About this file
This is a Defense Counterintelligence and Security Agency (DCSA) addendum that tailors FAR 52.212-4 contract clauses for fingerprinting services delivered through electronic transmission.
The contract is a Firm-Fixed Unit Price agreement for electronic fingerprint data file delivery (.EFT or .SUB format) to the DCSA Fingerprint Transaction System (FTS). Acceptance occurs only upon successful ingestion by the FTS system, not upon mere file transmission. The contractor must only tender conforming items and bears responsibility for replacing defective supplies—including files rejected by FTS, mismatched personally identifiable information, transmission failures, or poor image quality—at no additional cost to the Government. Payment is tied directly to successfully accepted deliverables, with the Government obligated to pay only for quantities actually accepted. The contractor must generate, track, and distribute electronic payment bypass codes (vouchers/coupon codes) to DCSA-sponsored NISP personnel for $0.00 out-of-pocket fingerprinting services; unused or expired codes (expiring September 29, 2026) resulting in no accepted deliverables shall not be invoiced. Consolidated invoicing is required monthly, reflecting only accepted deliverables per billing cycle. Prior to transmitting any deliverables, the contractor's specific LiveScan/CardScan hardware and server platform combinations must be successfully registered, tested, and approved by the DoD Secure Web Fingerprint Transmission (SWFT) Registration Authority. The contractor must maintain active integration status, utilize FIPS-compliant encryption over secure VPN tunnels, and employ valid DoD-approved Public Key Infrastructure (PKI) certificates (CAC, PIV, PIV-I, or ECA) throughout the contract term. Failure to maintain active SWFT and PKI registrations constitutes material breach of contract.

DCSA Addendum to FAR 52.212-4
1. Tailored Paragraph (a) Inspection/Acceptance
Paragraph (a) of FAR 52.212-4 is tailored and replaced in its entirety with the following:
(a) Inspection/Acceptance.
(1) The Contractor shall only tender for acceptance those items that conform to the requirements of this contract.
(2) The Government reserves the right to inspect or test any deliverables that have been tendered for acceptance. The Government may require repair or replacement of nonconforming deliverables at no increase in contract price.
(3) Acceptance Definition: Acceptance shall not occur upon mere transmission of the data file.
Acceptance occurs only when the delivered electronic fingerprint data file (.EFT or .SUB) is successfully ingested by the DCSA Fingerprint Transaction System (FTS).
(4) Defective Supplies: Files that are transmitted but subsequently rejected by the FTS, mismatched Personally Identifiable Information (PII), transmission failures, or poor image quality shall be deemed defective supplies. The Contractor shall be responsible for providing a replacement (a reprint of the subject) at no additional cost to the Government.
2. Tailored Paragraph (i) Payment
Paragraph (i) of FAR 52.212-4 is supplemented with the following:
(i)(7) Payment Tied to Acceptance: This is a Firm-Fixed Unit Price contract. The Government shall only be obligated to pay for the exact quantity of deliverables that are successfully accepted in accordance with tailored paragraph (a)(3) above.
(i)(8) Voucher/Coupon Code Policy: The Contractor shall generate, track, and distribute electronic payment bypass codes (vouchers/coupon codes) to allow DCSA-sponsored NISP personnel to schedule and execute fingerprinting services at $0.00 out-of-pocket cost. Unused voucher/authorization codes that expire (September 29, 2026) or are not redeemed by the subjects, resulting in no accepted deliverable, shall not be invoiced and shall be billed to the Government at $0.00.
(i)(9) Consolidated Invoicing: The Contractor shall submit a single, consolidated invoice at the end of each monthly billing cycle reflecting only the accepted deliverables for that period.
3. Tailored Paragraph (t) System for Award Management (SAM)
Paragraph (t) of FAR 52.212-4 is supplemented with the following:
(t)(5) System Registration Requirements: Prior to any transmission of deliverables, the Contractor’s specific LiveScan/CardScan hardware and server platform combinations must be successfully registered, tested, and approved by the DoD Secure Web Fingerprint Transmission
DCSA Addendum to FAR 52.212-4
(SWFT) Registration Authority. The Contractor must maintain this active integration status, utilize FIPS-compliant encryption over secure VPN tunnels, and utilize valid DoD-approved Public Key Infrastructure (PKI) certificates (e.g., CAC, PIV, PIV-I, or ECA) for the duration of the contract.
Failure to maintain these active SWFT and PKI registrations shall constitute a material breach of contract.
