toxicity to human and animal health, persistence in the environment, and their potential for bioaccumulation. The most common DoD activities that could potentially result in the release of PFAS to the environment is the use of PFOA or PFOS containing AFFF for testing, training, firefighting, and other life-saving emergency responses.
2.2 U.S. Regulatory Framework.
2.2.1 Neither PFOA nor PFOS are Resource Conservation Recovery Act (RCRA) hazardous wastes (and therefore, AFFF containing PFOA or PFOS are not RCRA hazardous wastes); however, under the Toxic Substances Control Act (TSCA) PFOA and PFOS are regulated through Significant New Use Rules (SNURs) which gives U.S. Environmental Protection Agency (USEPA) the authority to restrict the production and use of PFOA and PFOS containing products. AFFF constitutes an US Occupational Safety and Health Administration (OSHA) hazardous material because of its physical hazards, i.e., eye irritant, but is not listed as an US Department of Transportation (USDOT) or USEPA hazardous material. The groundwork is being laid by USEPA to incorporate PFOA and PFOS into federal drinking water standards by placing these chemicals on the Contaminant Candidate List (CCL) (a federally non-enforceable list which compiles unregulated chemicals that are targeted for future federal drinking water regulation). With regard to environmental water quality, USEPA has also listed PFOA and PFOS as Emerging Contaminants of Concern. Emerging contaminants (EC) are chemicals or materials that are characterized by a perceived, potential, or real threat to human health or the environment, or are characterized by a lack of published health standards. The Department of Defense (DoD) has also listed PFOA and PFOS as EC which are regulated under DoD Instruction 4717.18.
2.2.2 Temporary Moratorium on Incineration of Materials Containing PFAS. Effective 27 April 2022, the NDAA for FY2022 prohibited the incineration of materials containing PFAS including AFFF until conditions set forth in the FY2022 NDAA Section 343 are met. Therefore, the destruction of all AFFF-contaminated waste by high temperature incineration may only be authorized by the Contracting Officer if and when the moratorium is lifted. See PWS Section 7.5.1 for more information on disposal requirements for AFFF-contaminated wastes.
2.3 Task Order Period of Performance. Task order Period of Performance shall be 24 months commencing upon task order award.
3.0 DESCRIPTION OF WORK.
3.1 Work shall generally consist of removing and disposing of all AFFF (containing PFOA or PFOS) concentrate and associated system work to include removing and replacing AFFF bladders, rinsing or disposing of AFFF atmospheric tanks, and disposal of AFFF concentrate and solutions (i.e., rinsate and bladder tank pressurizing water). Resulting systems shall be replenished as specified with Fluorine-Free Foam, reconnections made, and checked for leaks.
3.2 While not RCRA hazardous wastes, all AFFF, solutions containing AFFF, and AFFF contaminated system components requiring disposal (i.e., plastic tanks and tank bladders, as applicable) shall be destroyed or disposed of otherwise at facilities that are USEPA permitted for the destruction or disposal of RCRA hazardous wastes (including PFAS containing wastes). See PWS Section 7.5.1 for additional details.
3.3 Unless authorized by the Contracting Officer or (or Contracting Officer’s Representative (COR)), the Contractor is not responsible for making repairs to or correcting deficiencies of existing equipment and systems. (This excludes any repairs made by the Contractor as a result of any damage caused by the Contractor to the equipment or systems.) Nor is the Contractor responsible for bringing existing code deficient systems/system components into compliance. Notwithstanding the above, the Contractor should identify any necessary repairs (e.g., existing leaks, etc.) that should be made to facilitate the accomplishment of project objectives, namely, the successful replacement of AFFF with Fluorine-Free Foam. The Contractor shall identify all such necessary repairs and request authorization from the Contracting Officer or COR to proceed PRIOR to conducting the repairs. Proceeding prior to obtaining written direction to do so will be solely at the Contractor’s own risk. See PWS paragraph 6.14 (Task 14).
3.4 Project Site Locations and Tank Data (Types, and Capacities). 3.5 For technical purposes, the contractor should assume the following:
· Water and power will be available within a reasonable distance (less than 50 feet) from each system to be serviced.
· The installations will provide suitable storage areas for supplies and waste materials. Suitable areas include flat level, hard surfaced areas and open for truck access.
· Installation personnel (either Government or contracted) will support the project by performing lockout/tagout of tank electrical systems and shutting-down tank fire alarms.
· Bladder and atmospheric tanks will have the necessary valves to isolate the concentrate tanks from the water source and the foam delivery system beyond the proportioner.
· Facilities listed as hangars will require coordination for flightline access and a permit for taking photos.
· Facilities shall be out of service for a duration not to exceed 3 days.
· MILSPEC compliant Fluorine-Free Foam will be available after 31 May 2023.
· Assume the Sample Task Order will be awarded 1 June 2023.
3.6 AFFF Work Summary. Work required for existing systems containing AFFF shall be generally accomplished using individual tasks for installations and subtasks within the tasks for work common to system components (i.e., atmospheric and bladder tanks, associated piping systems, and disposal tasks). Task 7 and Task 8 are included and shall be utilized as authorized to facilitate work for differing existing conditions (i.e., tank replacement, if necessary and authorized, minor repairs incidental to completing project objectives, and disposal of non-AFFF contaminated waste).
3.7 Tank Entry Prohibited. Work of this task order will not require entry of tanks by contractor personnel. All work (specifically tank rinsing) shall be accomplished via means that do not require tank entry. Contractor personnel are prohibited from entering any tanks.
3.8 Demarcation of Contractor Responsibility. With the exception of cases in which a control valve is downstream of the proportioner (see Section 7.5.10.4), work downstream of the AFFF proportioner is not authorized unless specifically authorized in writing by the Contracting Officer/COR.
3.9 Lead Based Paint (LBP) and Asbestos Containing Material (ACM).
3.9.1 Prior to conducting project field work the Contractor shall ascertain the need for disturbing painted surfaces, insulation covered surfaces (e.g., pipe or tank insulation), and flange gaskets to complete required project work. For these purposes “disturbing” is interpreted to mean actions such as cutting (by any means) or unfastening or disassembly of fittings, fixtures, flanges, etc. (i.e., unbolting, etc.), or other such actions that would disturb or affect the surface integrity of applied paints, insulation or gaskets. Excluded from such consideration would be unpainted surfaces (such as unpainted stainless steel) or components absent of insulation. The use of existing valves to accomplish work (e.g., draining, rinsing, etc.) so as to preclude the need for such disturbances is to be maximized to the extent practical.
3.9.2 The potential for disturbing lead-based paint (LBP) and/or asbestos containing material (ACM) shall be specifically addressed in the Contractor’s Work Plan/Accident Prevention Plan. For work or actions in which the Contractor identifies the need to disturb painted component surfaces, system piping insulation, or flange gaskets to accomplish required project work, the Contractor will be required to test for, or otherwise ascertain the presence of LBP or ACM. Additionally, coordination shall be made with the installation’s environmental compliance office if ACM is identified.
3.9.3 Work involving disturbance of LBP and/or ACM shall be conducted in strict accordance with the Contractor’s approved site specific Work Plan/Accident Prevention Plan but shall minimally require: (a) providing properly trained personnel to perform such work cognizant of the presence of, and the hazards associated with working with LBP and/or ACM, (2) utilizing appropriate PPE, work practices, and engineering controls, as applicable (3) performing such work using procedures consistent with their LBP and ACM programs, subject to Government approval, (4) properly disposing of derivative wastes resulting from conducting such work.
