Section A - Solicitation/Contract Form
EXECUTIVE SUMMARY
A.1 Objective – The objective of this contract is to procure services to remove, transport, and dispose of
Aqueous Film Forming Foam (AFFF), containing perflouroalkyl substances (PFAS). The AFFF will be removed or modified and refilled with a fluorine free foam based on a military specification (MIL-SPEC) provided at the task order (TO) level. Work may also include removal, transportation, and disposal of other types of firefighting foams. This procurement complies with the National Defense Authorization Act for the fiscal year 2020 (NDAA FY2020).
A.2 Contract Type. The U.S. Army Engineering and Support Center, Huntsville (CEHNC) intends to award
Multiple Indefinite Delivery/Indefinite Quantity (ID/IQ) type contract to both other than small and small businesses. The Government intends to award a contract or contracts resulting from this solicitation to all qualifying offerors as stated in FAR 15.304(c)(1)(ii). This requirement will be competed on an unrestricted basis with a small business reserve and will result in a Multiple Award Task Order Contract (MATOC).
The work is Service Contract Labor Standards type efforts (refer to FAR 52.222-41). The services for this requirement are classified under North American Industry Classification System (NAICS) 562910 - Environmental Remediation Services with a Small Business Size Standard of 750 employees. The applicable Product Service Code (PSC) is F108 – Hazardous Substance Removal, Cleanup & Disposal Services and Operational Support.
A.3 Contract Terms. This MATOC will have a base ordering period of twenty-four (24) months with three (3)
12-month option periods. There is no guarantee that the options will be exercised on the awarded contract.
The period of performance will be set at the time of award. The Government may extend the ordering period in accordance with terms in FAR 52.217-8, Option to Extend Services and FAR 52.217-9, Option to Extend the Term of the Contract. The evaluated rates in effect during the last exercised option period will remain in effect during any extensions executed under the stated clauses; not to exceed six months. Pricing for FAR 52.217-8, Option to Extend Services will be evaluated at the TO level.
The Government reserves the right to make staggered awards. In the event there are staggered awards during the MATOC award, later awarded contracts, will have an initial period of performance that will be less than the full 24-month base period in duration and will end on the same date as all other MATOC awardees. Option periods will be the same for all awardees. If determined to be in the Government’s interest to hold discussions, discussions may be held with offerors remaining in the competitive range after initial awards have been made to some offerors.
A.4 Contract Ordering. TOs will be awarded against the base MATOC/IDIQ contracts using the fair opportunity procedures in accordance with (IAW) FAR 16.505, Ordering, and Section H of the contract.
The only authorized ordering office is CEHNC. Other agencies may be delegated authority, in which case, an advance written notice will be given to the contractor. In addition to, or in lieu of mailing an order, the Contracting Officer may issue an order orally, by facsimile or by electronic commerce methods, at his / her discretion.
A.5 Contract Capacity. The total shared programmatic capacity for the MATOC is $800 Million over a period of five years (if all options are exercised) for this acquisition. Individual capacities will not be assigned to each contract and TOs will be awarded as Firm Fixed Price (FFP). Pricing is evaluated at the TO level.
Values provided under the Contract Line Item Numbers (CLINS) represent the estimated capacity only and the Government reserves the right to move capacity between CLINS and performance periods as necessary.
A.6 Minimum Guarantee. The Government’s minimum guarantee of $3000.00 extends throughout the entire period of performance of the IDIQ. Funding for this minimum guarantee is obligated on the first TO and is the minimum ordering amount; not a minimum payment. Payment under the subsequent TO award(s) in an amount meeting/exceeding the minimum guarantee satisfies the minimum guarantee. The initial TO is then deobligated and closed out.
A.7 Contract On-Ramps/Off-Ramps. In an effort to increase competition, the CEHNC Contracting Officer may evaluate the market every 12 - 18 months throughout the life of the MATOC to determine if it is in the Government’s best interest to On-ramp. During a contract “Off-Ramp”, the Contracting Officer may not exercise an option and contractors can request to be placed in a dormant status (refer to Section H).
Previously awarded TOs will be unaffected by on/off ramp actions taken to refresh the MATOC suite.
A.8 Contract Authorization: Only a warranted Contracting Officer acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer.
The only authorized ordering office is CEHNC. Other agencies may be delegated this authority, in which case, an advance written notice will be given to the contractor. In addition to, or in lieu of mailing an order, the Contracting Officer may issue an order orally, by facsimile or by electronic commerce methods, at his/her discretion.

DESCRIPTION/WORK STATEMENT
AQUEOUS FILM FORMING FOAM REPLACEMENT SUPPORT
MULTIPLE AWARD TASK ORDER CONTRACT
AT SITES IN CONUS AND U.S. TERRITORIES
27 May 2022
1.0 OBJECTIVE.
1.1 The objective of this Aqueous Film Forming Foam (AFFF) Replacement Support Multiple Award Task Order Contract (MATOC) is to procure the services of Contractors to perform the removal and disposal of AFFF containing perflouroalkyl substances (PFAS). Additionally, the systems may be removed or modified and refilled with a fluorine free foam complying with MIL-PRF-24385 dated January 2023 in order to comply with the National Defense Authorization Act for the Fiscal Year (FY) 2020 (FY 2020 NDAA). Work may also include removal, transportation, and disposal of other types of firefighting foams.
1.2 This contract is intended to support sites located throughout the United States, including Alaska and Hawaii, the U.S. Territories, U.S. Territorial waters and Outlying areas as defined by FAR 2.101. The services provided under this contract will be used in support of various Department of Defense Commands and Installations.
1.3 The Contractor shall safely locate; identify; recover, evaluate; assess; package; transport; manage; and make final disposition, as required, of all AFFF (containing PFOA or PFOS) concentrate and solutions and contaminated materials at various DoD facilities and properties. Work performed under this contract may include project planning; assessments; inspections; surveys; investigations; studies, engineering evaluations; prioritization; cost analyses; remedial or removal actions; spill response; sampling and analysis; evaluation of risks and hazards to human health and the environment; engineering containment and filtration; recovery; storage; transportation; and disposal.
1.4 Specific services and task activities are listed in Paragraph 3. The description of work stated herein provides a general understanding of the Contractor functions to be performed; individual Task Orders will contain the specific performance-based requirements.
2.0 GENERAL.
2.1 Firefighting and suppression foams such as AFFF are used primarily to control fires involving flammable liquids such as oil and fuel. Such foams control fires by forming films which serve as barriers that effectively starve fires of oxygen. AFFF based systems are presently installed and utilized at DoD bases and installations and facilities throughout the world. The key ingredients of AFFF are mixtures of hydrocarbon and fluorocarbon surfactants acting as surface active agents which are important in fire suppression effectiveness. Of these, perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) are part of a large group of perflouroalkyl substances (PFAS) that have come under increasingly greater environmental concern and scrutiny because of their toxicity to human and animal health, persistence in the environment, and their potential for bioaccumulation. The most common activities that could potentially result in the release of PFAS to the environment is the use of PFOA or PFOS containing AFFF for testing, firefighting, and other life-saving emergency responses.
The Contractor shall provide services to generally remove and dispose of all AFFF concentrate and solution and associated system work to include removing and replacing AFFF bladders, rinsing or disposing of AFFF atmospheric tanks, and disposal of AFFF concentrate and solutions (i.e., rinsate and bladder tank pressurizing water). Resulting systems shall be replenished as specified with Fluorine-Free Foam, reconnections made, and checked for leaks. Some AFFF systems may no longer be required and may be removed. The contractor shall protect human health and the environment from risks associated with AFFF in compliance with FY2020 NDAA and other applicable laws and regulations. Specific services and task activities are listed in Paragraph 3.
2.2 Permits and Licenses. The Contractor shall obtain the permits and licenses necessary to conduct work required for each Task Order under this Contract including, but not necessarily limited to, environmental permits, building permits, well permits where required by regulation, licensed drillers, and Department of Transportation (DOT) and Resource Conservation and Recovery Act (RCRA) requirements for the transport of Hazardous, Toxic, and Radioactive Waste (HTRW) on public highways.
2.3 Applicable Laws and Regulations. The Contractor shall perform this work in accordance with (IAW) with all applicable laws and regulations. The Contractor shall be responsible for acquiring the latest version of applicable regulatory or agency guidance, including but not limited to the referenced documents cited in this Solicitation and/or subsequent Task Orders issued after award of the Contract, unless otherwise specified.
2.4 U.S. Regulatory Framework. Neither PFOA nor PFOS are Resource Conservation Recovery Act (RCRA) hazardous wastes (and therefore, AFFF containing PFOA or PFOS are not RCRA hazardous wastes); however, under the Toxic Substances Control Act (TSCA) PFOA and PFOS are regulated through Significant New Use Rules (SNURs) which gives USEPA the authority to restrict the production and use of PFOA and PFOS containing products. AFFF constitutes an US Occupational Safety and Health Administration (OSHA) hazardous material because of its physical hazards, i.e., eye irritant, but is not listed as an US Department of Transportation (USDOT) or USEPA hazardous material. The groundwork is being laid by USEPA to incorporate PFOA and PFOS into federal drinking water standards by placing these chemicals on the Contaminant Candidate List (CCL) (a federally non-enforceable list which compiles unregulated chemicals that are targeted for future federal drinking water regulation). With regard to environmental water quality, USEPA has also listed PFOA and PFOS as Emerging Contaminants of Concern. Emerging contaminants (EC) are chemicals or materials that are characterized by a perceived, potential, or real threat to human health or the environment, or are characterized by a lack of published health standards. FY2020 NDAA requires that AFFF containing PFAS no longer be used after 31 September 2024.
The Department of Defense (DoD) has also listed PFOA and PFOS as EC which are regulated under DoD Instruction 4717.18
2.5 Publications and References. The Contractor shall be responsible for acquiring the latest version of guidance, including but not limited to the referenced documents cited in this Solicitation and/or subsequent Task Orders issued after award of the Contract, unless otherwise specified. A list of references is included in Section 12. It is not intended that the listing of referenced documents is a complete listing; additional regulations and guidance may be cited as necessary in the scoping of individual task orders. When list guidance is superseded, the latest replacement shall be used. The date of task order award will determine the appropriate date of the references used for that task order. Not all of the guidance cited in Section 12 will necessarily be applicable for any given task order.
2.6 Data Ownership and Data Rights. All data ownership and data rights will be IAW DFARS 227.7103-5(a).
2.7 Safety and Health Program. The Contractor shall develop and implement a written Safety and Health Program IAW requirements specified in EM 385-1-1, latest version. The Contractor shall ensure that its subcontractors, suppliers, and support personnel follow all safety and health provisions established in the accepted Accident Prevention Plan (APP) for the site. A Site Safety and Health Plan (SSHP) shall be included in the APP as an Attachment. No work shall be undertaken at any project site by a Contractor without an accepted APP/SSHP work plan. The Government reserves the right to stop work under this contract for any safety and health violations, deficiencies, or failures to follow related rules and regulations at no additional cost to the Government. The Government will verify that the Contractor has implemented corrective action before allowing continued performance under the contract.
2.7.1 Medical Surveillance. An ongoing medical surveillance program meeting the requirements of 29 CFR 1910.120, 29 CFR 1926.65 and standard-specific surveillance requirements (as applicable) shall be developed for personnel performing onsite activities.
2.7.2 Personal Protective Equipment. A written Personal Protective Equipment (PPE) program is required IAW 29 CFR1910.120 (g) (5), 29 CFR 1926.65(g)(5); as well as the respiratory protection requirements of 29 CFR 1910.134 and EM 385-1-1. PPE will be selected by the contractor and based on site hazards. Site hazards will govern which guidance is applicable.
2.8 Laboratory Capabilities.
2.8.1 Laboratories must demonstrate compliance with the DoD Quality Systems Manual (DoD QSM) (latest version) through accreditation by the DoD Environmental Laboratory Accreditation Program (DoD ELAP) for all project-required parameters. A list of laboratories accredited under DoD ELAP can be found at the DoD ELAP Denix web site at https://www.denix.osd.mil/edqw/accreditation/accreditedlabs/.
2.8.2 Any laboratory performing chemical analysis must provide its DoD ELAP accreditation certificate and supporting documentation to the applicable Design Center (DC) in order to be approved by that DC. If the laboratory fails to meet project-specific requirements, the KO or Contracting Officer’s Representative (COR) may require the Contractor to stop using this laboratory and obtain analytical services from another qualified laboratory that can meet project-specific requirements. The contract laboratory may not subcontract analytical services to another laboratory without the approval of the KO. The subcontracted laboratory must meet all requirements for the contract laboratory.
2.9 Security. When work is performed at a military installation, the Contractor shall comply with all security requirements of that installation.
