Project No. 460-22-700 EHRM Infrastructure Upgrades

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) for Other Than Full and Open Competition

Acquisition Plan Action ID: 36C776-25-AP-1210

1. Contracting Activity:

Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC) The proposed procurement, Request for Proposal (RFP) 36C776-25-AP-1210, is for the EHRM Infrastructure Upgrades Construction project at the Wilmington VA Medical Center (VAMC) in Wilmington, Delaware.

2. Nature and/or Description of the Action Being Processed:

This justification is to support the EHRM Infrastructure Upgrades Construction project at the Wilmington VAMC, that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials.

The use of a particular brand name for the items listed below accommodate standardization of these items throughout the facility.

a. Security camera and monitoring system

i. Avigilon

b. Physical security access control system

i. Bosch, Lenel On Guard.

C. Facility BAS System

i. Johnson Controls International- Metasys Building Automation and HVAC

Control Systems

d. Fire Alarm System

i. Notifier- Honeywell

e. Locksets and Cores

i. Best Locksets and Cores with SFIC 7- pin cores

3. Description of Supplies/Services Required to Meet the Agency's Needs:

This procurement is for the EHRM Infrastructure Upgrades Construction project at the Wilmington. VAMC. The scope includes everything necessary to complete the EHRM Infrastructure Upgrades Construction project that meets the requirements of the Department of Veterans Affairs. There are five (5) brand name items listed for which the VA is not able to accept equal or alternate items. The value of the items are listed below. The V AAR Construction magnitude for the entire project is between $20,000,000 and $50,000,000.

a. Security camera and monitoring system

iii. Description: Complete installation, programming, and licensing of digital video capture and recording equipment matching existing installed system to ensure and maintain proper operation of the video surveillance system in the data center and TR rooms.

b. Physical security access control system and Intrusion Detection

i. Bosch, Lenel On Guard.

iii. Description: Complete installation and programming of card readers and communication components matching existing installed system to ensure and maintain proper operation of the existing physical access control system (PACS). Safeguarding access to the new data center and TR rooms of the medical center to only authorized personnel only.

C. Facility BAS System

i. Johnson Controls International- Metasys Building Automation and HVAC

ii. Value:

iii. Description: omplete installation and programming of the BAS system to match the existing installed system to ensure and maintain proper operation of existing BAS system. These controls are required for a 100% fully compatible HVAC control system. Johnson Controls is contracted to maintain and monitor the facility wide BAS system.

d. Fire Alarm System

iii. Description: Complete installation and programming of fire alarm initiating and notification appliances in the data center and TR rooms matching existing installed system to ensure and maintain proper operation of the existing fire alarm system.

e. Locksets and Cores

i. Best- Locksets and Cores with SFIC 7- pin cores.

ii. Value: 1111111111

iii. Description: Complete installation of locksets and cores in the data center and TR rooms in buildings to match existing installed locksets and cores to ensure and maintain proper standard products used throughout the facility.

4. Statutory Authority Permitting Other than Full and Open Competition:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( ) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

These items have been standardized throughout the Wilmington VAMC, and are considered essential. Installing a different manufacturers' systems will create significant duplication in costs for the government that is not expected to be recovered through competition, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:

a. Security camera and monitoring system

i. Avigilon

ii. Impact: Any other devices and equipment not of the existing manufacturer will not provide correct interface and operability with existing monitoring, recording, and control equipment. The video surveillance system is crucial for safeguarding patients, visitors, staff, and the facility against unlawful and unauthorized activities. Modifications of the existing system without the correct original equipment manufacturer (OEM) components and service will compromise the integrity of the entire system. The installation and maintenance of the new system has to be performed by Securitas who has a maintenance and service contract with the facility.

b. Physical security access control system (PACS)

i. Bosch, Lenel Onguard.

ii. Impact: Any other devices and equipment not of the existing manufacturer will not provide correct interface and operability with existing PACS. The PACS is vital for authorized personnel to access key areas to provide direct patient care and safeguard critical operations of the facility. Modifications of the existing without the correct OEM components and service will compromise the integrity of the entire system. The Bosch, Lenel Onguard is used on all nine (9) campus buildings including four (4) CBOCs. Every PIV reader and Security panel is on these systems including access to every data/ telecom closet. The Bosch, Lenel Onguard has approved access to the VA system and any new security and intrusion system would have to be approved in the VA TRM process, which is a lengthy and specific process that would impact the construction schedule and add additional cost, Any new system would not interface with the current system. The cost to install the current Bosch/ Lenel Onguard only represents 0.005% of the total construction cost, but adding another standalone system would present a significant cost in time, security controls and money. Additional PIV cards would have to be issued to all employees. All these costs would be more than the 0.005% of the cost of the Bosch Lenel Onguard. The installation and maintenance of the new system has to be performed by Securitas who has a maintenance and service contract with the facility. Any additional system would also require a service agreement and would introduce additional vendors who would require access to the VA system security and privacy controls. When current service contracts need to be renewed, all vendors who are approved for the specific system are allowed to provide a proposal.

c. Facility BAS (Building Automation) System

i. Johnson Controls International, Metasys Building Automation and HVAC

Control Systems.

ii. Impact: Any other devices and equipment not of the existing manufacturer will not provide correct interface and operability with the existing BAS system.

All nine (9) campus buildings including the main building of 11 floors HVAC system are controlled by the BAS. There are two (2) HVAC technicians trained and certified in the operation of this system. Introducing another system for the one building (existing data center) and project data/ telecom rooms, would require new controls, and completely new software. The software needed for a new system would have to go through the VA TRM process and be approved. This is a lengthy process and would result in additional time and costs to the project. The HVAC technicians would need to have training in this system. A separate service agreement for this one system would need to in place. The cost of this compared to the cost of adding on to the existing system (1.29% of construction cost) would be a waste of taxpayer money to duplicate a new system. These control systems

Factory trained and authorized service must be located and supported by OEM within a limited travel time to provide emergency service support. The vendor’s service personnel would also need to have access to the VA system and would need to meet security and privacy controls.

d. Fire alarm system

i. Notifier- Honeywell.

ii. Impact: Any other devices and equipment not of the existing manufacturer will not provide correct interface and operability with the existing fire protection system. The fire protection system is critical for safeguarding patients, visitors, staff, and the facility. All nine (9) buildings are on the Honeywell fire alarm system. Any new system used for the data center and any new data/ telecom closet would require a new panel to be installed and dual monitoring by VA personnel, notifications to local fire departments and tie in to the fie suppression system. This system would require approval from OIT to access the VA system with new security and privacy controls in place. The cost of adding a new system would be prohibitive compared to the 0.005% of extending the current system. As a result, there would be two separate fire alarm systems on station indefinitely as the cost to a completely new system is cost prohibitive. An additional service agreement would also need to be entered into for this system. Modifications of the existing without the correct OEM components and service will compromise the integrity of the entire system. Factory trained and authorized service must be located and supported by OEM within a limited travel time to provide emergency service support. The vendor’s service personnel would also need to have access to the VA system and would need to meet security and privacy controls.

e. Locksets and Cores

i. Best Locks.

ii. Impact: Any other manufacturer will not interface and provide operability with the existing locksets and cores used in the facility. Best locksets and cores have been used in this station and and will be required for a 100% fully compatible system of locks and cores, without creating the redundance and of multiple master keys. Best locks are used on every opening in every building on campus including main doors in the four (4) CBOCs. This includes the dual access to VA data/ telecom closets. The master key system is keyed to the Best locks and adding another lock would require another master lock. OIT would have to approve another lock system for their data/ telecom closets which have separate keying. If another lock is used, then all existing data/ telecom closets would need to be changed to match and then require new security keys issued. This would pose a security issue.

Therefore, continuing with the Best locks would: 1- would not restrict the market as Best lock is commercially available (not distributor dependent) to all hardware suppliers, 2- keeps VA stock at a minimum, 3- reduces the number of keys VA personnel would need.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) set-aside. This Justification for Other Than Full and Open Competition will be posted to Contract Opportunities with the solicitation.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The Government estimate was prepared by the VA team and confirmed by the Contracting Officer's Representative (COR). The anticipat- Government for the items requested to be brand name is approximately

The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

The market research for the required brand name items was conducted and prepared by the COR and A/E. This information was then shared with the CO for further review. The CO was in concurrence with information provided that supported these brand name items. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the entire Wilmington VAMC.

The market research concerning the required brand name items was previously conducted when the procurement of these items were originally purchased. The manufacturers and products are exclusively acceptable for reasons outlined in this J&A.

An additional purpose of the market research was to ensure requirements of the Buy American Act (BAA) has been met for each of the brand name items identified. The A/E team reviewed each of the compliance standards for the BAA and compared it with the components in each of the brand name items. After their thorough review, they have concluded that each item is in compliance with the BAA.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

The new components (software and servers) must be able to tie into the existing and operational systems including the use of existing hardware. At this time, there are no competing vendors who have the programming rights to the systems, and products must be fully compatible with the existing systems being used at the Wilmington VAMC. Installing a different manufacturers system would create significant duplication in costs for the government that is not expected to be recovered through competition, and the systems are unable to interface.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.
