SECTION C – STATEMENT OF WORK (SOW)
Background The National Transportation Safety Board is an independent federal agency charged by Congress with investigating every civil aviation accident in the United States and significant events in the other modes of transportation—railroad, transit, highway, marine, pipeline, and commercial space. We determine the probable causes of the accidents and events we investigate and issue safety recommendations aimed at preventing future occurrences.
In addition, we conduct transportation safety research studies and offer information and other assistance to family members and survivors for each accident or event we investigate.
We also serve as the appellate authority for enforcement actions involving aviation and mariner certificates issued by the Federal Aviation Administration (FAA) and US Coast Guard, and we adjudicate appeals of civil penalty actions taken by the FAA. The Office of Government Ethics (OGE) requires certain executive branch employees to file confidential financial disclosure reports (OGE Form 450). Each agency determines who must file a confidential financial disclosure report, based on criteria established by OGE. The NTSB’s Designated Agency Ethics Official (DAEO), in coordination with other agency ethics officials and human resources officials, determines the positions of agency employees who must file the OGE Form 450.
NTSB employees who are required to file an OGE Form 450 must submit a new entrant report within 30 days of assuming the duties of their position, unless an extension is granted. Thereafter, employees are required to file an OGE Form 450 on an annual basis. Employees required to file confidential reports currently submit a paper or pdf copy of the report with an agency ethics official. Ethics officials receive, review, and certify the reports, and store them securely in either paper or electronic format.
OGE regulations provide that the NTSB’s DAEO is responsible for determining whether the OGE Form 450 will be collected in an electronic or a paper format (5 C.F.R. § 2638.205.). In addition, OMB Memorandum M-19-21, Transition of Electronic Records, directs all Federal agencies to ensure that all Federal records are created, retained, and managed in electronic formats, with appropriate metadata. The General Counsel is the DAEO for the NTSB. The DAEO has determined that electronic filing of the OGE Form 450 is necessary to comply with OMB Memorandum M-19-21, and to manage the agency’s ethics program effectively and efficiently.
Scope of Work The NTSB has a need for Commercial Off the Shelf (COTS) software to manage the collection, review, certification, and storage of electronic OGE Form 450 reports. The contractor shall implement a COTS solution that meets all the requirements below:
• Be FedRAMP authorized and maintain the authorization throughout the period of performance.

Business Approach
2. Past Performance Quoters shall submit up to three (3) recent and relevant Contractor Performance Assessment Reporting System (CPARS) evaluations for contracts similar in scope, size, and complexity to this requirement. If a quoter does not have applicable CPARS evaluations, the quoter may submit up to three (3) customer references, letters of recommendation, or other documentation demonstrating relevant past performance.
The Government will evaluate the quality and relevance of a quoter’s past performance information. Quoters with positive, relevant past performance information may receive a higher rating under the Past Performance factor. Past performance information may include CPARS evaluations, customer references, letters of recommendation, or other relevant documentation.
A quoter will not be evaluated unfavorably solely because it does not have CPARS evaluations, customer recommendations, or other available past performance information. If a quoter does not have relevant past performance information, the Government will assign a neutral past performance assessment. The Government reserves the right to consider information obtained from CPARS and other available sources in evaluating past performance.
3. Price Quoters shall submit a firm-fixed-price for Tables 1 through 6 located in Section B. Failure to provide complete pricing information may result in the quote being deemed unacceptable and the quoter not being considered for award.
The pricing information provided in Section B, Tables 1 through 5, will be incorporated into any resulting purchase order.
For evaluation purposes, quoters shall complete Table 6 in Section B. The NTSB will use the total price provided in Table 6, Section B, for price evaluation purposes and comparison against competitive offers received in response to this RFQ. The Government will evaluate quoted prices for reasonableness and consistency with the requirements of this RFQ.
RFQ: 9531BM26F0039, OGE 450 Software, Page 9 of 10
SECTION M – EVALUATION FACTORS FOR AWARD
Basis for Award The Government intends to award one (1) firm fixed price (FFP) Purchase Order (PO) to the responsible Contractor whose proposal conforms to the RFP, will be most advantageous to the Government, price and other price factors considered, such that it provides the best value to the Government. Best value is defined as the procurement process that results in the most advantageous acquisition decision for the Government that is performed through an integrated assessment and trade-off analysis between price and non-price factors.
The Government reserves the right to reject any or all Quotes if such action is in the public interest. Under a best value procurement, the NTSB may reasonably determine that the superior capability merits a higher price. The NTSB may also reasonably determine that the Quoter with other than the highest capability in non-price factors is the best value.
The Government may waive informalities and minor irregularities in Quotes. The Government reserves the right to award without discussions. Quoters are cautioned that they must submit the best quote with the initial quote.
Evaluation Process The following factors will be evaluated by the Government:
QUOTATION PART # FACTORS TITLE
I Technical Approach 1 Technical Approach II Business Approach 2 Past Performance II 3 Price
The NTSB will evaluate the above factors for each quoter as well as conduct a comparative evaluation of quotes in accordance with FAR 13.106-2 Evaluation of quotations or offers to determine the Quoter that represents the best value to the NTSB. Except when it is determined in accordance with FAR 17.206(b) not to be in the government’s best interests, the government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Contractor shall add the total estimated base year and option year prices and submit the total estimated value in Table #6 of the Attachment. This includes options under FAR clause 52.217-8, Option to Extend Services, which applies to the solicitation. Evaluation of options under FAR 52.217-7 will be accomplished by using the prices offered for the last option period to determine the price for a 6-month option period, which will be added to the base and other option years to arrive at the total price. Evaluation of options will not obligate the government to exercise the options(s). Price will be evaluated by adding together the price of all items in Table #1-5. In order to be eligible for award, pricing quoted must be determined to be fair and reasonable.
The Government will evaluate quotations using a best-value tradeoff process. Technical Approach is the most important evaluation factor, followed by Past Performance. Price is the least important evaluation factor. When combined, the non-price factors (Technical Approach and Past Performance) are significantly more important than Price. However, as quotations become more equal under the non-price factors, Price will become increasingly important in the award decision.
Technical Approach
1. Evaluation Factor 1: Technical Approach The Government will evaluate the quoter’s Technical Approach to determine the extent to which the quotation demonstrates a clear understanding of the requirements and provides a sound, realistic, and effective approach to successfully accomplish the objectives of this requirement.
The Government will assess the quality and completeness of the quoter’s proposed approach, including the quoter’s understanding of the Statement of Work (SOW), proposed methodology for performing the required services, ability to meet required performance objectives, and the extent to which the approach demonstrates the likelihood of successful contract performance.
The Government will consider the degree to which the proposed Technical Approach is feasible, practical, and demonstrates the quoter’s ability to provide the required services within the required timeframe and performance
RFQ: 9531BM26F0039, OGE 450 Software, Page 10 of 10 standards. The Government may consider strengths, weaknesses, significant weaknesses, and deficiencies identified in the Technical Approach when making its evaluation.
The Government will conduct a comparative evaluation of quotations to determine the relative strengths and weaknesses of each quoter’s Technical Approach. The Government will consider the differences among quotations under this factor, as well as the significance of those differences, in making the best-value determination.
Technical Approach is the most important evaluation factor. The Government will evaluate Technical Approach in conjunction with Past Performance and Price to determine the quotation that represents the best value to the NTSB.
Business Approach
2. Evaluation Factor 2: Past Performance The Government will evaluate the quoter’s demonstrated record of relevant and successful performance on contracts similar in scope, size, and complexity to this requirement. The Government will consider the quality, relevancy, and recency of the quoter’s past performance information, including CPARS evaluations, customer references, letters of recommendation, or other available documentation.
The Government will assess the extent to which the quoter has demonstrated the ability to successfully perform comparable requirements, meet contractual obligations, provide quality services, and maintain effective customer relationships.
Quoters with positive, relevant past performance information may receive a higher assessment under this factor. A quoter will not be evaluated unfavorably solely because it lacks past performance information. If a quoter does not have relevant past performance information, the Government will assign a neutral assessment.
The Government may also consider past performance information obtained from other sources, including other Government records, in evaluating this factor.
Acceptable/Unacceptable/Neutral Ratings for Factor 2
RATING ADJECTIVAL DESCRIPTION
Acceptable The Contractor has a record of providing adequate service. The Contractor provides personnel of professional character and provides adequate quality control and overall management of the project.
Unacceptable The Contractor has a record of providing inadequate service. The Contractor provides inadequate quality control and overall management of the project. The Contractor is not recommended and would not be awarded another contract by reviewer.
Neutral No reference provided or unable to reach point of contact.
3. Evaluation Factor 3: Price Price will be evaluated for reasonableness and fairness based on the total firm-fixed-price quoted by each quoter. The Government will compare quoted prices received in response to this RFQ to determine price competitiveness and will consider whether the proposed price is consistent with the requirements of this solicitation.
Price will not be assigned a separate rating or score. Rather, price will be considered as part of the Government’s overall best-value tradeoff determination. While the Technical Approach and Past Performance factors are more important than Price, the importance of Price will increase as the differences among quotations under the non-price factors become less significant.
