The contractor must obtain Maryland Department of Agriculture pesticide applicator certification and comply with all federal, state, county, and municipal regulations.
The contract period consists of one twelve-month base period (September 1, 2026 through August 31, 2027) with four optional twelve-month extension periods through August 31, 2031. The contractor shall furnish an on-site supervisor with authority to represent the contractor and attend pre-work meetings and performance evaluations. Optional tasks include unscheduled maintenance, emergency on-call snow removal (with two-hour response requirement), and specialized services for blizzard conditions (16+ inches accumulation within 24 hours). The contractor is responsible for up to 20 inches of seasonal snowfall; additional snowfall beyond this threshold may be billed at pre-defined rates with documented measurement photos and timestamps. Performance Requirements Summary establishes surveillance through periodic and 100% inspections, allowing one complaint/discrepancy per season for most landscaping tasks and zero deficiencies for snow/ice removal and optional tasks. Non-conforming services must be corrected during the first business day after identification, with remedies ranging from re-performance at no additional cost to contract termination for cause.

PERFORMANCE WORK STATEMENT
COLUMBIA CAMPUS LAWN CARE MAINTENANCE
CAMPUS SNOW AND ICE REMOVAL SERVICES
Federal Communications Commission (FCC) Columbia Campus Howard County, Maryland
1. GENERAL INFORMATION:
1.1. Description of Services:
This is a non-personal commercial services purchase order to manage and maintain lawns, specific areas, and landscaping along with snow and ice removal services at the FCC Columbia Campus. Performance shall be according to the standards herein. The contractor shall perform to standards in the contract and comply with all local, state, and federal regulations during the service performed. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the work as defined within this Performance Work Statement (PWS).
1.2. Background:
The FCC Columbia Campus is comprised of four distinct geographical areas (see Place of Performance under Section 6). These areas require regular grounds maintenance activities including trees, shrubs, plant maintenance and leaf/debris/stick removal along with snow and ice removal. These areas are used by visitors as well as employees and contractors of the FCC.
Grounds maintenance is required to keep these areas safe, accessible, and in a state of good maintenance befitting a facility managed by the FCC.
Grounds maintenance activities required by this contract will occur throughout the year. Some activities will be seasonal in nature or occur irregularly. Columbia Campus grounds must remain free of debris, overgrown vegetation, and snow and ice to provide a safe site for visitors and employees.
2. DEFINITIONS
Throughout this PWS, terms are defined as follows:
Contracting Officer (CO): The Government employee who is authorized to enter into, administer, and/or terminate contracts and make related determinations and findings.
Contracting Officer's Representative (COR): An individual designated in accordance with subsection 1.602-2 of the Federal Acquisition Regulation (FAR) and authorized in writing by the contracting officer to perform specific technical or administrative functions. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.
Columbia Campus: The destination of FCC Campus in Columbia, MD, where the contract is to take place.
Contractor's On-Site Supervisor: An employee of the Contractor who is a Supervisor who shall be located on the project grounds to continually oversee the work at the time it is being performed, and who shall have authority to represent the Contractor in dealing with the Government, and all subcontractors. The Supervisor shall attend the pre-work meeting, all performance evaluation meetings, and be physically on site when any work is being done. The On-Site Supervisor may also be the person who does the work, but they must have the above-mentioned authority.
3. GOVERNMENT WILL FURNISH
None.
4. CONTRACTOR WILL FURNISH
4.1. General:
The Contractor shall furnish all equipment, repair parts, and supplies, to manage and maintain the grounds and landscaping along with manage snow and ice removal according to the standards set herein. The Contractor shall be required to bring to, and remove from the campus, that equipment and materials needed to perform the work involved in this contract. No on-site storage of any kind is available. The Government shall not be responsible for the protection of contractor equipment.
In addition to any items specified in the Tasks and Requirements sections of this contract, the following constitutes a partial listing of items the Contractor shall be required to furnish:
a. Grass seed and/or sod
b. Fertilizer
c. Soil amendments, mulches, topsoil, bark chips
d. Petroleum, oil, and lubricants
e. Trucks and trailers for transporting equipment and materials
f. Hand tools
g. Hand-operated, power-driven equipment
h. Equipment repair parts
1. Personnel clothing, safety equipment J. Road or de-icing salt, asphalt and concrete safe
4.2. Permits and Responsibilities:
The Contractor shall be responsible for obtaining all necessary licenses and permits, and for complying with any applicable Federal, State, County, and Municipal laws, codes, and regulations, in connection with the services of the work within this requirement.
The Contractor shall provide the FCC with a copy of their Maryland Department of Agriculture (MDA) Pesticide Applicator/Business license and certification for the categories applicable to the herbicide applications authorized in the PWS (e.g., treatment of weeds in sidewalks, asphalt areas, and the gravel antenna field).
4.3. Public Safety:
The Contractor shall maintain the public use areas to provide the best possible conditions for safe use by visitors. All areas in which the contractor performs work will be marked or signed in such a manner that any person entering the area will be aware of work being done in the vicinity.
4.4. Lost and Found:
It is the responsibility of the Contractor to instruct his employees that all articles of possible personal or monetary value found by the Contractor's employees must immediately be turned into the Contracting Officer Representative (COR) or other government designated person.
4.5. Pre-work Meeting:
The CO will schedule a meeting with the contractor within 5 business days following the contract award to discuss the requirements of the contract. At the pre-work meeting, the Contractor shall submit, in writing, for approval of the COR, the following items:
a. List of employees who will be working for the Contractor at the FCC location
b. Full Name, address, and telephone number of an authorized supervisor
c. Description of uniform and vehicle emblem
d. Work schedule for the first month of the contract
e. List of all subcontractors employed to perform specifications of the contract. This list includes all license numbers, expiration dates, etc.
f. Insurance Certificates
g. Contractor's Abbreviated Accident Prevention Plan (AAPP)
4.6. Other Personnel:
The Contractor shall furnish supervisory, administrative, and direct personnel to accomplish all work required.
5. PERIOD OF PERFORMANCE:
The period of performance shall be for one (1), twelve (12) month base period and four (4) twelve (12) month option periods. Options shall be exercised at the discretion of the Government.

6. PLACE OF PERFORMANCE:
The services specified by this task order shall be performed at the areas outlined in the Technical Exhibits. Refer to Technical Exhibit 1 for an ariel overview of the Columbia Campus building locations.
6.1. Lawn Maintenance Areas (Refer to Technical Exhibits 2 and 3):
a. Area #1 - HFDF Center located at 9200-9201 Farmhouse Lane, Columbia, MD 21046
a. Area #2 -FCC Laboratory located at 7435 Oakland Mills Road, Columbia, MD 21046
b. Area #3 - FCC Laboratory - Side Lot located adjacent to 9200 Farmhouse Lane, Columbia MD 21046
c. Area #4 - Back Fields surrounding 9200-9201 Farmhouse Lane, Columbia, MD 21046
6.2. Snow and Ice Removal (Refer to Technical Exhibit 4):
Snow and Ice Removal shall be performed at the following locations to include the roadways, parking lots, sideways, and snow removal around the garbage dumpsters.
a. HFDF Center located at 9200-9201 Farmhouse Lane, Columbia, MD 21046
b. Public Safety Parking lot adjacent to Farmhouse Lane in front of HFDF Center located at
9201 Farmhouse Lane, Columbia MD, 21046
c. Laboratory located at 7435 Oakland Mills Road, Columbia MD, 21046
d. Laboratory Parking areas in front of and behind the Laboratory Building located at 7435

e. EB Garage behind the Laboratory Building located at 7435 Oakland Mills Road, Columbia, MD 21046
f. Entry Point, Gate Access Pedestal, Gate House, and parking space adjacent to Gate

7. HOURS OF OPERATION:
7.1. Lawn Maintenance
All lawn maintenance care shall be completed Monday through Friday during the regular business hours from 8:00 a.m. to 4:30 p.m. Eastern Time (ET), excluding all federal holidays and building closings. All activity is limited to these business hours unless approved in writing by the COR. Activities must be during the mowing season, which is April 1st - November 30th.
7.2 Snow and Ice Removal
During the hours outlined in Table 3 (Snow and Ice Removal Schedule) below. Snow and ice removal service shall be the responsibility of the Contractor and shall commence when an accumulation of two (2) inches of snow or an accumulation of one-half (.5) inches of mixed snow/sleet/freezing rain, as measured on the parking lot and road surfaces, has fallen or when unsafe conditions, including icing, exist in the Columbia, Maryland.
8. MAINTENANCE SERVICE SCHEDULE
8.1. MOWING SCHEDULE:
The mowing season is from April to November for each period of this task order. The contractor shall not bill for services outside of the mowing season. The mowing schedule for all areas are listed below:

*During every April and November, the Contractor shall perform bi-annual tree pruning of the magnolia suckers (as needed), leaf and debris removal around the laboratory building, flower beds, shrubs, tree rings, and cracks alongside the curb.
8.2. SNOW AND ICE REMOVAL SCHEDULE:
Contractor shall provide snow and ice removal services in such a manner that the below listed roadways and facilities (see Table 2 - Snow and Ice Removal Schedule) are clear of snow accumulation over two (2) inches and treated for ice accumulation of more than 0.01 inches during the below listed times. Note that Lab Parking includes the pathways to the dock areas and trash containers.

9. SPECIFIC LANDSCAPING TASKS
AND REQUIREMENTS
The Contractor shall provide the services for maintaining grounds and landscaping as listed below. No landscaping work shall be performed on Federal Holidays or on weekends without the prior approval of the COR.
In conjunction with grass cutting, areas around the structures and headstones shall be trimmed.
Walks and roadways shall be cleared of all trimmings and debris. The contractor must exercise caution near buildings and other structures, ensuring that any equipment discharge is directed away from them. The Contractor shall be responsible for all repairs or replacement items which have been damaged during groundskeeping operations, including but not limited to, irrigation systems, damaged lawn areas, signs, structures, etc.
9.1. GRASS CUTTING-AREA 1: HFDF CENTER:
The lawn grass shall be maintained at a uniform blade height of not more than three and one half (3.5") inches and according to the mowing schedule outlined in Table 2 above. (See Technical Exhibit 2 -All Mowing Areas Ariel View.)
The roadsides along Farmhouse Lane (outside the black fence) shall be cut to a width of 8-10 feet from the black fence up to the entrance gate (approximately 1/4 mile). (See Technical Exhibit 3 - Mowing Area 1 Ariel View).
Mowing/Lot Cleanup: The Contractor shall:
a. Ensure grass is cut once per week and is maintained at heights indicated in Table 2.
b. Ensure all clippings will be removed from mulch beds, sidewalks, curbs, roadways and other saved areas at each mowing.
c. Use care so that trees, shrubs, buildings and signs are not damaged.
d. Perform string line trimming around trees, shrubs, buildings and signs in conjunction with each mowing, as needed. The use of herbicides around the perimeter of FCC buildings is NOT authorized.
e. Edge curbs and sidewalks in conjunction with each mowing.
9.2. GRASS CUTTING - AREA 2: FCC LABORATORY:
The lawn grass shall be maintained at a uniform blade height of not more than three and one half (3.5") inches and according to the mowing schedule outlined in Table 2. (See Technical Exhibit 2
- All Mowing Areas Ariel View.)
Mowing/Lot Cleanup: The Contractor shall:
a. Ensure grass is cut once per week and is maintained at heights indicated in Table 2.
b. Ensure all clippings will be removed from mulch beds, sidewalks, curbs, roadways and other saved areas at each mowing.
c. Use care so that trees, shrubs, buildings and signs are not damaged.
d. Perform string line trimming around trees, shrubs, buildings and signs in conjunction with each mowing, as needed. The use of herbicides around the perimeter of FCC buildings is NOT authorized.
e. Edge curbs and sidewalks in conjunction with each mowing.
9.3. GRASS CUTTING - AREA 3: FCC LABORATORY - SIDE LOT
The lawn grass shall be cut at a uniform blade height of not more than six (6") inches and according to the mowing schedule outlined in Table 2 above. (See Technical Exhibit 2 - All Mowing Areas Ariel View.)
9.4. GRASS CUTTING -AREA 4: BACK FIELD MOWING
The lawn grass shall be cut at a uniform blade height of not more than six (6") inches and according to the mowing schedule outlined in Table 2 above. (See Technical Exhibit 2 - All Mowing Areas Ariel View.) Trimming around the antenna poles shall be completed in conjunction with each mowing.
9.5. MULCH HARDSCAPES, WALKWAYS, AND ASPHALT
WEEDING:
Remove all weeds from the mulch hardscape, walkways, pavers and cracks alongside the curb.
Remove all weeds growing within the mulch zone, outlined in Technical Exhibit 4 - Laboratory Ariel View with Dimensions and Mulch Beds and around the front mulch bed at the FCC Farmhouse, one (1) time annually during the mowing season by spraying weeds located in sidewalks and hand-pulling weeds within the mulch beds. Remove all weeds from asphalt and sidewalk areas, two (2) times during mowing season, by spraying weeds located in sidewalks and asphalt areas.
Remove all weeds, two (2) times during mowing season, and spray the gravel area of Antenna Field and gravel lane leading to it (see Technical Exhibit 1). The gravel area is approximately 118 feet x 118 feet and the gravel lane is approximately 10 feet x 300 feet. Care shall be taken to avoid any damage to the equipment located there. Commercially available products containing active ingredients like Glyphosate are acceptable, but the contractor must take appropriate precautions. In particular, the contractor shall take the following precautions when administering any weed treatment.
• Do not spray directly on the antennas
• Avoid spraying on windy days as the spray may go on the antennas
• Spray all the gravel areas and at the edges of the concrete antenna pads as outlined in
Technical Exhibit 1
• Do not spray too close to the antenna pedestals as there are several boxes mounted on them with sensitive equipment inside
9.6. MULCH HARDSCAPES ANNUAL MAINTENANCE
The Contractor shall uniformly apply double shred hardwood mulch to all mulch beds as required to maintain a minimum depth of three (3) inches. The mulch beds include those outlined in Technical Exhibit 4 - Laboratory Ariel View with Dimensions and Mulch Beds and the ones at Farmhouse building. The FCC Laboratory currently has approximately 3,235 square feet (SF) of mulch beds. The Farmhouse has approximately 400 square feet (SF) of mulch beds. All mulch areas are to be cultivated annually. Mulch shall be kept off plants and walkways. The Contractor shall remove grass and weeds prior to the mulch application and keep mulch out of the crowns of shrubs and off buildings, sidewalks, light standards, and turf. Existing mulch shall be cultivated (raked) and kept free of soil, debris, and weeds.
9.7. FALL/SPRING PICK-UP AND CLEARING
Twice per year, in the spring and fall, the Contactor shall perform tree, shrub, and plant maintenance along with leaf/debris/stick removal around all the Columbia, MD building structures outlined in Table 2 and Technical Exhibit 1 - Columbia Campus Ariel View with Buildings.
9.8. TREE MAINTENANCE
The Contractor shall maintain all trees in accordance with all the applicable recognized industry standards. The site directly around the FCC Laboratory has approximately fifteen (15) mature trees that are included in this effort. Services shall also include the removal of magnolia suckers from all magnolia trees in the spring and fall season. Trees must be trimmed such that no limbs or other tree vegetation is within four (4) feet of Laboratory facility.
9.9. SHRUB MAINTENANCE
The Contractor shall maintain all bushes, shrubs, hedges, etc. in accordance with all the applicable recognized industry standards. The Contractor shall trim, brush, and prune all bushes, hedges, and shrubs directly around all the buildings outlined in Table 2 and Technical Exhibit 1 - Columbia Campus Ariel View with Buildings.
9.10. LEAF REMOVAL
The Contractor shall perform leaf removal operations around the Columbia, MD locations buildings during fall and spring seasons or as otherwise required by when trees start and complete dropping their leaves. This shall include removal of all debris within twenty-five (25) feet of all structures and buildings outlined in Table 2 and Technical Exhibit 1 - Columbia Campus Ariel View with Buildings. Leaf and debris removal shall occur around the building, flower beds, shrubs, tree rings, cracks alongside the curb and the rooftop. While performing this action the Contractor shall rake, clean and remove leaves from around every building.
10. SPECIFIC SNOW AND ICE
REMOVAL REQUIREMENTS AND
TASK(S):
10.1. SEASONAL SNOWFALL MEASUREMENTS AND
ADDITIONAL BILLING:
The Contractor is responsible for all snow and ice removal services up to a cumulative seasonal total of 20 inches. If seasonal snowfall exceeds 20 inches, the Contractor shall continue providing snow and ice removal services without interruption and may bill the Government at the pre-defined rates established in the contract. For any additional billing to be accepted by the Government, the Contractor must meet the following requirements:
• Contractor shall measure seasonal snowfall accumulation using a ruler placed in the snow after the bulk of each snowfall has ended
• Photos of these measurements must be taken, with a timestamp applied, and provided to the COR upon request
• Seasonal snowfall accumulation measurements must represent actual fallen snow and exclude drifting or blowing snow after the initial event
• Contract shall submit evidence, to include snowfall measurement pictures with timestamps, service dates, and accumulation details as part of the billing for any work performed beyond the 20-inch threshold
• Billing shall be submitted to the Government at the pre-defined rates established in the contract (see Unscheduled Services Pricing Sheet)
10.2. DRIVEWAY (See Technical Exhibit 5):
Start outside the front gate (gate path must be clear of snow and ice to allow for smooth operation). Clear the Entry Point to include areas around the gate, gate access pedestal, gate house, and gate house adjacent parking space. Clear the roadway to front parking lot; clear all parking spaces; clear around the flagpole and back out to main roadway. Continue around to the back of lab building to intersection of Farmhouse Lane.
10.3. FARMHOUSE LANE (See Technical Exhibit 5):
Starting from the gate along Oakland Mills Rd past the driveway down towards the Farmhouse building; in the gate; around the circle and a single lane path in front of the three-car garage behind the Farmhouse Building.
10.4. PUBLIC SAFETY PARKING (See Technical Exhibit 5)
Remove snow and ice in the parking spaces along farmhouse lane in front of the Public Safety HFDF Center.
10.5. PUBLIC SAFETY HFDF CENTER (See Technical Exhibit 5):
Clear Farmhouse Lane, starting from the adjoining access road, down towards the Farmhouse building; in the gate; parking lots at 9201 Farmhouse Lane; around the circle. These areas are to be treated with salt, calcium chloride or sand as necessary. These areas include addresses 9200 and 9201 Farmhouse Lane.
10.6. LAB PARKING LOT (See Technical Exhibit 5)
Remove snow and ice from the back-parking lot; all parking spaces; the area in front of the garage and large back building behind the Lab. Plow both loading dock areas (snow must be pushed out rather than pushed in to allow trucks to get to loading dock plate); access roadway going to Farmhouse Lane. These areas are to be treated with salt, calcium chloride and/or sand.
10.7. SHOVELING:
All stairs, porches, walkways and landings shall be cleared of snow and then treated with salt or calcium chloride to prevent further accumulation. These areas include:
10.7.1. Laboratory: Front sidewalk, steps and top landing, back sidewalk and sidewalk on the north side of building.
10.7.2. HFDF Center: At 9201 Farmhouse Lane, clear the front doorstep, the side ramp walkway (all the way to the back of the building in front of the roll up door), and the steps on the side of the building.
10.8. SALT TREATMENT:
Salt treatments shall commence when there has been an ice event such as an ice storm, sleet, or freezing rain with an accumulation on the roadways or sidewalks. The salt treatment shall include all roadways, parking lots, stairs, walkways, porches, and landings.
Salt treatments include treatments done prior to the storm, during the storm, following a storm, after a refreeze. Salt shall not be used where it will cause damage to concrete, brick, wood, etc.
calcium chloride or other acceptable materials shall be used.
10.9. MISCELLANEOUS:
The Contractor may be recalled to clear short sections of the road in the event of snow drifting.
Care shall be taken not to pile snow in front of areas where FCC access is required, such as, in front of the dumpsters, parked vehicles, garages, sheds, loading docks, bay doors, or mailboxes.
After-hours facility access information will be provided to the contractor by the FCC staff prior to the first snowfall.
The FCC will not be responsible for any equipment that contractor may choose to store on the property. Any property furnished by the Contractor that is left behind must be approved by the COR before the Contractor leaves the property.
Contractor shall be responsible for repair of any major damage to grass, blacktop or any other FCC Property, because of the snow removal process. Major damage will be defined as any grass patch larger than 9-square feet or blacktop patch larger than 4-square feet.
11. OPTIONAL TASK(S):
At the Government's discretion during any performance period, but only upon the Contracting Officer's (CO) written authorization to proceed, the Contractor shall provide unscheduled maintenance/special events services. These services do not include services required under any other Section of this PWS. This optional work may be directed on a labor-hour basis, within the ceiling established under this contract or may be performed on a Firm Fixed Price basis agreed upon in a bilateral modification. The ceiling value represents the FCC's maximum financial liability. All work performed beyond the ceiling amount is at Contractor's own risk.
The vendor shall quote labor rates for all unscheduled services outlined in the PWS (see Unscheduled Services Pricing Sheet for list of potential tasks). Snow removal, as defined under Section 11.4, Blizzard Conditions, shall continue and be billed at the quoted labor rate. Other Optional Task(s) will be performed when approved by the Contracting Officer’s Representative (COR) and billed at the quoted labor rate. Non-emergency Optional Tasks (such as tree removal) will be quoted by the vendor and approved via a modification to the contract prior to commencement of work. All such services shall adhere to the pricing and approval protocols established herein.
11.1. UNSCHEDULED MAINTENANCE/SPECIAL EVENT:
The Contractor shall walk the perimeter around the fence annually with the COR or other designee to identify areas where trees and/or other vegetation are damaging, or potential will damage, the perimeter fence. An estimate for the cost of identified issues will be expected within five (5) business days of identifying issues. Remediation tasks may include tree removal, clearing brush and other vegetation, spraying to kill vegetation along perimeter fencing, etc.
Contractor shall respond to the COR within 24 hours after being notified of tree or vegetation issues that are impacting the integrity of the perimeter fence, roadways, and or ground.
11.2. EMERGENCY "ON-CALL" SNOW AND ICE REMOVAL:
The Columbia site may be active at undetermined times for emergency related activities. If services are required outside of date/times outlined in this contract, emergency services may be requested. It is required that the vendor arrives on-site within two (2) hours of the initial emergency call, which would be outside days/times outlined in this contract.
This service will be required to clear roadways for employee shift changes and/or departure (e.g., clear additional snow accumulation and/or drifting). This service will consist of a pass from the Oakland Mills Road Gate at the guard shack, continuing through rear laboratory parking lot, the adjoining access road, down Farmhouse Lane, and through HFDF and Farmhouse parking lots.
This is only to keep one lane minimally passable for HFDF Staff access.
Failure to respond to "on call" requests as specified by the terms above may result in written notice, deduction/withholding payment or termination for default.
11.3. OTHER EMERGENCY SNOW AND ICE REMOVAL:
It is unlikely but not impossible that the government will require snow and ice removal services to other locations on campus and/or during times not covered under this scope of work. This work may include services around the farmhouse and garages behind the farmhouse.
11.4. BLIZZARD CONDITIONS:
Any single snowstorm or combination of storms, within 24 hours of the first storm, having total accumulations of sixteen (16) inches or more may require specialized equipment and subcontracted operators.
The government may also require emergency services for blowing snow.
12. REPORTING REQUIREMENTS
Monthly reporting shall be provided to the CO and COR electronically via email outlining the details of work performed during the previous month. Reports should include pictures of work performed as well as the date and time.
For Snow Removal, the contractor will report to the COR (email or other agreed upon method) when visiting the site. At the completion of each visit, the contractor shall report, electronically or through other agreed upon methods, to the COR the work accomplished with photos of roadways/parking lots/sidewalks of areas before and after activities. The Contractor shall take pictures of a ruler in the snow after the bulk of accumulating snowfall has finished and provide documentation to the COR when requested.
13. PERFORMANCE REQUIREMENTS SUMMARY
13.1. Performance Requirements Summary:
To ensure that the Government receives the services for which it contracted, the Government will only pay for services received. The Performance Requirements Summary (PRS) determines if the Contractor meets the performance standards of the contract, as well as provides guidelines for how and when surveillance will be performed. It ensures timeliness, effectiveness and that the Contractor is delivering the results specified in the contract. Government contract quality assurance will be performed per the PRS surveillance schedule.
13.2. Performance Requirements Summary Table (PRS):
The PRS is a listing of significant performance objectives with associated performance standards that will be monitored and inspected by Government personnel. Each performance objective represents a critical function as identified by the Government at the time of contract award. The performance standard represents the minimum acceptable level of Contractor performance. The performance objectives and standards represent only the critical components of this Contract, and do not excuse the Contractor from performance of other responsibilities identified in the
PWS. All services described in this PWS are subject to inspection/surveillance by the Government.

Snow and ice are removed and do not accumulate. Paved areas are safe for vehicle or pedestrian traffic intended. Areas have adequate de-icing material for the conditions.
10.11 - Snow and Ice Removal
Repair Damaged Areas.
The contractor shall be responsible for repairing all areas damaged by the contractor's vehicles, equipment, or personnel.
Damaged areas shall be repaired to meet the appearance of the surrounding area at no cost to the government.
Work required is satisfactorily completed 100% of the time.
11 - Optional Tasks - Emergency Service

13.3. Surveillance:
Periodic and 100% inspections by the COR or other designee will serve as surveillance methods.
If the COR discovers deficiencies and/or receives complaints, the COR will alert them to the contractor for correction.
13.4. Quality Control:
The Contractor, not the government, is responsible for quality control actions necessary to meet the quality standards set forth by the contract. The Government reserves the right under the Contract Terms and Conditions-Commercial Items (FAR 52.212-4) to inspect and test the services called for by the contract, to an extent practicable at times and places outlined in this contract and during the term of the contract. The Government will reject non-conforming services.
13.5. Unacceptable Performance:
When performance is determined to be unacceptable, as defined in the Performance Requirements Summary, the COR will inform the contractor that performance is unacceptable and provide written documentation. By initialing and dating the documentation, the contractor is only acknowledging notification of unacceptable performance. Disputes in surveillance should be referred to the Contracting Officer for resolution.
The COR will notify the Contracting Officer of unacceptable performance. If any of the services do not conform to contract requirements, the Government may require the contractor to perform the services again in conformity with contract requirements, with no increase in contract amount.
When the defect(s) in services cannot be corrected by re-performance, the Government may:
a. Require the Contractor to take necessary action to ensure future performance conforms to contract requirements.
b. Reduce the contract price to reflect the reduced value of the services performed.
c. If the Contractor fails to promptly re-perform the services, or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may:
1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service
2) Issue Cure Notice
3) Terminate the contract for Government convenience
4) Terminate the contract for Cause
13.6. Correction of Non-Performance of Work:
The Contractor shall employ an adequate quantity of personnel to ensure that any services found to be not in compliance and therefore not acceptable, shall be made acceptable by the performance or re-performance of the work, where such re-performance is possible, during the first business day after non-compliance has been observed by or reported to and verified by the
COR.
