NOTIONAL SEED PROJECT STATEMENT OF WORK

30 OCTOBER 2020

1. CONTRACT FOR CONSTRUCTION OF: FB-00007-21, Revitalize M-6205 & FB-00009-21, Revitalize M-2505, FORT BRAGG, NC.

2. DESCRIPTION OF WORK: The job includes, but is not limited to, all labor, material, equipment, incidentals, supervision and transportation required to Revitalize M-6205 & M-2505 for use as a Latrine and Small Meeting Room Facility for Bragg Boulevard Linear Park, M-6205 & M-2505; at the end of the undertaking the Real Property Facility [all components and systems necessary to perform designated function], including installed building equipment Systems [subset of facility], and Components [subset of system] as well as infrastructure for equipment in place and personal property [terms as defined in 10 US Code, Chapter 169: §2661, §2801, §2805 and §2811 and AR-420-1] shall be complete and useable. All work shall be performed in accordance with UFC 1-200-01 (DOD Building Code) and UFC 1-200-02 (High Performance and Sustainable Building Requirements), as amended by more stringent requirements in this SOW, as well as the contract specifications, manufacturer’s specifications and published recommendations. Work performed under this task order shall be completed by or supervised by discipline specific licensed contractors. The work shall comply with the latest edition of all published guidance: Federal, U.S. Department of Defense (DOD), Department of the Army, U.S. Environmental Protection Agency (EPA), Unified Facility Criteria (UFC), the Fort Bragg Installation Design Guide (IDG), as well as Fort Bragg construction safety and environmental protection laws, regulations, rules, and codes, current as of the date of the award of the contract.

CLIN 2: FB-00007-21, Repair M-6205 Repair IAW DA PAM 420-11, Chapters 1-6, Definitions, paragraphs a (1) and (4).

“Interior rearrangements (except for load-bearing walls) and restoration of an existing facility to allow for effective use of existing space or to meet current building code requirements (for example, accessibility, health, safety, or environmental) may be included as repair.”

Conversion Repair Projects IAW 420-11 1-6, (6) the existing Category Code is 73017 Description [AR 415-28] A the project is converting the building to Category Code to 73085 Description, thus even though the work could be considered repair 420-11 work classification is construction

“Additions, new facilities and functional conversions must be done as construction.”

Subsection (e) of section 2811 of title 10, United States Code, is amended to read as follows: ‘‘(e) REPAIR PROJECT DEFINED.—In this section, the term ‘repair Project’ means a project—‘‘(2) to convert a real property facility, system, or component to a new functional purpose without increasing its external dimensions.’’.

Subsection (e) of section 2811 of title 10, United States Code, is amended to read as follows: ‘‘(e) REPAIR PROJECT DEFINED.—In this section, the term ‘repair Project’ means a project—‘‘(2) to convert a real property facility, system, or component to a new functional purpose without increasing its external dimensions.’’.

3. PERFORMANCE PERIOD:

4. AT/OPSEC REQUIREMENTS: Check the appropriate boxes based on OPSEC form.

|X| ACCESS, GENERAL PROTECTION, AND SECURITY POLICY AND PROCEDURES.

Contractor and all associated subcontractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by Government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal, Director of Emergency Services, or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or individual facility change, the Government may require changes in contractor security matters or processes.

|X| IWATCH TRAINING.

The contractor and all associated sub-contractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 5 calendar days of contract award and within 10 calendar days of new employees commencing performance with the results reported to the COR NLT 15 calendar days after contract award. |X| FOR ELIGIBILITY VERIFICATION FOR EMPLOYMENT

E-Verify is an Internet-based system that compares information from an employee's Form I-9, Employment Eligibility Verification, to data from U.S. Department of Homeland Security and Social Security Administration records to confirm employment eligibility. The U.S. Department of Homeland Security is working to stop unauthorized employment. By using E-Verify to determine the employment eligibility of their employees, companies become part of the solution in addressing this problem. All U.S. employers must complete and retain a Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens. On the form, the employer must examine the employment eligibility and identity document(s) an employee presents to determine whether the document(s) reasonably appear to be genuine and relate to the individual and record the document information on the Form I-9. The list of acceptable documents can be found on the last page of the form. E-Verify is mandatory for employers with federal contracts or subcontracts that contain the Federal Acquisition Regulation E-Verify clause.

DFARS 252.236-7001: Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

10. SCOPE OF WORK:

A. GENERAL - Design Build Contracts, Tailor as Required:

This is a Design Build Contract; the contractor shall subcontract with an A-E firm to complete plans prior to commencement of the "reconfiguration" work. The AE Contractor is a Subcontractor of the Prime Contractor; the Prime Contractor shall ensure that the requirements of the contract are met. The contractor shall furnish all Architect-Engineer services, labor, materials, and equipment required to perform all requirements of the job.

a. All work shall conform to the most current version of: UFC 1-200-01 DoD Building Code (General Building Requirements) and UFC 1-200-02 High Performance and Sustainable Building Requirements, based on the date of the contract award and as amended by more stringent requirements in this SOW. The job includes all labor, materials and equipment required for full performance of the work.

b. Contact Documents shall be signed and sealed by an Architect or Professional Engineer as applicable to the discipline.

c. Prepare Contract Documents (Drawings, Specifications, Cost Estimate, Project Narrative and FF&E Package) to guide a general contractor in all disciplines, including, but not limited to architectural, mechanical, electrical, plumbing, fire protection, etc., as needed for this project.

d. All references to Unified Facilities Criteria (UFC) refer to the current edition as of date of award of the contract.

e. The major features of work are listed below, however this job includes, but is not limited to, the major features identified.

f. A-E Construction Phase Services: None, except as required by the AE construction subcontractor to resolve errors and omissions.

g. Contract Post-Award Conference as well as a Design Kick off Meeting Site Visit is required.

*Note: If requested and required the Post Award Conference may happen during same day as Kick off Meeting.

B. DESIGN - Design Only and Design Build Contracts, Tailor as Required:

1. Design Services and Submittal Requirements. The Savannah District Design Manual for Military Construction (SAS DM) provides detailed guidance for preparation of all work under this contract. All designs shall be delivered to Fort Bragg using CAD technology, SpecsIntact software for contract specifications. Submittal requirements for each phase of design are defined in the SAS Design Manual for Military Construction. Deliverables shall be provided to Fort Bragg for reproduction and distribution to other agencies. Deliverables for each submission shall include a complete set of CAD files, and PDFs of all files. All narrative and text documents, and specifications shall be provided in their electronic format, as appropriate. Final and corrected submissions shall be geo-referenced in accordance with Fort Bragg Criteria. The Government shall consolidate all review comments by the scheduled cutoff date.

2. Design Schedule: Project Design timeline

*Note: Design NTP are at Contract award unless Design and Construction NTP(s) are to be issued separately.

65% Submittal 30 calendar days after contract award.

100% Design Submittal 60 calendar days after contract award.

100% Corrected Design Submittal 90 calendar days after contract award.

A/E shall submit invoices on a milestone basis upon submission and approval of each design submittal.

3. Predesign Meeting: Prior to design beginning the prime contractor must coordinate a predesign meeting with the AE firm, subcontractors, and Government stakeholders to discuss the design development and requirements. The Contractor shall coordinate the meeting with the Fort Bragg Project Manager.

4. Construction Contract Documents: The specifications, PDF, and DGN formatted drawing files submitted by the A-E at the corrected final design stage shall constitute the construction contract documents for this project. Correction of items of noncompliance in the contract documents, whether format or technical errors, is the responsibility of the Architect-Engineer.

a. The Design shall be prepared using English units.

b. Drawing Number: The drawing number shall be DPW-7865

5. Sixty-five Percent (65% Percent) Design and Submittal: The Architect-Engineer shall prepare in accordance with Government standards the detailed working drawings and specifications necessary for the effective coordination and efficient execution of the construction work together with such design analyses, and other related and supporting documentation as are more fully specified herein and in the SAS Design Manual for Military Construction.

6. Final Design (100%) and Submittal: The Architect-Engineer shall prepare in accordance with Government standards the detailed working drawings and specifications necessary for the effective coordination and efficient execution of the construction work together with such design analyses, and other related and supporting documentation as are more fully specified herein and in the SAS Design Manual for Military Construction. The A-E shall ensure that the incorporation of comments and responses to the comments from previous design review are included.

7. Corrected Final Design (100%) and Submittal: The Architect-Engineer shall prepare in accordance with Government standards the detailed working drawings and specifications necessary for the effective coordination and efficient execution of the construction work together with such design analyses, and other related and supporting documentation as are more fully specified herein and in the SAS Design Manual for Military Construction. The A-E shall ensure that the incorporation of comments and responses to the comments from previous design review are included.

9. Conferences:

d. Conference Minutes: The Architect-Engineer shall be responsible for taking notes and preparing the minutes for all conferences after contract award. Conference/visit notes shall be prepared in typed form, signed by the A-E’s Project Manager, and the original furnished to the Fort Bragg KO and COR (within five business days after date of conference) for concurrence and distribution to all attendees.

10. Permits: The Architect-Engineer shall ensure that designs comply with all the requirements of UFC 1-200-01 (DOD Building Code) and UFC 1-200-02 (High Performance and Sustainable Building Requirements). The A-E and their construction subcontractor shall be responsible for obtaining necessary permits, licenses, and approvals from local, state, and federal authorities.

C. DEMOLITION - Vertical Construction Contracts:

1. GENERAL

a. The job includes all demolition required to achieve the design intent of the RFP drawings. Demolition shall conform to the requirements of 02 41 00 and includes but is not limited to the following.

i. Demolition of existing facility, additions, stairs, ramps, and other building components, including foundations.

ii. Gutting of the interior to load bearing elements, to achieve the design intent of the RFP drawings.

iii. Demolition of existing thermal and moisture protection system, including cladding, windows, doors, roofing, to achieve new work.

iv. Demolition of existing landscaping and site features as required to achieve the design intent of the landscape plan.

b. The job includes demolition, and disposal. The contractors are responsible for obtaining all required permits and conforming to all OSHA requirements.

c. Demolition includes Asbestos, Lead Based Paint and Visible Mold Abatement from the entire facility, at the end of the undertaking there shall be no Asbestos, Lead Based Paint or Visible Mold in the entire facility.

a. Asbestos Containing Materials (ACM) Demolition includes but is not limited to removal and disposal of ACM flooring, the ACM flooring mastic, ACM contaminated ceiling tile, and the ACM ceiling tile mastic, ACM Pipe wrapping, ACM joint compound, et cetera. The work includes include the required daily air monitoring, design services, TEM clearance, disposal and other precautions required by law.

i. An asbestos removal permit must be obtained from the Health Hazards Control Unit (HHCU) of the N. C. Department of Health & Human Services, Division of Public Health prior to any renovation project that will disturb more than 35 cubic feet, 160 square feet, or 260 linear feet of regulated asbestos-containing material. If the asbestos containing materials are disturbed removal is required. If suspect materials are discovered during the demolition in concealed spaces, demolition and renovation activities work should stop. A North Carolina accredited asbestos inspector shall sampled the suspect material. The project manager will provide electronic copies of all asbestos removal applications, permits, any revisions and disposal documents to the Fort Bragg EMB Asbestos Program Manager. All asbestos containing materials (ACM) shall be disposed of in accordance with all federal, state, and local regulations. The contractor shall submit asbestos abatement plan.

b. Lead Based Paint (LBP) Demolition includes but is not limited to removal and disposal of LBP. The job includes the required daily air monitoring, design services, disposal and other precautions required by law. The use of Sponge blasting is an acceptable method of removal, sponge abrasiveness shall proceed from gentlest means to more aggressive means to minimize deterioration of existing subsurface.

i. The OSHA standards for lead-construction (29-CFR 1926.62) regulates the work practices for lead-containing materials. Since all painted or stained surfaces and residues at Fort Bragg are presumed to contain lead, this standard is to be applied to all facilities. Whenever waste is generated, the person generating the waste is responsible in determining whether it is hazardous waste and whether the hazardous waste contains lead. Abating lead disturbed by the contractor is included in the job. The contractor shall submit a lead abatement plan.

c. At the end of the undertaking the facility and the site shall be cleaned of all debris and construction waste. The site shall be restored to the condition the site was in prior to the undertaking, except where additional landscaping is a requirement of the job.

2. The entire interior shall be conditioned insulate and air seal at the exterior wall line and roof line to comply with the requirements of UFC 1-200-02.

H. PLUMBING

1. Conform to UFC 3-420-01 Plumbing Systems and 22 00 00.

I. ELECTRICAL

1. Conform to: UFC 3-501-01 Electrical Engineering for general electrical requirement criteria, UFC 3-520-01 for interior electrical systems criteria, UFC 3-530-01 for interior and exterior lighting and controls criteria, UFC 3-560-01 for electrical safety and electrical Operations and Maintenance (O&M) criteria, and NFPA 70.

J. COMMUNICATIONS

1. Conform to 27 10 00. Telecommunications system designs shall require Registered Communications Distribution Designer’s stamp per UFC 3-580-01Telecommunications Interior Infrastructure Planning and Design.

K. FIRE SUPPRESSION, FIRE DETECTION, FIRE ALARM, AND MASS NOTIFICATION SYSTEMS

1. Conform to UFC 4-021-01 Design and O&M: Mass Notification Systems, UFC 3-600-1, ETL 98-7, NFPA 72, NFPA 20, 21 00 00 and other applicable NFPA Standards and Codes. Provide a complete addressable, Class A, 4-wire supervised fire detection (alarm) system. Fire Alarm Control Panel (FACP) shall be connected to Fort Bragg’s Emergency Response System.

Fire protection design and shop drawings must be prepared by a licensed Fire Protection Engineer (FPE) and include his/her seal. The licensed PE is required to have passed the NCEES test in the discipline of Fire Protection Engineering. The QFPE must monitor the installation of the fire alarm system and certify, in writing, that the system was installed and operates as per design.

2. All fire alarm system acceptance tests shall be performed in the presence of the Installation’s Fire Department, to demonstrate operation of all newly installed fire alarm devices.

L. UTILITIES

1. Design systems to utilize existing utilities, connect and extend existing as required for new work.

11. ADDITIONAL ENCLOSURES

A. |X| RFP Design

12. SITE VISIT: Prior to the submission of any proposals, all offerors are required to visit the project site location to become familiar with the project requirements. A proposal will not be rejected only because the offeror fails to visit the project site. Failure to visit the project site will not relieve the bidder from responsibility for performance of the work and compliance with the terms and conditions of any resultant contract. In no event will a failure to inspect the site constitute grounds for a claim after award of the contract.

13. EXCAVATION PERMIT: The contractor shall have a completed and approved Excavation Permit prior to any excavation, to include sign or fence-post holes. The Contractor shall schedule an appointment to locate utility lines at least 24 hours prior to any excavation with the DPW.

14. DISPOSAL OF WASTE: Loose debris on trucks leaving the site shall be loaded in a manner that shall prevent loosing or dropping of materials on streets and conform to local ordinances / laws. Fasten suitable cover, such as a tarpaulin, over the load before entering surrounding streets. The Contractor shall be responsible for cleaning up any materials that fall from trucks and held liable for any resulting damages. The Contractor is solely responsible for spillage from its vehicles, and such spillage shall be cleaned up immediately. The Contractor shall report all spills to the Fort Bragg Fire Department 910-432-0911 or 911. For the duration of this contract and on a daily basis, the Contractor shall remove from all roads and / or streets asphalt, mud, soil, rocks, trash, and debris that result from its operations. All roads and / or streets affected shall be cleaned before close of business on the day affected.

· Contractor shall submit all trip tickets from the off-post landfill facility to the COR/ACOR within three working days to show all debris is being land-filled in accordance with all Federal requirements and in an approved location.

· The Contracting Officer (KO) will determine if materials removed from and not reused in the project are salvageable or unsalvageable. Salvageable materials shall be disposed of as directed by the KO. When material is designated as unsalvageable, the material from that point shall become the property of the Contractor.

· The Fort Bragg Lamont Construction and Demolition (C&D) Landfill is closed and is not accepting any C&D Waste or Asbestos Waste. The Municipal Solid Waste (MSW) Transfer Station at the Lamont Landfill Facility is closed and is not accepting MSW at the facility.

· All contractors shall use a State Certified C&D Landfill or Sub Title “D” Landfill outside Department of Defense land for the disposal of C&D waste, asbestos waste, and MSW. The contractor shall maintain data of all waste disposed (C&D and MSW) and all materials recycled in execution of a TO. The Department of the Army (DA) and the North Carolina Department of Environmental Quality (NCDEQ) requires monthly and annual reporting of all materials (waste and recyclables) managed by Fort Bragg. The Fort Bragg Environmental Compliance Branch, Solid Waste/Recycling Office is responsible for compiling data into monthly Directorate Reports to be consolidated into reports for DA and NCDEQ. A form from the Solid Waste/Recycling Office or a Contractor form shall be completed by the Contractor with the type of waste or recycled material, the weight of the waste/material (tons or pounds), and the certified facility accepting the waste/material. This information shall be submitted to Fort Bragg Solid Waste/Recycling Office no later than the second Friday of each month.

· All recyclable materials generated during execution is Government property unless the contract specifies that the Contractor can obtain the materials. State Law and Fort Bragg regulations requires covering of loads of waste or recyclables to prevent litter. All waste and recyclable material loads are subject to be inspected of their contents while on Department of Defense land. The Lamont Landfill Facility Recycling Area will accept specific recyclable items as indicated below.

· Concrete, Brick, Block and Asphalt: tested and free of asbestos and lead based paint to be recycled; no larger than 2 feet by 2 feet pieces or equivalent; minimal amount of dirt in load; no rebar protruding out of the concrete.

· Trees, Limbs, and Stumps: 6 feet or less in length for diameter < 3 feet; 3 feet or less in length for diameter => 3 feet; minimal amount of dirt in load and in stump roots; ground wood chips accepted; no trash in load.

· Pallets: Serviceable and non-serviceable.

· Steel and Aluminum: No items requiring demilitarization, containing or coated with liquid.

· Cardboard: Clean of trash, plastic, Styrofoam, wood, metal, etc.; 40 cubic yard dumpster available for material; alternate acceptance location at Fort Bragg Recycling Center (Building 3-1240, DPW Compound at Butner Road / Reilly Road intersection).

15. SALVAGE: All materials and equipment to be demolished, except recyclable items and items indicated in as Government salvage, shall be vested to the Contractor upon removal from Department of Defense land. The Government shall not be responsible for the condition, loss, or damage to such materials and equipment after NTP. All unsalvageable material shall be disposed of legally outside Department of Defense land. Projects which include Government salvage will have such items clearly designated in the scope. Government salvage materials shall be cleaned, sorted, identified, bundled, boxed, etc. and delivered to the collection location identified.

16. HAUL ROUTES: The Contractor is required to obtain approval from the COR for the routes he intends to use for transportation of borrow materials, construction debris, or demolition materials unless otherwise permitted in writing by the COR. The axle load of earth-hauling equipment operating on paved streets shall not exceed 12,000 pounds.

17. UTILITY OUTAGES AND ROAD CLOSURES: Utility, road and railroad closures require a minimum 10 working days advance written notice and will be subject to COR for approval. In the case of a road closures, a sketch shall be provided showing the closure location and all necessary signs and barricades. Necessary signage, barricades, flag persons, lights (including temporary traffic control lights), and markings for the safe movement of the public during construction shall be in accordance with the Manual on Uniform Traffic Control Devices, and shall be provided at no additional expense to the Government.

18. AVAILABILITY AND USE OF UTILITY SERVICES:

Utility services required on the job site for the accomplishment of the work

|X| Will be furnished at an additional cost to the Contractor.

However, the Government will make no connections or alterations to the existing utility systems for the Contractor. Utilities for offices and/or storage buildings or areas will be billed to the Contractor monthly and will not be furnished free of charge. The Contractor shall be responsible for installing meters or other connections at no cost to the Government. At the conclusion of the contract, the Contractor shall remove all temporary connections, distribution lines, meters and associated paraphernalia unless otherwise notified by the COR. Prior to installing any utility connections at an office/storage site, the plan will be approved by the COR. When utility meters are installed, the Contractor shall notify the COR for the initial meter reading. Failure to obtain this initial reading will result in the Contractor being charged for the entire amount shown on the meter.

20. CONTRACTOR STORAGE AND TRAILERS: The Contractor shall place or paint a sign on all of his storage trailer(s) and building(s) used on this contract. At a minimum, the sign shall contain the name of the Contractor and a telephone number at which the contractor can be reached. The trailer(s) and building(s) shall be completed with gates and/or doors which can be locked. Only material for this project shall be stored in the trailer(s) or building(s). The Contractor shall remove the storage trailer(s) or building(s) within 30 days after completion of the contract and prior to submitting his final invoice. The area around the storage trailer(s) and building(s) shall be kept clean.

21. SAFETY: Safety will be in compliance with the Corps of Engineers Safety Manual EM 385-1-1. Use of appropriate safety equipment is mandatory and not limited to hard hats and steel-toed shoes. Contractor is responsible for daily clean up and complete restoration of the area once the contract is complete.

22. CONTRACTOR’S PERSONNEL

· Contractor personnel performing work under this contract shall be U.S. citizens unless the provisions of Army Regulation 25-2, Information Assurance have been fully completed and approval has been granted by the Government for the non-U.S. citizen to perform the required support

· Contractor personnel performing work under this contract shall be able to read, write, speak, and understand the English language to effectively carry out all contract requirements. They shall have a command of both the written and spoken English language to communicate in person properly clearly, and effectively or via electronic devices (telephone or Email) with co-workers, customers, and the general public

23. HOURS OF WORK: Work shall be accomplished between the hours of 0730 thru 1600 hours daily, Monday through Friday on non-Government holidays. Legal holidays falling on Saturday are observed on the proceeding Friday and those falling on Sunday are observed on the following Monday. Work schedule and facility security to be coordinated with the Contracting Officer Representative (COR) for facility access and security maintenance during duration of work. Contractor shall not work outside of the stated hours of work, without first obtaining approval from the COR.

24. WARRANTY: The contractor shall provide a minimum of one (1) year warranty on all materials and workmanship from the date of the Government’s acceptance of the work.
