5.2.8. Known or projected resource and schedule impacts.

5.3. DELAYS:

Mission requirements may restrict the Contractor’s access to the project at times.

Government will provide the Contractor notice of the dates and estimated duration of the restrictions, if known. Unexpected delays due to range closures shall be reported to the CO, no later than the following workday.

5.3.1. Notification of Delays: The Contractor shall, in writing, notify the CO within 24 hours of occurrence of any action, lack of action or circumstance, which may delay the Contractor. Failure to do so may negate any subsequent request for equitable adjustment.

5.3.2. Delay Types: Excusable Delays are delays that are unforeseeable and beyond the control of the contractor. Non-Excusable Delays are delays that are foreseeable or within the Contractor’s control. The distinction between these two (2) is significant in that it determines which party is liable for the delay. Similarly, it also dictates whether a Contractor would be entitled to a time extension and possibly, if the Contractor would be entitled to compensation for that time extension.

5.3.3. Excusable Delay: Except for defaults of the Contractors at any tier, the Contractor shall not be in default because of any failure to perform this contract under its terms if the failure arises from causes beyond the control and without the fault or negligence of the Contractor. Examples of these causes are (1) acts of God or of the public enemy, (2) acts of the government in either its sovereign or contractual capacity, (3) fires, (4) floods, (5) epidemics, (6) quarantine restrictions,

(7) strikes, (8) freight embargoes, and (9) unusually severe weather.

5.3.3.1. If the failure to perform is caused by the failure of a Contractor at any tier to perform or make progress, and if the cause of the failure was beyond the control of the Contractors at any tier and without fault or negligence of either, the Contractor shall not be deemed to be in default, unless:

5.3.3.2. The subcontracted supplies or services were obtainable from other sources.

5.3.3.3. The CO requests the Contractor to purchase these supplies or services from the other source;

5.3.3.4. The Contractor failed to comply reasonably with this order.

5.3.3.5. Upon request of the Contractor, the CO shall ascertain the facts and extent of the failure. If the CO determines that, any failure to perform results from one (1) or more of the causes above, the delivery schedule shall be revised, subject to the rights of the Government under the termination clause of this contract.

5.3.4. Non-Compensable Delay: A Non-Compensable Delay is when contractor has assumed the risk under the contract. Oftentimes, even if a delay appears to be excusable, it will be the responsibility of the contractor if it was foreseeable, it could have been prevented but for the acts of the contractor, or it was caused by the negligence of the contractor.

5.4. Performance Period: The total proposed performance period for this requirement is 150 days. This includes all construction and closeout activities, such as punch-list items, final clean-up, and submission of deliverables (as-built drawings, O&M manuals, warranties, DD Form 1354, etc.). The government review time for as-built drawings, manuals, and warranties is 21 calendar days. After as-built drawings are approved, the government has 14 calendar days to return red-line drawings.

Therefore, civilian Contractor personnel are advised that at any time they place a call to, or receive a call from a USAF organization, they are subject to COMSEC procedures. The Contractor will assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees.

8.3. SECURITY DELAYS:

During performance of this subcontract the Contractor may encounter delays for security reasons. It is recommended that the Contractor inventory all tools, equipment, in and including vehicles, prior to commencing work, to reduce the delay times.
