SECTION 01 00 00
GENERAL REQUIREMENTS
1.1 SAFETY REQUIREMENTS
Refer to section 01 35 26, SAFETY REQUIREMENTS for safety and infection control requirements.
1.2 GENERAL INTENTION
A. Contractor shall furnish labor and materials and perform work for
Project 668-25-105 Replace Grease Traps as required by these specifications and the Statement of Work.
B. Visits to the site by Bidders may be made only during the published site walk or by appointment with the contracting officer representative
(COR).
C. Not Used

E. All employees of general contractor and subcontractors shall comply with VA security management program and obtain permission of the VA police, be identified by project and employer, and restricted from unauthorized access.
1.3 STATEMENT OF BID ITEM(S)
A. ITEM 1 - Base Bid: All work as defined within the project Statement of
Work and specifications.
B. Not Used
1.4 SPECIFICATIONS AND DRAWINGS FOR CONTRACTOR
A. Drawings and contract documents may be obtained from the website where the solicitation is posted. Additional copies will be at Contractor's expense.
1.5 CONSTRUCTION SECURITY REQUIREMENTS
A. Security Plan:

1. The security plan defines both physical and administrative security procedures that will remain effective for the entire duration of the project. The plan shall be submitted and approved by the COR prior to beginning work. The campus has a perimeter fence and gates but is freely open to the public. VA police are on site 24/7 and have responsibility for overall campus security however contractors are still responsible for securing their laydown yards and construction areas. Contractor vehicle placarding is required.
2. The General Contractor is responsible for assuring that all sub-contractors working on the project and their employees also comply with these regulations.
B. Security Procedures:
1. Not Used
2. General Contractor’s employees and subs may be subject to inspection of their personal effects when entering or leaving the project site.
3. Before starting work the General Contractor shall give one week’s notice to the Contracting Officer so that security arrangements can be provided for the employees. For working outside the scheduled shifts or days, the General Contractor shall give 3 days’ notice to the COR so that security arrangements can be provided for the employees. This notice is separate from any notices required for utility shutdown described later in this section.
4. No photography of VA premises is allowed without written permission of the Contracting Officer.
5. VA reserves the right to shut down the project site and order
General Contractor’s employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer.

3. The construction entrance gate into the facility along Wellesley uses a Best blue core padlock. This gate is manually operated and must be secured every evening. Use of this gate may be revoked if the contractor cannot manage the security of it.
4. Construction areas will use a Best blue core lock wherever possible.
Best blue keys can be purchased locally at AM Hardware and will not be provided by the VA.
5. If keys are required for spaces with existing locks the contractor will be required to check a key out from the VA’s locksmith during normal operating hours. Any personnel in possession of a VA key will require a contractor PIV card as described in paragraph 1.5.B.1.c.
If VA keys are lost or stolen the contractor will be held liable for rekeying any locks that were associated with any keys issued to them. The cost for rekeying these locks could be substantial.

F. Motor Vehicle Restrictions
1. Vehicle authorization request shall be required for any placard identified or labelled contractor vehicle entering the site and such request shall be submitted at least 24 hours before the date and time of access. Access shall be restricted to picking up and dropping off materials and supplies. Extended periods of parking in limited access areas such as entrances, roadways, loading docks and etc. shall require prior approval coordinated by the COR.
2. Contractor designated parking area shall be defined as Area 101 of the site map. This area shall be described as the unpaved area beginning at the southwest corner of the campus and extending northward along the west fence line toward the new boiler plant and shall be the area between the west side of Lot D and the west fence
(west of the drainage basin). The designated contractor parking area shall be shared by all identified contractor vehicles and shall not be dedicated to a sole contractor’s use. The designated contractor parking area shall NOT be maintained by the VA grounds service (to include but not be limited to: snow plowing, parking lines, mowing or etc.). All contractor vehicles must have a sign on the vehicle
01 00 00 - 4 identifying the contractor, and a contact number for the driver on the dash. Contractors may not park in patient parking stalls or next to any building. Vehicles may park at the job site only if delivering materials or if the service vehicle is required for the work (i.e. welding rig, vac truck, etc.)
3. No General Contractor or Sub-Contractor privately owned vehicles
(POVs) shall be allowed to park on the VA campus. All POVs shall be parked off campus or remotely at the contractor’s expense. All contractors shall be required to carpool their employees to the campus to greatest extent possible and to park the contractor identified vehicles in the designated contractor parking area only as described in F.2. above.
4. A limited number of 4 permits shall be issued for a General
Contractor for parking in the designated contractor parking area only. Only contractor labelled vehicles shall be allowed to park on campus in the designated contractor parking area or construction area as described in F2. above.
5. Traffic laws are in effect on the campus. VA police will issue tickets for all parking and moving violations (i.e. failure to wear seatbelts or failure to stop at stop signs). These are federal tickets and have fines associated with them.
1.6 OPERATIONS AND STORAGE AREAS
A. The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the COR. The Contractor shall hold and save the Government, its officers and agents, free and harmless from liability of any nature occasioned by the Contractor's performance.
1. Laydown / storage areas may be provided pending availability of space on a non-interference basis.

3. Additional shared job trailer parking locations may be provided for multiple smaller scale projects during contract negotiation with the
Contracting Officer in coordination with the COR as applicable.

B. Not Used.
C. The Contractor shall, under regulations prescribed by the Contracting
Officer, use only established roadways, or use temporary roadways constructed by the Contractor when and as authorized by the Contracting
Officer. When materials are transported in prosecuting the work, vehicles shall not be loaded beyond the loading capacity recommended by the manufacturer of the vehicle or prescribed by any Federal, State, or local law or regulation. When it is necessary to cross curbs, sidewalks, irrigation systems, greenspace, or lawns, the Contractor shall protect them from damage. The Contractor shall repair or pay for the repair of any damaged curbs, sidewalks, roads, irrigation systems, greenspace, or lawns. Contractor will contact local transit authority if work will impact public transportation.
D. Workers are subject to rules of MGVAMC applicable to their conduct.
E. Work Execution:
1. All work shall be executed to minimize impact to MGVAMC normal daily operations, including operations of utility services, fire protection systems and any existing equipment, and with work being done by others. Use of equipment and tools that transmit vibrations and noises through the building structure, are not permitted in buildings that are occupied, during construction, jointly by patients or medical personnel, and Contractor's personnel, except as permitted by COR where required.
Construction that generates extended periods of outage which deteriorates or prevents the operational capacity of the facility shall be identified prior to any start of work and shall require
COR coordination and approval.
a. Store materials and equipment only in designated areas assigned by the COR.
b. Schedule delivery of materials and equipment to immediate construction working areas within buildings in use by
Department of Veterans Affairs in quantities sufficient for not more than two workdays. Provide unobstructed access to
MGVAMC areas required to remain in operation.

c. Where access by MGVAMC personnel to vacated portions of buildings is not required, storage of Contractor's materials and equipment may be permitted subject to fire and safety requirements.

L. Coordinate the work for this contract with other construction operations as directed by the COR. This includes the scheduling of traffic and the use of roadways, as specified in Article, USE OF
ROADWAYS.
M. The contractor shall keep the premises and surrounding area free from accumulation of waste materials or rubbish caused by operations under the contract. At completion of work, the contractor shall remove waste materials, rubbish, the contractor’s tools, construction equipment, machinery and surplus material from and about the project.
N. Work hours of the project engineers are Monday through Friday between
0600 and 1630. If assistance is needed from project engineers, such as gaining access to spaces, it must be done during these hours unless coordinated and authorized by the COR prior to the start of any work.
1.7 ALTERATIONS
A. Survey: Before any work is started, the Contractor shall make a thorough survey with the COR, of buildings and areas of buildings in which alterations occur and areas which are anticipated routes of access. The contractor shall furnish a report with photos, signed by both, to the Contracting Officer. This report shall list by rooms and spaces:

1. Existing condition and types of resilient flooring, doors, windows, walls and other surfaces not required to be altered throughout affected areas of buildings.
2. Existing conditions of items such as plumbing fixtures and accessories, electrical fixtures, equipment, venetian blinds, shades, etc., required by drawings to be either reused or relocated, or both.
3. Shall note any discrepancies between drawings and existing conditions at site.
4. Shall designate areas for working space, materials storage and routes of access to areas within buildings where alterations occur, and which have been agreed upon by Contractor and COR.
B. Any items required by drawings to be either reused or relocated or both, found during this survey to be nonexistent, or in opinion of COR to be in such condition that their use is impossible or impractical, shall be furnished and/or replaced by Contractor with new items in accordance with specifications which will be furnished by Government.
Provided the contract work is changed by reason of this subparagraph B, the contract will be modified accordingly, under provisions of clause entitled "DIFFERING SITE CONDITIONS" (FAR 52.236-2) and "CHANGES" (FAR
52.243-4).
C. Re-Survey: Ten days before expected partial or final inspection date, the Contractor and COR together shall make a thorough re-survey of the areas of buildings involved. They shall furnish a report on conditions then existing, of resilient flooring, doors, windows, walls and other surfaces as compared with conditions of same as noted in first condition survey report:
1. Re-survey report shall also list any damage caused by Contractor to such flooring and other surfaces, despite protection measures; and, will form basis for determining extent of repair work required of
Contractor to restore damage caused by Contractor's employees.
D. Protection: Provide the following protective measures:

1. Wherever existing roof surfaces are disturbed they shall be protected against water infiltration. In case of leaks, they shall be repaired immediately upon discovery.
2. Temporary protection against damage for portions of existing structures and grounds where work is to be done, materials handled, and equipment moved and/or relocated.
3. Protection of interior of existing structures at all times, from damage, dust and weather inclemency. Wherever work is performed, floor surfaces that are to remain in place shall be adequately protected prior to starting work, and this protection shall be maintained intact until all work in the area is completed.
1.8 DISPOSAL AND RETENTION
A. Materials and equipment accruing from work removed and from demolition of buildings or structures, or parts thereof, shall be disposed of as follows:
1. Reserved items which are to remain property of the Government are identified by attached tags or noted on drawings or in specifications as items to be stored. Items that remain property of the Government shall be removed or dislodged from present locations in such a manner as to prevent damage which would be detrimental to re-installation and reuse. Store such items where directed by the
COR.
2. Items not reserved shall become property of the Contractor and be removed by Contractor from the MGVAMC.
3. Items of portable equipment and furnishings located in rooms and spaces in which work is to be done under this contract shall remain the property of the Government. When rooms and spaces are vacated by the Department of Veterans Affairs during the alteration period, such items which are NOT required by drawings and specifications to be either relocated or reused will be removed by the Government in advance of work to avoid interfering with Contractor's operation.

1.9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND
IMPROVEMENTS
A. The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workers, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.
B. The Contractor shall protect from damage all existing improvements and utilities at or near the work site and on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the
Contractor fails or refuses to repair the damage promptly, the
Contracting Officer may have the necessary work performed and charge the cost to the Contractor.
(FAR 52.236-9)
B. Refer to Section 01 57 19, TEMPORARY ENVIRONMENTAL CONTROLS, for additional requirements on protecting vegetation, soils and the environment. Refer to Articles, "Alterations", "Restoration", and
"Operations and Storage Areas" for additional instructions concerning repair of damage to structures and site improvements.
1.10 RESTORATION
A. Remove, cut, alter, replace, patch and repair existing work as necessary to install new work. Except as otherwise shown or specified, do not cut, alter or remove any structural work, and do not disturb any ducts, plumbing, steam, gas, or electric work without approval of the
COR. Existing work to be altered or extended and that is found to be
01 00 00 - 10 defective in any way, shall be reported to the COR before it is disturbed. Materials and workmanship used in restoring work, shall conform in type and quality to that of original existing construction, except as otherwise shown or specified.
B. Upon completion of contract, deliver work complete and undamaged.
Existing work (walls, ceilings, partitions, floors, mechanical and electrical work, lawns, paving, roads, walks, etc.) disturbed or removed as a result of performing required new work, shall be patched, repaired, reinstalled, or replaced with new work, and refinished and left in as good condition as existed before commencing work.
C. At Contractor's own expense, Contractor shall immediately restore to service and repair any damage caused by Contractor's workers to existing piping and conduits, wires, cables, etc., of utility services or of fire protection systems and communications systems (including telephone) which are not scheduled for discontinuance or abandonment.
D. Expense of repairs to such utilities and systems not shown on drawings or locations of which are unknown will be covered by adjustment to contract time and price in accordance with clause entitled "CHANGES"
(FAR 52.243-4) and "DIFFERING SITE CONDITIONS" (FAR 52.236-2).
1.13 LAYOUT OF WORK
A. The Contractor shall lay out the work from Government established base lines and benchmarks, indicated on the drawings, and shall be responsible for all measurements in connection with the layout. The
Contractor shall furnish, at Contractor's own expense, all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the work. The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer. The Contractor shall also be responsible for maintaining and preserving all stakes and other marks established by the Contracting Officer until authorized to remove them.
If such marks are destroyed by the Contractor or through Contractor's negligence before their removal is authorized, the Contracting Officer
01 00 00 - 11 may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.

B. Establish and plainly mark center lines for each building and corner of column lines and/or addition to each existing building, and such other lines and grades that are reasonably necessary to properly assure that location, orientation, and elevations established for each such structure and/or addition, roads, parking lots, are in accordance with lines and elevations shown on contract drawings.
C. Following completion of general mass excavation and before any other permanent work is performed, establish and plainly mark (through use of appropriate batter boards or other means) sufficient additional survey control points or system of points as may be necessary to assure proper alignment, orientation, and grade of all major features of work. Survey shall include, but not be limited to, location of lines and grades of footings, exterior walls, center lines of columns in both directions, major utilities and elevations of floor slabs:
1. Such additional survey control points or system of points thus established shall be checked and certified by a registered land surveyor or registered civil engineer. Furnish such certification to the COR before any work (such as footings, floor slabs, columns, walls, utilities and other major controlling features) is placed.
D. During progress of work, and particularly as work progresses from floor to floor, Contractor shall have line grades and plumbness of all major form work checked and certified by a registered land surveyor or registered civil engineer as meeting requirements of contract drawings.
Furnish such certification to the COR before any major items of concrete work are placed. In addition, Contractor shall also furnish to the COR certificates from a registered land surveyor or registered civil engineer that the following work is complete in every respect as required by contract drawings.
1. Lines of each building and/or addition.
2. Elevations of bottoms of footings and tops of floors of each building and/or addition.

3. Lines and elevations of sewers and of all outside distribution systems.
E. Whenever changes from contract drawings are made in line or grading requiring certificates, record such changes on a reproducible drawing bearing the registered land surveyor or registered civil engineer seal, and forward these drawings upon completion of work to the COR.
F. The Contractor shall perform the surveying and layout work of this and other articles and specifications in accordance with the provisions of
Article "Professional Surveying Services".
1.14 NOT USED
1.15 WARRANTY MANAGEMENT
A. Warranty Management Plan: Develop a warranty management plan which contains information relevant to FAR 52.246-21 Warranty of Construction in at least 30 days before the planned pre-warranty conference, submit a warranty management plan. Include within the warranty management plan all required actions and documents to assure that the Government receives all warranties to which it is entitled. The plan must be in narrative form and contain sufficient detail to render it suitable for use by future maintenance and repair personnel, whether tradesman, or of engineering background, not necessarily familiar with this contract.
The term “status” as indicated below must include due date and whether item has been submitted or was approved. Warranty information made available during the construction phase must be submitted to the
Contracting Officer for approval prior to each monthly invoice for payment. Assemble approved information in a binder and turn over to the
Government upon acceptance of the work. The construction warranty period will begin on the date of the project acceptance and continue for the product warranty period. Include in the warranty management plan, but not limited to, the following:
1. Roles and responsibilities of all personnel associated with the warranty process, including points of contact and telephone numbers within the company of the Contractor, subcontractors, manufacturers or suppliers involved.
2. Furnish with each warranty the name, address and telephone number of each of the guarantor’s representatives nearest project location.

3. Listing and status of delivery of all Certificates of Warranty for extended warranty items, to include roofs, HVAC balancing, pumps, motors, transformers and for all commissioned systems such as fire protection and alarm systems, sprinkler systems and lightning protection systems, etc.
4. A list for each warranted equipment item, feature of construction or system indicating:
a. Name of item.
b. Model and serial numbers.
c. Location where installed.
d. Name and phone numbers of manufacturers and suppliers.
e. Name and phone numbers of manufacturers or suppliers.
f. Names, addresses and phone numbers of sources of spare parts.
g. Warranties and terms of warranty. Include one-year overall warranty of construction, including the starting date of warranty of construction. Items which have extended warranties must be indicated with separate warranty expiration dates.
h. Starting point and duration of warranty period.
i. Summary of maintenance procedures required to continue the warranty in force.
j. Cross-reference to specific pertinent Operation and Maintenance manuals.
k. Organizations, names and phone numbers of persons to call for warranty service.
l. Typical response time and repair time expected for various warranted equipment.
5. Not Used.
6. Procedure and status of tagging of all equipment covered by extended warranties.

7. Copies of instructions to be posted near selected pieces of equipment where operation is critical for warranty and/or safety reasons.
B. Performance Bond: The Performance Bond must remain effective throughout the construction period
1. In the event the Contractor fails to commence and diligently pursue any construction warranty work required, the Contracting Officer will have the work performed by others, and after completion of the work, will charge the remaining construction warranty funds of expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.
2. In the event sufficient funds are not available to cover the construction warranty work performed by the Government at the contractor’s expenses, the Contracting Officer will have the right to recoup expenses from the bonding company.
3. Following oral or written notification of required construction warranty repair work, the Contractor shall respond within 3 business days. Written verification will follow oral instructions. Failure to respond will be cause for the Contracting Officer to proceed against the Contractor.
C. Pre-Warranty Conference: Prior to contract completion, and at a time designated by the Contracting Officer, the Contractor shall meet with the Contracting Officer to develop a mutual understanding with respect to the requirements of this section. Communication procedures for
Contractor notification of construction warranty defects, priorities with respect to the type of defect, reasonable time required for
Contractor response, and other details deemed necessary by the
Contracting Officer for the execution of the construction warranty will be established/ reviewed at this meeting. In connection with these requirements and at the time of the Contractor’s quality control completion inspection, furnish the name, telephone number and address of a licensed and bonded company which is authorized to initiate and pursue construction warranty work action on behalf of the Contractor.
This point of contract will be located within the local service area of the warranted construction, be continuously available and be responsive
01 00 00 - 15 to Government inquiry on warranty work action and status. This requirement does not relieve the Contractor of any of its responsibilities in conjunction with other portions of this provision.
D. Contractor’s Response to Construction Warranty Service Requirements:
1. Following oral or written notification by the Contracting Officer, the Contractor shall respond to construction warranty service requirements in accordance with the “Construction Warranty Service
Priority List” and the three categories of priorities listed below.
Submit a report on any warranty item that has been repaired during the warranty period. Include within the report the cause of the problem, date reported, corrective action taken, and when the repair was completed. If the Contractor does not perform the construction warranty within the timeframe specified, the Government will perform the work and back charge the construction warranty payment item established.
a. First Priority Code 1. Perform onsite inspection to evaluate situation, and determine course of action within 4 hours, initiate work within 6 hours and work continuously to completion or relief.

E. Warranty Tags: At the time of installation, tag each warranted item with a durable, oil and water-resistant tag approved by the Contracting
Officer. Attach each tag with a copper wire and spray with a silicone waterproof coating. Also submit record copies of the warranty tags showing the layout and design. The date of acceptance and the QC signature must remain blank until the project is accepted for beneficial occupancy. Show the following information on the tag.

1.18 TEMPORARY USE OF MECHANICAL AND ELECTRICAL EQUIPMENT
A. Use of new installed mechanical and electrical equipment to provide heat, ventilation, plumbing, light and power will be permitted subject to written approval and compliance with the following provisions:
1. Permission to use each unit or system must be given by COR in writing. If the equipment is not installed and maintained in accordance with the written agreement and following provisions, the
COR will withdraw permission for use of the equipment.
2. Electrical installations used by the equipment shall be completed in accordance with the drawings and specifications to prevent damage to the equipment and the electrical systems, i.e. transformers, relays, circuit breakers, fuses, conductors, motor controllers and their
01 00 00 - 17 overload elements shall be properly sized, coordinated and adjusted.
Installation of temporary electrical equipment or devices shall be in accordance with NFPA 70, National Electrical Code, (2014
Edition), Article 590, Temporary Installations. Voltage supplied to each item of equipment shall be verified to be correct and it shall be determined that motors are not overloaded. The electrical equipment shall be thoroughly cleaned before using it and again immediately before final inspection including vacuum cleaning and wiping clean interior and exterior surfaces.
3. Units shall be properly lubricated, balanced, and aligned.
Vibrations must be eliminated.
4. Automatic temperature control systems for preheat coils shall function properly and all safety controls shall function to prevent coil freeze-up damage.
5. The air filtering system utilized shall be that which is designed for the system when complete, and all filter elements shall be replaced at completion of construction and prior to testing and balancing of system.
6. All components of heat production and distribution system, metering equipment, condensate returns, and other auxiliary facilities used in temporary service shall be cleaned prior to use; maintained to prevent corrosion internally and externally during use; and cleaned, maintained and inspected prior to acceptance by the Government.
B. Prior to final inspection, the equipment or parts used which show wear and tear beyond normal, shall be replaced with identical replacements, at no additional cost to the Government.
C. This paragraph shall not reduce the requirements of the mechanical and electrical specifications sections.
D. Any damage to the equipment or excessive wear due to prolonged use will be repaired replaced by the contractor at the contractor’s expense.
1.19 TEMPORARY USE OF EXISTING ELEVATORS
A. Use of existing elevator for handling building materials and Contractor's personnel will be permitted subject to following provisions:

1. Contractor makes all arrangements with the COR for use of elevators.
The COR will ascertain that elevators are in proper condition.
Contractor may use the service elevator for special nonrecurring time intervals when permission is granted. Personnel for operating elevators will not be provided by the Department of Veterans

a. Entrance jambs, heads soffits and threshold plates.
b. Entrance columns, canopy, return panels and inside surfaces of car enclosure walls.

1.37 SCHEDULE AND FAILURE TO ACHIEVE PROGRESS
A. Contractor shall submit a complete CPM schedule for approval within thirty days of award. The CPM schedule is a working document and should be updated and refined at least weekly and shall be submitted monthly throughout the project. Any change in critical path or delay of more than ten working days shall be identified and a corrective action plan submitted as soon as the delay is identified. Detailed three-week look ahead schedules shall be submitted weekly and may be independent of the CPM schedule at the contractors discretion, however the data must be incorporated into the CPM. The CPM will indicate relationships, constraints, float, and dates for all activities and milestones at a minimum. Additional information shall be included at the COR’s request. Submittal/shop drawing preparation time, review time, and procurement time shall be included for all critical path activities and items with long procurement times.
B. Should the progress fall behind the approved project schedule for reasons other than those that are excusable within the terms of the contract, the Contracting Officer may require provision of a written recovery plan for approval. The plan must detail how progress will be made-up to include which activities will be accelerated by adding additional crews, longer work hours, extra work days, etc.
C. Artificially Improving Progress:
1. Artificially improving progress by means such as, but not limited to, revising the schedule logic, modifying or adding constraints, shortening activity durations, or changing calendars in the project schedule is prohibited. Indicate assumptions made and the basis for any logic, constraint, duration and calendar changes used in the creation of the recovery plan. Any additional resources, manpower, or daily and weekly work hour changes proposed in the recovery plan
01 00 00 - 20 must be evident at the work site and documented in the daily report along with the Schedule Narrative Report.
D. Failure to Perform:
1. Failure to perform work and maintain progress in accordance with the supplemental recovery plan may result in an interim and final unsatisfactory performance rating and may result in corrective action directed by the Contracting Officer pursuant to FAR 52.236-15
Schedules for Construction Contracts, FAR 52.249-10 Default (Fixed-
Price Construction), and other contract provisions.
E. Recovery Schedule:

1.38 GREEN ENVIRONMENTAL MANAGEMENT SYSTEM (GEMS)
GEMS Awareness Training required for Contractors
All federal agencies are required by Executive Order to implement an Environmental Management System, reduce waste, reduce quantity of toxic and hazardous chemical and materials acquired, used or disposed of, increase diversion of solid waste by recycling, and use sustainable environmental practices (acquisition of bio-based, environmentally preferable, energy-efficient, water-efficient and recycled-content products).
The Department of Veterans Affairs has chosen the term GEMS to refer to the department’s Green Environmental Management System. Green Environmental Management Systems have been shown to be a valuable tool to lessen negative impacts on the environment, and create more efficient, cost effective means of providing service to our veterans. The GEMS program emphasizes importance of compliance to federal, state, and local regulations; encourages pollution prevention strategies whenever possible; and focuses on continued improvement on environmental issues. The GEMS Program is based on ISO 14001, which relates to Environmental Management Systems (EMS). The EMS provides a framework to review activities performed by, or on behalf of the organization, including work performed by contractors.
Any parties, including contractors, who perform an activity identified as being significant based on the impact on the environment, environmental compliance, exposure risk, etc., must be aware of our facility GEMS program and ways to reduce the environmental impacts. Training for contractors and each member of their staff who is involved in significant activities should include operational controls used to reduce the environmental impacts.
The following construction activities have been identified as significant based on potential environmental impacts:

• Chemical Storage (potential for spills) Hazardous chemicals, if no alternative is available, must be stored in accordance with OSHA, EPA (49 CFR 265 Subpart I), and NFPA requirements. Any hazardous chemicals and wastes must be stored in a manner which would prevent release into the environment and must be disposed of in accordance with local, state and federal regulations. 40 CFR Parts 262-268. See list below of construction waste that is potentially hazardous waste.
• Asbestos Abatement activities 29 CFR 1926.1101
• Activities involving lead, i.e. lead based paint 29 CFR 1926.62
• Recyclable material. All contractors should recycle as much material as possible. The records of materials recycled must be submitted to the COR for recordkeeping.
• Activities which may result in contaminates (oils, fuel, chemicals, debris) flowing down the storm sewer or on ground surface. 40 CFR 112
• Activities which involve handling of universal wastes (batteries, fluorescent lamps, mercury containing devices-switches, pesticides).

Requirement to Maintain Record of Materials Reused or Recycled
In accordance with the Federal Pollution Prevention Act (source reduction, recycling, treatment and environmentally safe disposal to the environment), Resource Conservation and Recovery Act (cradle to grave management of hazardous waste and Federal procurement of recycled products) and Federal Facilities Compliance Act (subjects Federal facilities to Federal, State and local waste management and disposal laws and regulations) contractors and project managers are required to monitor waste(s) taken from a project, and certify proper disposal. If recycle or reuse of a waste product (doors, light fixtures, etc.) is possible, reasonable effort should be made to reuse or recycle the product.
Items that are reused or recycled should be logged on the attached Materials Reused/Recycled Record by the Project Manager. At the conclusion of the project, this form shall be reviewed and signed by the COR, with a copy given to the M&O Foreman and the GEMS Coordinator for their records.

SECTION 01 33 23
SHOP DRAWINGS, PRODUCT DATA, AND SAMPLES
PART 1 – GENERAL
1.1 DESCRIPTION
A. This specification defines the general requirements and procedures for submittals. A submittal is information submitted for VA review to establish compliance with the contract documents.
B. Detailed submittal requirements are found in the technical sections of the contract specifications. The Contracting Officer may request submittals in addition to those specified when deemed necessary to adequately describe the work covered in the respective technical specifications at no additional cost to the government.
C. VA approval of a submittal does not relieve the Contractor of the responsibility for any error which may exist. The Contractor is responsible for fully complying with all contract requirements and the satisfactory construction of all work, including the need to check, confirm, and coordinate the work of all subcontractors for the project.
Non-compliant material incorporated in the work will be removed and replaced at the Contractor’s expense.
1.2 DEFINITIONS
A. Preconstruction Submittals: Submittals which are required prior to issuing contract notice to proceed or starting construction. For example, Certificates of insurance; Surety bonds; Site-specific safety plan; Construction progress schedule; Schedule of values; Submittal register; List of proposed subcontractors.
B. Shop Drawings: Drawings, diagrams, and schedules specifically prepared to illustrate some portion of the work. Drawings prepared by or for the Contractor to show how multiple systems and interdisciplinary work will be integrated and coordinated.
C. Product Data: Catalog cuts, illustrations, schedules, diagrams, performance charts, instructions, and brochures, which describe and illustrate size, physical appearance, and other characteristics of materials, systems, or equipment for some portion of the work. Samples of warranty language when the contract requires extended product warranties.
D. Samples: Physical examples of materials, equipment, or workmanship that illustrate functional and aesthetic characteristics of a material or
01 33 23 - 2 product and establish standards by which the work can be judged. Color samples from the manufacturer's standard line (or custom color samples if specified) to be used in selecting or approving colors for the project. Field samples and mock-ups constructed to establish standards by which the ensuing work can be judged.
E. Design Data: Calculations, mix designs, analyses, or other data pertaining to a part of work.
F. Test Reports: Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work. Report which includes finding of a test made at the job site or on sample taken from the job site, on portion of work during or after installation.
G. Certificates: Document required of Contractor, or of a manufacturer, supplier, installer, or subcontractor through Contractor. The purpose is to document procedures, acceptability of methods, or personnel qualifications for a portion of the work.
H. Manufacturer's Instructions: Pre-printed material describing installation of a product, system, or material, including special notices and MSDS concerning impedances, hazards, and safety precautions.
I. Manufacturer's Field Reports: Documentation of the testing and verification actions taken by manufacturer's representative at the job site on a portion of the work, during or after installation, to confirm compliance with manufacturer's standards or instructions. The documentation must indicate whether the material, product, or system has passed or failed the test.
J. Operation and Maintenance Data: Manufacturer data that is required to operate, maintain, troubleshoot, and repair equipment, including manufacturer's help, parts list, and product line documentation. This data shall be incorporated in an operations and maintenance manual.
K. Closeout Submittals: Documentation necessary to properly close out a construction contract. For example, Record Drawings and as-built drawings. Also, submittal requirements necessary to properly close out a phase of construction on a multi-phase contract.
1.3 SUBMITTAL REGISTER
A. The submittal register will list items of equipment and materials for which submittals are required.
B. The submittal register will serve as a scheduling document for submittals and will be used to control submittal actions throughout the contract period.

C. The VA will provide a blank submittal register in electronic format.
Thereafter, the Contractor shall fill in the blank register with the required submittals as documented in the project spec. The Contractor shall track all submittals by maintaining a complete list, including completion of all data columns, including dates on which submittals are received and returned by the VA.
D. The Contractor shall update the submittal register as submittal actions occur and maintain the submittal register at the project site until final acceptance of all work by Contracting Officer.
E. The Contractor shall submit formal monthly updates to the submittal register in electronic format. Each monthly update shall document actual submission and approval dates for each submittal.
1.4 SUBMITTAL SCHEDULING
A. Submittals are to be scheduled, submitted, reviewed, and approved prior to the acquisition of the material or equipment.
B. Coordinate scheduling, sequencing, preparing, and processing of submittals with performance of work so that work will not be delayed by submittal processing. Allow time for potential resubmittal.
C. No delay costs or time extensions will be allowed for time lost in late submittals or resubmittals.
D. All submittals are required to be approved prior to the start of the specified work activity.
1.5 SUBMITTAL PREPARATION
A. Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements.
B. Collect required data for each specific material, product, unit of work, or system into a single submittal. Prominently mark choices, options, and portions applicable to the submittal. Partial submittals will not be accepted for expedition of construction effort. Submittal will be returned without review if incomplete.
C. If available product data is incomplete, provide Contractor-prepared documentation to supplement product data and satisfy submittal requirements.
D. All irrelevant or unnecessary data shall be removed from the submittal to facilitate accuracy and timely processing. Submittals that contain the excessive amount of irrelevant or unnecessary data will be returned without review.

E. Provide a transmittal form for each submittal with the following information:
1. Project title, location and number.
2. Construction contract number.
3. Date of the drawings and revisions.
4. Name, address, and telephone number of subcontractor, supplier, manufacturer, and any other subcontractor associated with the submittal.
5. List paragraph number of the specification section and sheet number of the contract drawings by which the submittal is required.
6. When a resubmission, add alphabetic suffix on submittal description.
For example, submittal 18 would become 18A, to indicate resubmission.
7. Product identification and location in project.
F. The Contractor is responsible for reviewing and certifying that all submittals are in compliance with contract requirements before submitting for VA review. Proposed deviations from the contract requirements are to be clearly identified. All deviations submitted must include a side by side comparison of item being proposed against item specified. Failure to point out deviations will result in the VA requiring removal and replacement of such work at the Contractor's expense.
G. Stamp, sign, and date each submittal transmittal form indicating action taken.
H. Stamp used by the Contractor on the submittal transmittal form to certify that the submittal meets contract requirements is to be similar to the following:

1.6 SUBMITTAL FORMAT AND TRANSMISSION
A. Provide submittals in electronic format, with the exception of material samples. Use PDF as the electronic format, unless otherwise specified or directed by the Contracting Officer.
B. Compile the electronic submittal file as a single, complete document.
Name the electronic submittal file specifically according to its contents.
C. Electronic files must be of sufficient quality that all information is legible. Generate PDF files from original documents so that the text included in the PDF file is both searchable and can be copied. If documents are scanned, Optical Character Resolution (OCR) routines are required.
D. E-mail electronic submittal documents smaller than 5MB in size to e-mail addresses as directed by the Contracting Officer.

E. Provide electronic documents over 5MB through an electronic FTP file sharing system. Confirm that the electronic FTP file sharing system can be accessed from the VA computer network. The Contractor is responsible for setting up, providing, and maintaining the electronic
FTP file sharing system for the construction contract period of performance.
F. Provide hard copies of submittals when requested by the Contracting
Officer. Up to 3 additional hard copies of any submittal may be requested at the discretion of the Contracting Officer, at no additional cost to the VA.

1.10 VA REVIEW OF SUBMITTALS AND RFIS
A. The VA will review all submittals for compliance with the technical requirements of the contract documents. The Architect-Engineer for this project will assist the VA in reviewing all submittals and determining contractual compliance. Review will be only for conformance with the applicable codes, standards and contract requirements.
B. Period of review for submittals begins when the VA COR receives submittal from the Contractor.
C. Period of review for each resubmittal is the same as for initial submittal.
D. VA review period is 5 business days for submittals.
