ORDER PLACEMENT PROCEDURES
FAIR OPPORTUNITY CONSIDERATIONS
Awardees will be afforded a fair opportunity to compete again at the Delivery Order level and will be solicited via email. All contractors that have received an award against the solicitation will be provided the following in an email in order to compete for each Delivery Order:
1. Blank Price Schedule
2. Specification
3. Response Date
4. Any miscellaneous information that may be relevant to particular orders (place of delivery, etc.)
In providing awardees a fair opportunity to be considered for each Delivery Order, the contracting officer shall consider the following factors:
(a.) Past Performance on earlier Delivery Orders (b.) Price (c.) Ability to comply with the Period of Performance (d.) Other factors relevant to the placement of Delivery Orders
Contractors competing for award of Delivery Orders may reduce prices by quoting lower prices than proposed and awarded under their contract. Increases in pricing are not permissible. Any proposals that are received after the response date for each Delivery Order may not be considered.
Exceptions:
Awardees need not be given an opportunity to be considered for a particular order, if the Contracting Officer determines that:
(a.) The agency need for such supplies or services is of such urgency that providing such opportunity would result in unacceptable delays.
(b.) Only one such contractor is capable of providing such supplies and/or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
(c.) The order should be issued on a sole source basis in the interest of economy and efficiency as a logical follow-on order already issued under this contract, provided that all awardees were given a fair opportunity to be considered for the original order.
(d.) It is necessary to place an order to satisfy a minimum guarantee.
EXTENT OF OBLIGATION
The Government is obligated only to the extent of authorized purchases actually made under this contract. The quantities specified on this contract are only an estimate. The Government may order more or less depending on actual needs. Under this contract the Government is not obligated to purchase any items other than fulfilling the guaranteed minimum.
