1. Nature and/or description of the item/service being procured and anticipated cost:
The Department of Homeland Security, FEMA, Disaster Emergency Communications Division prepared this justification for an exception to fair opportunity to procure (13) 8kw and (2) 12kw Cummins Generators mounted mobile command vehicles that are used by the Agency for vehicle mounted generators. This is a request for approval of brand name justification for “Cummins”.

2. Statutory Exception and rationale for brand name. Only one awardee is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized pursuant to FAR 16.505(b)(2)(i)(B) and is an item peculiar to one manufacturer:
Only the original equipment manufacturer is capable of providing this equipment because this equipment is unique or highly specialized. Pursuant to FAR 16.505(a)(4), this brand name specification must be used because the equipment has been tested, fitted, and is consistent, compatible and interoperable with all other vehicles and trailers currently deployed throughout the entire FEMA/Disaster Emergency Communications Division fleet of emergency operations vehicles. Additionally, the Mobile Emergency Response Support detachment generator mechanics have extensive knowledge and maintenance expertise of this equipment due to the many years of previous purchases. Any deviation could cause additional delays in deployments, fleet readiness, and training.
3. FEMA intends to post this requirement on www.sam.gov pursuant to FAR 16.505(b)(2)(ii)(D).
